4. Law enforcement officials, in carrying out their duty, shall, as far as possible, apply non-violent means before resorting to the use of force and firearms. They may use force and firearms only if other means remain ineffective or without any promise of achieving the intended result.
7. Governments shall ensure that arbitrary or abusive use of force and firearms by law enforcement officials is punished as a criminal offence under their law.
Would you call the use of the socalled blank bullets which is confirmed to be injurous even if it can't kill as it is erroneously believed? Especially when it was used on eaceful unarmed protesters waving national flag and singing the national anthem?
Guy please i dont know who you are but i repect your tenacity in trying to downplay the foolish irrational act of the Nigeria Army but NEWS FLASH! They will not get away with this so dont bother responding to this.
Thanks and have a great sunday. You are dancing from pillar to posts now. From your posts alone, it says they MAY USE IT. That is all that matters, that the law allows them to use it. QED. Some things are not sentiments, they are simply hard facts and data, no need being emotional. For avoidance of doubt, if the army fires live rounds from their rifles for like 2-3 minutes into a crowd of 50 -100 persons, you will not be looking for evidences of death after 27 days, it will be clearly apparent. Just as them no dey look for evidences that a woman is pregnant after 6 months, it shows by itself. |

Toks2008: Exerpts from the revelation reads
"At the hearing of a judicial panel of enquiry today in Lagos Nigeria, Brigadier General Ahmed Taiwo, who heads the Army’s 81st Division in Lagos, when shown a photo by Reuters which he used as testimony to prove the army only fired blank rounds, said two bullets among the 11 shown were live rounds, one spent and one unspent. He said they were not the army’s but perhaps from the police".
So whilst you try so hard to defend the use of blanks, it has been admitted that live rounds were used and we will know more truth as it unveils. Good that Reuters found 2 bullets that were live round, the question then would be: a. Where did Reuters find those bullets? b. Who gave those bullets to Reuters? c. A determination of who fired those bullets. However, at the end of the day, the main crux of the matter still remains valid, who are who died at the Lekki Toll Gate? |

Babinski: While Lee's death may be termed a mistake from a supposed blank, a more appropriate reference is the death of Jon-Erik Hexum from blank cartridge which shows blanks can kill.

https://www.mentalfloss.com/article/71752/how-do-blanks-work-compared-regular-bullets
https://en.m.wikipedia.org/wiki/Blank_(cartridge)
It is also important to note that if there is any other thing in the barrel, it will come out with projectile force. As such, using blanks need to be very well planned if fatalities are to be avoided.
Now imagine Nigerian Army going to meet protesters whom they claimed became violent. Do you think they will first load their guns with blanks and when the situation becomes dangerous they switch to bullets? This is the same Army accused of war crimes in Borno by Amnesty o. The same Army we all know shoot to kill rather than to warn or play. In the same country where Police never use rubber bullets. Then the Army starts to shoot blanks?
Please, the Army and the blanks story just doesn't measure up and going by their different conflicting statements starting from the claim that they were never at the Toll Gate to the claim that they didn't fire on protesters and then that they later fired blanks, the only valid conclusion is that they are liars. All your citations are about the same incident, the man had the gun under his temple. He was an untrained person handling a gun. The NA is a trained unit, with hours of training thus they aren't gonna put the rifle under the temple of a person except they intended to do the person harm. Thus all this stories about blanks killing people is a waste of time. For example, under certain conditions, drinking water will kill a human being, but that is not what one will be using to proof death when the subject is offered a simple glass of water. To reiterate, that a man lied to a father that he doesn't know a girl or even ever talked to her, and it was discovered that both were lies does not automatically imply he is guilty of raping the girl or responsible for her pregnancy. The only valid conclusion to make is that NA personnel fired blanks INTO the air to disperse protesters. |

Babinski: DJ Switch should be arrested on the testimony of an agent of an accussed party? It is ridiculous for the Judicial Panel to allow the Army as an accused party to present one of their own as expert witness and also submit blanks that were not taken from the crime scene in the presence of credible witnesses. Do you go to court and say the accused should be presenting his family members as expert witnesses? Where is the objectivity?
Even if we assume without conceding that they used blanks, do you know that blanks for a pistol used in filming killed Bruce Lee's only son? Do you know several actors have died from blanks fired from pistols? Do you know the muzzle velocity of pistols compared to rifles? And he is saying even if he presses the rifle on a person and shoots a blank nothing will happen? That is a blatant lie.
Also, why do you as Army come to a peaceful protest with civilians if you wanted to shoot blanks? You bring an armoured tank to a fight and you say it is to spray water? And you want us to believe you? Everyone knows it is the Police that have the constitutional duty for security in civilian protests except it becomes very violent. That the Army showed up is already indicting.

