You will need to explain exactly what happened, why you 'forgot' or didn't disclose the previous refusal. Your statements will determine which documents to attach as evidence to buttress your facts. There is no generic documents to respond to misrepresentation.

I will still append a caveat to this until I see an official policy of the CIC on it. The above person In fact waited for his TRV to be approved first before putting his PR application. So this makes sense. This is the same strategy someone mentioned today, that his immigration lawyers asked them to do and a few people criticized the person for it.
Other people shared their own opinion on it and not criticise.

I think enough have been shared on this PR thing. I also shared the link to CIC's website for anybody wanting more information.

We should move on and not drag on it any further. It's now left for anybody to decide on what's best for him/her. Thankfully, it hasn't resulted to fights and insult yet. I think everybody had a valid input in their own right and cumulatively enlightened others to an extent. If there are further doubts, let's do well to further study/research on it or better still send CIC a mail requesting more clarification on the subject.

I cannot say if officers are compelled to use statements made by applicants. But the form declarations as filled and signed are archived which form part of the applicant's immigration profile.

IRCC will have to respond to you regarding that since you didn't declare it in your form. Most often, issue of misrepresentation are referenced from declaration on the application form. I can't tell you how yours will play out. So you just have to wait and see how event turns out.

I've been refused before and while reapplying I ticked yes to that question cause I felt it meant I've applied to enter Canada before. Hope this won't be an issue of misrepresentation o? You don't have to worry about that. And no, it won't be an issue of misrepresentation. You already answered yes and declared you were refused a visa whether you ticked one box or both. It is now left to them to open their records and ascertain when and what happened.

The question is if you have applied to remain, not enter Canada. Thinking about it more, I guess been refused entry at the border does not count as applying to remain in Canada. Been denied a visa also does not count as applying to remain in Canada. You have never entered Canada, so there is no way to have applied to "remain" there. That is why they also ask you if you have ever been denied entry to Canada. That is the question you should have checked yes. That said, no I do not think it will count as misrepresentation. They will know you never entered Canada, so there is no way to have applied to remain there. Worse come to worst, they will issue administration review request and you can explain that it was an honest mistake from your end.

My Cameroon bound guy! Actually, the question on the form is " Have you previously applied to enter or remain in Canada" ?

Being refused entry at the border ofcos means one was denied entry to canada. So it is valid for border denial and not necessarily remaining.

The question of being refused a visa before is the question 2b while that of border, extentions or applications while in canada is question 2c on the IMM 1294 form( application form).

By the way, when is the Cameroun trip? its count down already o. The three weeks you long for is almost due. cheesy

Hello, I'm a silent follower for a long time now. I'm using a consultant in Canada for PR and when they were about to put us in the pool. I told them of mu husband's intention to process study permit, they quickly said they won't put us in the pool for now. we have to wait for the study permit to come out first. They applying at the same time is likely to affect the outcome. I am the principal applicant for the PR.

Firstly, i personally most often admonish people to always find useful information for themselves first from appropraite and reliable sources regarding any issue.

That being said, there is such a thing in the IRCC ACT and REGULATION as "dual intent" with official guideline regarding all that is involved. Find the link here

Some people think you cannot apply for both study permit(temp res) and PR at the same time. This is NOT true. You actually can! As a matter of fact, the requirements and procedures are very clear ,unambiguous and available to who ever need it.

In simple words, IRCC evaluates each application for the category you apply for based on this ACT and it's rule. Officers don't just make a decision on an application. They follow a LAW that has been established as guidelines for each category of their migration program be it temporary or permanent.

Now, here is the confusion associated with this dual intent. For a temporary residence application(Study permit), you MUST prove to officers that your primary intention is to stay temporarily and leave after study. With a PR application filled in at the same time, some people would say or think that it will contradict that aspect of 'returning back after the study' and this is where alot of people get confused and just advise one intent at a time including agents, lawyers etc forgetting that IRCC ACT stipulates for each individual purpose and have it's requirements for such purpose without contradicting the other.

IRCC does not care whether you want to live temporarily or permanently live in Canada or not. When applying for study permit or PR, you must satisfy each requirements. If an applicant does that sufficiently, both status will be issued because they are treated as 2 different files. Non is SUBJECT to the other.

Another important thing we all should understand is that studying in canada is also a process to PR. The only difference is that it is a temporal stay, applicants will have to show genuine interest and must convince officers they will leave at the end of their study even though there is chance of becoming a PR. The IRCC acts empowers officers to evaluate study permit applicants on this premise. They just want to evaluate that if such applicant does not get permanent status eventually, they should have strong hometies to return to without a likelyhood to overstay their temporary status. This can be shown by strong ties to home country eg an established life and job with a respectable income, family business, properties etc.

