This post is NOT in support of the SENATE or SAGAY it is a post to highlight a POINT OF LAW not emotion. The popular narrative is that the Senate is wrong. In my opinion the 1999 Constitution gives them enabling power to summon anyone (witness implies giving testimony and does not preclude the individual him/herself).

It is also to POINT OUT to Nigerian's that a country is run on laws NOT emotion or popularity. This is one reason we keep going round in circles. Keep yourself abreast of the Laws of the Federation of Nigeria.

Why not educate us by posting the relevant sections of the 1999 constitution that gives them this power.

The govt of Buhari has suffered a lot of attacks on this policy, despite that it was not his govt that introduced it, but hey, with attacks also come accolades. I can vividly remember when Guardian erroneously announced their incompetence to the whole country last year that the current govt has increased duty payable on car imports despite that same has been introduced and implemented since 2014.

A lot of people went on abusing spree, complaining that the present govt wants to squeeze the citizenry to the extreme, whereas, it was same duty of 35% on used cars and 70% on brand new cars that has been introduced since 2014. Since that gaffe, I take news reports from Guardian with a lot of caution.

More kudos to the PMB govt for not reversing a lot of policy initiatives and developmental projects of the previous govt like Power privatisation, automotive policy, TSA, BVN and ongoing infrastructural projects.

It has demonstrated to the world that the Nigerian govt can be stable with policies even after political change. It's indeed a good one to boost investor confidence.

Her degree is a B.A Geography.

Drinking Fanta, Sprite with Vitamin C is toxic, Nigerian Court rules; slams NAFDAC

A Nigerian Court has ordered the National Agency for Food, Drug Administration and Control to direct the Nigeria Bottling Company Plc., manufacturers of Fanta and Sprite soft drinks, to include a warning on the bottles of the product, that its content cannot be taken with Vitamin C.

Justice Adedayo Oyebanji of the Lagos High Court, Igbosere, gave the order following a suit filed by a businessman, Fijabi Adebo, and his firm, Fijabi Adebo Holdings Ltd.

The legal action, which was instituted in 2008, had NBC and NAFDAC as defendants.

Mr. Fijabi’s lawyer, Abiodun Onidare, told the court that his client bought large quantities of different products from NBC for export to the UK but when they arrived at their destination, Fanta and Sprite failed UK Health Authorities’ (Stockport Metropolitan Borough Council’s Trading Standards Department of Environment and Economy Directorate) sample test for human consumption, as they became poisonous when mixed with Ascorbic Acid (Vitamin C).

The claimants demanded N15.1 million as special damages and N1.6 million being the money the NBC admitted it received from the claimants.
In its defense, the NBC, through its lawyer, T. O. Busari, said it was not negligent as claimed by the plaintiff, saying it has stringent quality control procedures to ensure that its products are safe for end-user consumption.

The NBC argued that the levels of the chemical components in its soft drinks are safe for consumption in Nigeria and that the claimants are not entitled to the recovery of damages arising from their illegal exportation of products meant for local distribution.
NAFDAC did not file any defense in the case.

Justice Oyebanji ruled that the knowledge of the Nigeria Bottling Company that the products were to be exported was immaterial to its being fit for human consumption.

“The court is in absolute agreement with the learned counsel for the claimants that soft drinks manufactured by Nigeria Bottling Company ought to be fit for human consumption irrespective of colour or creed,” he said.

“It is manifest that NAFDAC has been grossly irresponsible in its regulatory duties to the consumers of Fanta and Sprite manufactured by Nigeria Bottling Company.”

The judge said NAFDAC had failed Nigerians by its certification as satisfactory for human consumption, products which in the United Kingdom failed sample test for human consumption and which become poisonous in the presence of Ascorbic Acid ordinarily known as Vitamin C, which can be freely taken by the unsuspecting public with the company’s Fanta or Sprite.

“The court, in the light of the damning evidence before it showing that NAFDAC has failed to live up to expectations, cannot close its eyes to the grievous implication of allowing the status quo to continue as it is,” the judge said.