So apparently,. someone had made an error. When a blank is fired, Mr. Rosen said, a piece of soft wadding normally comes out of the gun. But this time a metallic projectile came out, he said. As for lethality of blank bullets, it depends on cartridge type, distance and where the victim is hit just like with real bullets so it is potentially lethal.
Furthermore, the sound of it can also create serous commotion in large crowds that could lead to stampede or people running to their death even if not directly from the blank bullets.
And this is if indeed real bullets were not used.
And @Akainzo please go and get your facts right.
The use of rubber or blank bullets on! (UNARMED PROTESTERS) is a serious crime. You are totally WRONG. A BLANK bullet has no PROPELLANT, thus it is fired and ejected from the casing and simply lands at the feet of the shooter. The only person that is at risk from Blanks is actually the shooter. This are questions that need urgent answers before God go vex for us in this country. The person announced by Sanwo-Olu died from BLUNT FORCE injury! A bullet does not cause blunt force injury. That doctors operated on someone that was at the Lekki Toll gate does not imply that he was shot by the army, he could have had an accident, he could have been attacked. Sermwell: You must understand that the federal law makers didn't absent themselves from legislative business. And of course they didn't just wake up one morning to resume after a long time, to impeach the Senate President when their seat are in contention before the courts. The Edo state law makers didn't help themselves in this case. What even stopped them from doing all these shortly after their inauguration? These law makers have slept on their rights and the court may no longer take them serious, hence the court of first instance has already rule their seats to be vacant. Well, no matter how we try to analyse these issues here, it will certainly not be very clear who is on the wrong side of the law! But I think the court will not be pleased with the political dimension of this case. Thanks for at least moving away from the illegality you were touting previously, as we have now both agreed that only 1 proclamation is needed and they other lawmakers can be sworn in by the Clerk or Presiding officers later. As to why they didn't attend plenary, the question will be: Were they invited to be sworn in? Did they attempt to be at the HoA complex and were prevented? Were they refused being sworn in? The answers to the above will help the court to determine if their seats are vacant or not, but for now, until the courts determine otherwise, they are valid fully elected lawmakers of the Edo State House of Assembly. |

Sermwell: So the governor issued a proclamation for the swearing in of the other 14 members?? He has already done that for the swearing in of 10 members in which other members were absent(for whatever reasons) and subsequently refused to partake in any legislative business of the state. Now my question to you is that.....is the governor required by the constitution to issue proclamation twice? And by what proclamation was the subsequent 14 members sworn in? I am happy we both agree the constitution has not been violated. The proclamation is only issued once, as a proclamation is about the COMMENCEMENT OF THE LEGISLATIVE TERM, it has nothing to do with inauguration. Cast your mind back to 2015, PMB issued a proclamation and the PDP members of the Senate with Saraki were inaugurated, and Saraki was appointed Senate President while the majority APC members of the Senate were having a meeting with the President. Did the President issue a second proclamation for the other members to then be sworn in? Of course he didn't as a proclamation is only issued once, and once the legislative activities have commenced, other members can be sworn in by the Clerk or the Presiding officers of the House. So clearly, the other members do not need a proclamation to be issued by Obaseki before they can be sworn in, and that is also what the court said. |

The court is yet to decide on their membership of the house, and whatever they are doing now is shrouded in illegality....and they all know it....but they are fooling the masses to argue nonsense. Since you are a lawyer, let me take you up on your stance. By the constitution, they are elected members of the House of Assembly. By the constitution, until a competent law court declares their seat vacant, they remain elected members of the House of Assembly. By the constitution, if a High Court declares their seat vacant, and they appeal at the Appellate Court, they remain elected members of the HoA. Now to the issue of inauguration. By the constitution, a Governor issues a proclamation of the House TO THE CLERK OF THE House of Assembly. By the constitution, it is the Clerk that inaugurates or swears in members of the House of Assembly AFTER the proclamation. By the constitution, the Governor has done the proclamation, and 10 members were sworn in earlier. By the constitution, the clerk/House has now sworn in the other 14 members of the House of Assembly. Please, do let me know which part of what I enumerated above is the illegality that you are referring to. |