The fear some folks have while applying for PR and study permit at the same time is that since PR means going permanently to canada, it will not reflect your claim to return back as filled in your study permit application. My only advice will be when applying for both, MAKE SURE you have other strong home ties aside family. You would have satisfied officers of your intent for a study permit by so doing and not necessarily for your PR application.

With that being said, when you apply for a study permit, having a PR application in process or not, you would be evaluated on the same grounds as another person with only study permit application and your PR application will be evaluated on the grounds of another person with a PR application. Nothing is dependent on the other. It's a stand alone process which each individual must meet the provisions and requirements of the established ACT.

Certainly will not affect your application. Yours and his are in different categories with different PRIMARY applicants as well as different requirements.

Because if you are going to be truthful you would say yes and your description would be application for PR. or since they thread differently you would just say no abi.

That part and question of the study permit form as emboldened refers and can only be answered if an applicant applied to either extend their visa, permit and was refused while in canada or was denied entry at the border.

Also, dual intent is allowed by IRCC as long as both applications are not for the same purpose.

No sir/ma'am, you can't do medical now till you are instructed by the Visa officer to undergo one. This is because an IME(immigration medical examination) code will have to be generated to locate your medical result on their database.

The code is either generated by the hospital upfront before you submit your application or IRCC will generate it for you and request that you proceed for one.

Yes, especially if your program is more than a year. Officers will determine if he your sponsor can generate equivalent funds for the next year. So yes, it's important sponsor included a recent account statement with 6 months duration.

No, it will not. IRCC stipulates that funds in LIQUID funds MUST be available for tuition and living expenses for the first year. So by this, showing a source of funds without showing the actual money will not meet this requirement. Let your sponsor show that funds are available.

By the way, i'll advice he transfer these cash into your personal account.

You do not need a medical exams means the upfront medical you submitted is being reviewed and will be updated. Untill then, "you do not need a medical exams"!

I would say 17-25. However, if the are VERY strong and VERY convincing reasons going for undergraduate program as an older applicant, it's still possible but reasons have to be very cogent.

This would be because at a younger age, the primary intention will be more established than when an applicant is older. Alot might be considered for an older person. Preceding events and gaps, economic situation, interest and the viability of obtaining or completing a degree after a certain age and the chances of employability in Nigeria, pending responsibilities(marriage,commitments, etc).

Also note, each applicant is considered a potential migrant. They will consider all you are bringing to their country, your chance of a smooth transition, your value after a certain period(age and achievements inclusive) and also your ability to study without recourse to their resources for any reason whatsoever.

What ever is giving him the confidence that he will succeed in the the new field should also form basis of his reasons for switching. It's that simple!

The VOs are human too, if he can convince himself about his move,then the VO's job will be easier because their job is to see the overal purpose of going to canada.

So my sponsor is my mom, when I was gathering documents, she transferred some money to my bank account (naira account) and stated in her sponsorship letter that the money is to cover traveling expenses to Canada & accommodation purposes while in Canada. I submitted my SOA(savings account) to show this. Somehow I feel like she should have just left all the money in her account & we would have just submitted her SOA only since I'm not sponsoring myself. Dear gurus, what do u guys think, was that a good step?

The money having been transferred to your account is a good step. It shows you have access to available funds. However, it might not be a good step if the source of the funds was not included. Irrespective of whose account the money is, she is a RELIABLE sponsor since she is your parent and what so ever claim she makes will be seen as genuine.

The only concern should be that the funds source was established and documents were also provided. If this was provided, then you have nothing to worry over.

That line doesn't mean one submitted additional documents. It's same for all application once you submit. Only indicate the supporting documents written as additional documents are being reviewed.

Btw, once the eligibility status reads "we regret....... ", it's definitely a refused application. I think applicants should now look out for the eligibility status than the final decision status because, it seems not to be changing since the restructuring of their account dashboard.

Hey guyz.

So i delivered the news and the young man was still filled with joy, shock and gobsmacked when i left. I also requested that i share his profile here as with the tradition to encourage others.

I don't have so much details about the previous refusals but 2 of the 5 were refused for insufficient funds, personal assets, travel history.

The last 3 were all purpose of visit and travel history.
I will give details of the last two and what he did differently.


Timeline for the last 2 application:

Profile:
Undergraduate, Petroluem engineering.
Work experience: 4 years as a well/exploration engineer.
Proposed program: master of engineering, chemical and petroluem engineering.

