Even EFFC can investigate CJN. Now consider a sitting governor with immunity. EFCC can investigate and build a file but cannot charge him. No matter how weighty the file the president cannot remove him from office. But House of Assembly can. We should not argue with emotion but with the laid down law and procedure. If you think the law is inadequate there is a procedure to amend it. |
Buhari seized Pa Awo's passport (opposition leader o, not in parliament or previous govt) and jailed Pa Ajasin despite court saying no case against him. Back in 1983. Oblitz:Apparently no. The National Judicial Council can recommended removal or suspension of CJN to the president OR 2/3rd of the senate in a vote on the floor of NASS. Then the president becomes constrained under the law to act. But we know that Buhari has flouted NASS ruling (EFCC chairman) and court orders (Dasuki, Al Zazaki and others) where he is normally supposed to obey law makers & the judiciary. Many Nigerians & especially APC supporters refuse to see that NASS & the Judiciary primarily have legal duties to act as check & balances on the extra-ordinary powers of the executive, NASS to make laws & Judiciary to interpret and dispense justice according to the constitution. Whatever the failures of people running NASS & the Judiciary, those two institutions are VERY sacred and Nigerians should never play with them at any time. Irrespective of who is the president. A president can die & Federal policies can change over night with a new president. BUT all NASS members & entire Judiciary people cannot die at once. Their work is a continuum and always evolving to shape a better society and protect our rights and freedoms. Despite all the power, the president is just one man and he can err easily despite advise from those around him BUT the other arms of government are run by many well educated Nigerians. Two heads are better one. |
