I am from Uzbekistan. I applied for visa 2 month ago and my application was rejected. Here's the text of ECO's supporintg evidence:

Therefore, I do not consider that you have demonstrated, on the balance of probabilities, that you have sufficient command of English to foolow the course as you wil be required to understand complex phraseology on the Diploma of Business Administratioin course. Paragraph 57 (ii) of HC 395

* I note that you have stated you will return to Uzbekistan and resume your emplyment. However I do not find it credible that a company which is providing no financial contribution towards your costs, can genuinly expect you to return and continue your employment with them. Even though your employer state in their support lette that the company needs specialists they are not providing any funding towards your trip. As such I am not satisfied on the balance of probabilities that you intend to leave UK at the end of your proposed course. Paragraph 57 (iv) of HC 395.

Now I've got a letter that confirmes that the company I work for is ready to pay 50% of all costs. But I have no TOEFL or IELTS. I've got English Proficiency document from the University I graduated from, it is signed by the Head of English Language Department and by the Dean of my faculty. I have also some certificates of English.
Today is 26th day since my application was rejected and I have to decide whether to make an appeal or not in two days. Please give me advice! Will these docs satisfy ECO or not? And is it real to get visa quickly or it will be considered for 1 year? I've read on UK visas site that an appeal will be concidered by Senior ECO, and if the new docs satisfy him, he will give a visa immediately, not sending my documents to London.

I don't want to wade into anyone's argument but my sister and I applied for our British P in 1994 too and received it on the fourth day too. Prior to this, we used to travel on my mum's passport.

We were asked to bring several documents but the only document we took was our birth certificate. I guess my mum was thinking about us being on her Nigerian passport and issues to do with dual nationality, hence did not give us her passport to take along and it would have taken my parents a long time to dig up their records.

We just told them there was a fire and . . .British people keep records hence were able to use only the birth cert that we supplied. When I reapplied for my passport ten years later, they brought out the original application form I had filled then.

Copies of the determination was forwarded to myself (the appellant) and the Presenting Officers Unit on the ? ? ? (January date). The five days for the respondent (ECO) to appeal the determination of Judge ? ? ? lapsed on the (date on letter plus five days), hence I am using this correspondence to remind (the post) of the statutory duty under s87 of the 2002 Act for ECO's to comply with the Judge's direction.
Would be looking forward to hearing from you with regards to presenting myself to the visa section.

I suggest you appeal, as well do the proficiency test exams ASAP, get a letter from the company that they will be willing to sponsor your degree program. All this documents you will submit later on as the appeal goes by.
It might take up to a year though before the outcome gets known.

But in the meanwhile, I will suggest you appeal urgently.

This 5 days things I still insist is for Asylum cases and that is if you are in the UK, not for Non-Asylum cases as you have mistakenly stated it here again.

Or have you been once deported ni? You like that 5 days seriously

Big_bumper just gave you a well documented write-up as to your case. It is very simple to understand. Just type the mail and forward it to the High Commission.

But it not  5 days as she stated there.

I am not disputing the fact that it is applicable to asylum cases as I don't know much about asylum cases BUT it is also applicable to students visas too.

You don't need to but you could try submitting two letters one headed reconsideration, the other appeal, with your verification letter from your employer and your previous place of study's proof of your proficiency in English. They can have the same content. The logic is for the senior ECO to be able to review his colleague's decision based on the new information you supplied.

If the decision can be reconsidered it would be better than an appeal that could take anything fron four months to six months.

Substitute the first ? ? ? in the letter for the date the judge sent you the decision and the other ? ? ? is for the name of the judge and the post is Brritish High Commision.

now my question is that shud i consider this letter as visa approval or shud i expect some more hurdels, ?, is it usual that they have approved my visa without hearing of appeal, ?, i am much worried now a days that wht can happen in coming days as this situation is not usual,,, and things are unexpected, plz throw some light over it and guide me, i hope someone will reply me, thanx in advance,

Strange it is your first post

I think you will be given, ECO might have reconsider the earlier refusal. Beside Valid college letter, these days they were asking for updated Sponsors bank statement as well.

i was searching the forums to ask my question abt uk visa and i found this forum,

they have not asked me the bank statement , refusal was on college, my question is can they refuse me again or any other problems, ?, coz the decision did not come from judge yet, hearing is next month, thnx for replying,

UK Passports applied for through the BHC Lagos are issued by the Consular Dept of the BHC/ FCO (Foreign & Commonwealth Office) .Inside the passport the originating BHC issuing the passport used to be clearly written .Nowadays,its just written FCO inside.UK Visa,UK Passport Agencyand UK Immigration Service all share the same database and facilities and make up the staff of the BHC as most staff are multidisciplinary staff from different UK Government Dept's on secondment.

To answer your question the way you put it, the British passport booklets are made in UK but can be issued through Foreign posts such as the British High Commission Abuja or the Deputy British High Commission in Lagos.

I knew the booklet passport emanate from UK.

I knew about the database so i don't really need enlightment on that.

So you apply at BHC on monday with documents and the Passport office in london issue the passport and the consular department deliver it to you on Thursday.

24 hrs multiply by 4 days = 96 hours

Getting UK passport in lagos within 96 hours, I rest my case on this.

I remembered following Kemi to British high commision's office in 1993 for the same thing.

Through Kemi, i first knew their Ibadan office which is located in a very "strange" place in Ibadan, which is adjacent to Alhaji arisekola's Old bodija house. The application takes more than a year.

Lagos would be earlier but not 96 hours.

Before they issue the visa, they will ask you to sign a document that you are withdrawing the appeal. So the hearing will not take place again.

Consular Dept of the BHC in Lagos (just like any other BHC UK Post) can unilaterally issue UK passports in Lagos without having to go to the Passport Office in London to get it done.

Unfortunately, I don't really know anything about the U.K. immigration system. I have worked only in the United States, and recently, Canada. The experts of the house, Mr. Akolawole, Mr. LondonCool, Mr. VOR, Ms. Funkybaby and the others, might know a whole lot more about how to write an application letter for U.K. immigration. I hope you get a response soon.

For example, those who watched the serialisation of "Lagos airport" programme on satellite would remember the lady that was accosted for using a diplomat's passport. Her passport picture was taken, and numerical algorithm was used to compare it to the one in the aforementioned passport and used to determine the fact that she was not the person in the passport. This is biometry authentication using facial patterns. It has been around for donkey years.

Other examples of biometrics could involve scanning of fingerprints, irises, etc.

That five/six-line letter was specially composed for you, all you have to do is slot in the judge's name and the date the decision was sent to you.

Sorry I am not technologically savvy, otherwise would have sent a "cut and paste" one to you personally, via your email address. I have a faint recollection of what my email address is, but never know what my password is. I also tried to listen to the recording you attached but chickened out once some "real" thing flashed on my screen.