He ruled that, “That NAFDAC shall forthwith mandate Nigeria Bottling Company to, within 90 days hereof, include on all the bottles of Fanta and Sprite soft drinks manufactured by the company, a written warning that the content of the said bottles of Fanta and Sprite soft drinks cannot be taken with Vitamin C as same becomes poisonous if taken with Vitamin C.

“In consideration of the fact that this case was filed in 2008 and that it has been in court for nine years, costs of N2 million is awarded against NAFDAC. Interest shall be paid on the costs awarded at the rate of 10% per annum until liquidation of the said sum.”

TCN asks us to reduce electricity generation, Gencos cry out


While most Nigerian individuals and corporate organizations are suffering from lack of adequate electricity supply to meet their consumption needs, the nation’s electricity Generation Companies (GenCos) have cried out that the Transmission Company of Nigeria (TCN) has been directing them to reduce generation, which cost them huge revenue losses and damage to their plants.

The Managing Director of Mainstream Energy Solutions, Operators of Jebba and Kainji Hydro Electricty Plants, Engr. Lamu Audu, told journalists, in Abuja, yesterday, that the GenCos could no longer bear the constant energy production reduction orders of the TCN.

He revealed that between February and Monday (March 13, 2017) Jebba and Kainji alone lost 8, 574 MW unutilized electricity. He said that the total unutilized energy from all the GenCos in the period under review was monumental and most painful at a time most Nigerian homes and business hardly had enough power to meet thyeir consumption needs.

His words, “Generation has improved significantly. On the average it has been above 4, 000 MW in the last one month.

“Unfortunately, we (GenCos) have been at the receiving end. In the sense that we are not allowed to deliver what we are generating. I have records here, there is no secret about it and we want Nigerians to know that the effect is so much.

“ Apart from the loss of revenue after declaring what we are capable of generating, because we have what we call, “Day-Ahead-Declaration” by the regulation, we are expected to declare within the next 24 hours what we are going to generate, the capacity which we have and are sure to put into the grid –which we declare to the National Control Centre.

“It is a rule that you must declare in 24 hours that capacity, the idea of the declaration is to enable the system operator to prepare for what it has to give out.
“Unfortunately, most of the time, we are not allowed to put the whole energy we have declared 24 hours earlier into the grid.

“There are two things that happen: One, our machines will see that the power being generated and put on the grid is not utilized fully, so they will on their own de-load, they will come down on their own.

“Secondly, we receive direct instructions from the National Control Centre to reduce load or even shut down. We have the records here.

“What that means is that we have stranded energy. That is energy that is not being utilized. Now, one we lose revenue that should have come to us as a result of that energy that is not utilized.

“In addition, it has technical effects on our machines, leading to increase in the cost of maintenance.
“The third is that our shareholders are beginning to ask questions as to why should they put more money to realize more capacity, if what we are generating now is not being utilized. So you can see that it has weakened the appetite of investors to invest more in the generation of electricity.

“I just felt I should share with you events that took place between February and March (2017). Within the February and march, the total energy that could not be evacuated from Kainji and Jebba is 8, 574 MW. This is the energy that could not be evacuated either as a result of direct instruction from the National Control Centre or the frequency going up and our machines shutting down.”

RE: INVITATION TO BRIEF THE SENATE

May I respectfully refer to your letter Reference No. NASS/CS/8S/R/09/29 dated 9th March, 2017 and inform Your Excellency that the decision on payment of Customs duties by vehicle owners who do not have them as prescribed by law is currently being reviewed.

2. The goal of the review is to take a broad additional input from stakeholders and the public on all its aspects. I will welcome opportunity to avail the Senate on our findings and the way forward on improving our capabilities to plug major drainages in the nation economy without adding to hardships and within our mandate.

3. Regarding the wearing of uniform, I wish to advise that the Senate avails itself of the legal basis of its decision to compel me to wear uniform. I am similarly seeking legal advise on this issue, so that both the Senate and I will operate within the proper legal framework.

4. I regret my inability to answer the Senate invitation owing to a recent bereavement. I will however, make myself available whenever I am needed in future.
