ILIDEFI: Yeah, d court will decide. But a judgement had earlier been made dat there is no division, factions or merger in PDP. APC was formed following a merger of parties, so if anybody decamped from APC, he was safe. Not so for PDP. In essence, you agree that the court will decide. The judgement you alluded to was some 3 months before the events in Sokoto state and therefore cannot hold as regards his defection some months later. So in essence, until a competent court declares that there was no faction as of his time of defecting, he remains a member of HOR. And until 2/3 majority of the members of the HOR vote him out, he remains the Speaker of the HOR. |

ILIDEFI: Section 68 of the Nigerian constitution. Take note of sub section 1g:
68. (1) A member of the Senate or of the House of Representatives shall vacate his seat in the House of which he is a member if -
(a) he becomes a member of another legislative house.
(b) any other circumstances arise that, if he were not a member of the Senate or the House of Representatives, would cause him to be disqualified for election as a member;
(c) he ceases to be a citizen of Nigeria;
(d) he becomes President, Vice-President, Governor, Deputy Governor or a Minister of the Government of the Federation or a Commissioner of the Government of a State or a Special Adviser.
(e) save as otherwise prescribed by this Constitution, he becomes a member of a commission or other body established by this Constitution or by any other law.
(f) without just cause he is absent from meetings of the House of which he is a member for a period amounting in the aggregate to more than one-third of the total number of days during which the House meets in any one year;
(g) being a person whose election to the House was sponsored by a political party, he becomes a member of another political party before the expiration of the period for which that House was elected; Provided that his membership of the latter political party is not as a result of a division in the political party of which he was previously a member or of a merger of two or more political parties or factions by one of which he was previously sponsored; or
(h) the President of the Senate or, as the case may be, the Speaker of the House of Representatives receives a certificate under the hand of the Chairman of the Independent National Electoral Commission stating that the provisions of section 69 of this Constitution have been complied with in respect of the recall of that member.
So what does that tell you? Is it not what I tried explaining?
The part of constitution you are referring to talks about removal of a speaker or his deputy. I'm talking about membership of the house itself. If a speaker loses his right of remaining a member of the House, can he still remain a speaker? Nobody is arguing about the procedure of impeachment of a speaker here.
Tambuwal is a lawyer, yes. But he broke the constitution, simply because others have been doing it and getting away with it, so he felt he could also do it and get away with it. He may still get away with it finally, but his move was unconstitutional.
If you're not willing to make proper research before writing, then don't quote me again. Now read the part in BOLD . What does it mean, who interprets it, is it applicable in this instance? These questions I asked are the reasons why only the court can decide what the answers are and thus determine the faith of Tambuwal. |

I have a feeling we will always agree to disagree. let me give a final analogy and rest my case. A man who kills someone in broad daylight with witnesses around is deemed to be innocent under our law until a competent court declares him guilty. This means he has basically the same rights of any citizen like you and I. Immediately the court pronounces him guilty however, those rights cease, not before. Same way the election of this man, even though he might have colluded with Inec is still deemed valid and with it all accompanying rights until the supreme court declared otherwise. There is no allegation here that his Inec certificate was forged. He should not be asked to return salaries earned while he was having a valid certificate. However if he was paid any salary after the court's declaration he is bound to return same.
I rest my case. shalom! Sorry to disappoint you, the man has no rights like me. He is presumed innocent, yes, but he has limited rights. Once he is charged, he is either in Police custody or remanded in prison. Once this happens, he has no rights like me a free man as he cannot vote, move freely, and so many other things. How can he believe he won an election he knew he did not participate in? Are there two of him? Presumption of innocence is different from restitution. |

The local production cost in Nigeria is about 20-40. Talk to any futures trader, they will tell you what numbers their firms use in hedging cost in Nigeria. Bros, you do certainly mix things up. A futures trader is talking about "Cost of Lifting", which translates to Upstream Cost and not production Cost. Nigeria does not pay for it at International price, it is only used to account for the crude oil used for the subsidy system. At the worst, one would use a weighted average system and not use the spot price considering that there are other associated costs with spot cargo that are not incured by local refining. |

atlwireles: NNPC does not need the spot market. In 2005 Obj changed the price formula, where NNPC contract are based on the 30 days NYSE price average, for the 445,000 barrels allocated for our local refineries. That change was to be able to calculate the differential that should be the "Subsidy" to be accrued to NNPC. This helps to determine a true and fair value for the cost of the unused crude allocated for local refining. So please do not muddle things up. |