Try to read the following, this time very CAREFULLY:
“He said those making the claim were misinterpreting Section 145(2) of the constitution...
He said, “The sum total of that subsection is that if the President fails, refuses and or neglects to transmit power to the Vice President, the National Assembly is mandated after the period of 21 days to pass a resolution empowering the Vice President to start to act automatically ‘as the Acting President of Nigeria’.
“That section did not and never provided that it is only when the President will spend more than 21 days outside the shores of the country, that he will be required to hand over power to his Vice President.
“The 21 days provision is meant to give the maximum period the President will be allowed to be in breach of Section 145 of the Constitution as the National Assembly will come in to do what the President ought to have done in the first place by mandating the Vice President to act in the place of the ‘travelled President’.
“The President has breached the 1999 constitution, no doubt, by his inability to transmit power to the Vice President of the country for the 19 or less that he wants to spend for his “private visit’ in the UK.
“His “private visit’ has no place in Section 145 of the 1999 Constitution in the first place. He is only allowed outside the shores of Nigeria for official visits, medicals and or vacations.”
Ubani said the signing of a bill by Buhari in London did not speak well for Nigeria’s sovereignty.” Clearly, you are fixated on accepting only his, Ubani, version of interpreting the constitution. Open your mind, and read what others are saying. If the NA cannot trigger that section until 21 days, it implies the President can do whatever he wants so long as he doesn't fall foul of that provision. Simple logic, simple stuff. If they say, your employment will be terminated or consequence management will be applied after 21 days, if you don't show up at work, does it not imply you are free to go away for 20 days without consequences? KEVIND: Judges Now Afraid To Perform Their Duties, Says NBA President
Paul Usoro, president of the Nigerian Bar Association (NBA), says judges in the country are afraid to perform their duties as expected due to fear and intimidation from the executive arm of government.
He spoke while delivering an address at the association’s national executive committee (NEC) meeting, which held at the NBA secretariat in Abuja, on Thursday.
Usoro also spoke about the high level of insecurity and poor state of the rule of law in the country.
He expressed worry over the “intimidation of judges by members of the executive arm and security operatives”, saying that judges now “operate under an oppressive and pervasive climate of fear and insecurity.”
“Our Jjudges are threatened, intimidated and blackmailed mostly by the executive arms of government and their agencies both at the federal and state levels,” he said.
“Our judges cannot deliver justice under a climate of fear and intimidation. Justice thrives where and when there is an independent judiciary. There can be no such independence when there is no security of tenure for our Judges. There can be no independence of the judiciary when our judges are intimidated, threatened and blackmailed by state agencies and their officials.
“There can be no independence of the judiciary when our judges are actively coerced by state officials to think and reason only in the manner that those officials and, presumably, government want them to think.”
The senior advocate of Nigeria also lamented over how some members of the association were victims of the high rate of insecurity in the country.
“My dear colleagues, as you would observe, I have given you three illustrative instances of the insecurity that pervades our land from the three NBA Nigerian Zones – East, West and North – and that, by itself, makes the point that no part of our country is safe,” he said.
“No region is safe, and no tribe is safe. No one indeed is safe. And yet, we have governments in place, at the federal, state and local government levels and the primary business of governments is the protection of lives and property. Indeed, without security of lives and property, everything else grinds to a halt.”
He called on the federal government to address the security challenges in the country and urged public officials to adhere to the rule of law.
https://www.nairaland.com/5258051/judges-now-afraid-perform-duties I differ with Falana on the issue of the Presidential Aides, the aides are personal appointees of the President and their tenure elapses either along with his or when he decides to terminate their appointments. Presidential aides and SGF do not require ratification or consent of NASS and thus their tenure does not expire except if the tenure of their Principal expires. Ministers are a different kettle altogether as the constitution is clear as to their tenure. On the case of SGF and the Presidential aides, the learned luminary's position is not supported in law. |

Imagine a presiden who rode to power the first time on claims of fighting corruption yet when the bill to enable accountability is brought to him, he suddenly develops cold feet yet his gullible supporters still believe he's fighting corruption That the Police don't arrest all criminals at once, or make mistakes to allow some criminals get away does not imply the Police is not doing its work! That the President hasn't signed this particular law does not imply that he isn't fighting corruption. Evaluating life on the basis of absolutes of ALL or NOTHING is not a very good philosophy. Life is not Black or White, but varying shades of Grey, plus every successful person learns to choose their battles. The key question is, if the lawmakers who are representative of the people and who actually have the oversight responsibility that the Audit is supposed to facilitate cannot believe so much in the Bill as to move to override the President, then maybe there is something more than just the Bill. |

bishopkay: I'd the bill didn't have the support of the legislators, there's no way it could have scaled first second and third readings.
What I am saying is emphasized in the stupid partisan mentality associated with Nigerian legislators especially members of the APC in this current dispensation where good bills would the president refused to assent to are fought against by the legislators because they think it would embarrass the president. Meaning the president is our law and guide and whatever he is uncomfortable with, all Nigerians should automatically feel the brunt too no matter how beneficial the hitherto bill would be for people. Then we also have some very mad supporters who feel the country and everything ought to revolve around the president, his whims and caprices.
Hope you understand me now my friend You obviously missed the fact that there are different requirements for passing a bill for assent and overriding the President. For passing a bill, the NASS needs a simple majority of those that were in the auditorium on the day of the decision, thus for Senate, that is 16 votes! To override the President requires a 2/3 Majority of the entire NASS => 2/3 of 469 = 310 Votes! To muster such number requires so much politicking and an assurance that the said Bill is going to enjoy widespread support by the populace. Leave all the talk of embarrassing the President, all is politics. The real thing is knowing that getting the 310 votes is a herculean task. |

lapazi: Nice one, i feel that this should also be the best approach by law, however what happens in a situation where the gated area doesn't only house the Bank?
I have seen a couple of Bank premises that reside in a rented building!
Plus at bolded, i havent seen a Bank that does that. In a shared or rented premises, whoever is in charge or responsible for the placing the security personnel at the entrance or "gate" assumes liability by that act. |

bishopkay: When you answer the question I asked then I'd give you a robust reply. But perhaps I should give you a sneak peak into what happened when the national assembly wanted to override the electoral bills and some others before and after it?
Some senators of the APC said the Saraki led national assembly wanted to embarrass and humiliate the president hence they worked against ever getting a 2/3 veto to override the president's stance. Does it ring any bells? In essence you are saying the bill doesn't have enough support amongst the NASS members for them to override the President. |