Applied- Nov 2016, refused 3 feb 2017.
Reasons: Purpose of visit, travel history.

Requested for gcms file. VO pointed out that program is inconsistent with previous study and employment history. Study plan not sufficient to propel additional knowledge. (dis one shock me o).

Last application: Applied April 5th with upfront medical.

Medical passed: may 2.

Approved :June 22.

Document submitted:
Sponsor: Father.
Statements of account of 25m and 12m.
Company documents.
Contract award documents
Sponsorship letter.

His documents:
Undergrad degree certificate (first class)
Admission letter
Certifications
Car particulars.
4 paged SOP
Visas from previous travels
International organisation membership documents.
Employment letter
Pay slips
Recommendation letter

Here is what was done differently between the two last applications.

After getting the gcms file, we paid attention to the officer's concern and noticed he/she could not establish a broader scope of petroluem engineering and his job role as an exploration engineer. SOP was written to open that horizon and give specifics on what he was going to do during his program, what he was going to do in terms of further research and how he intend to also develop a project that would solve the difficulty in oil exploration in the niger delta region since his company works there too.

He didn't give all these details in his previous application so i guess the VO who obviously did not fully understand the scope of petroluem engineering to include exploration/well drilling was quick to find his proposed program inconsistent with his job role.

This was well explained, program desirables were well outlined and future projects/plan/ research were all well laid down. And above all God himself was pleased with the effort made and had to give the officer more space for sense! grin

Like i personally would mention, These folks DO NOT completely know the details and content of some programs. If there is need to expantiate further, please do. SOP is to help open their mind to your purpose and NOT to tell them what is not already shown or seen in your application.

Just to encourage someone!

Someone who contacted me to help review his SOP just got his application approved like 5mins ago! I haven't even told him yet! I want to break the news to him in person! This is his 6th attempt, over the past 2 years!

I encouraged him to give it one last try, he reluctantly did, i practically helped him because i believed he shouldn't just give up especially when he satisfied all the requirements. After applying and linking, he just gave me his account details to be checking his account for him because he already lost all hope!

I can't even contain my joy! I'm almost emotional right now! I can imagine what he will feel as i break this news to him!

5 refusals!! and at last, an approval! Never give up or loss all hope. There is no challenge that is not surmountable. Use the right strategy and above all, just trust God even when you don't see any sign! The process will eventually make you stronger and more determined!

I'm really exicted!!!!!!

If you insist on applying for a bachelor's degree in Canada even though you have one already in Nigeria, be prepared with a cogent and persuasive reason to provide to the school and VO. Many people do this, this is not entirely foreign. It wont mean you have to spend another four years of school to get the second degree. Two more years of studying will get you a second degree in the area of study with the basic prerequisite to go on to the nursing program graduate studies you desire. This is a totally thought out and reasonable proposition you have. Nursing is a very attractive field of study.You should explain this career change to the VO. Perhaps you might explain that a death in the family or the permanent incapacitation of a family member(s) or friend(s) gave you new appreciation for the field of nursing. Go with your guts if you really want to go for a second bachelors. Schools are very cognizant of that. I graduated from university in the United States at 26 years old. There was a 78 year old woman in my class who was our valedictorian and the chosen commencement speaker for our class. Apparently, when we were spending our time playing, this woman understood the value of education and studied her heart out to get better grades than us. Age is no factor in the admission process, except you going to a military school-- in keeping faith with the Canadian government's anti discrimination policy. I do not know how age will play out with a VO once any lacuna period or gaps in education are well documented and sufficient home ties are shown. I think you can totally sail through this, have no fear!! Good thing you asking a year ahead, gives you time to strategize.
My 'cameroun bound brother'! grin Firstly, you quoted the wrong moniker. Also let me congratulate you on your admission and funding as well.

While i agree with you about giving officers cogent reasons for a career switch, the circumstances MUST clearly be seen in terms of
1. Activities.
2. Interest
3. Ability from previous indulgence.

Writting SOP hardly would do justice to anything if there are no evidential materials. Anybody can say anything. As a matter of fact, an applicant can implore the service of a writter to be able to pass these messages across to officers in clear manner and terms.

Nursing being an attractive field also means it is very challenging and demanding while also being highly regulated. Irrespective of the number of years a student will be studying, the first point of reviewing both admission and visa application most likely will be INTENT. At what instance is he/she considering a career in nursing? Why this sudden interest? has previous activities shown an inkling in this path? Is your current age reflective of a desire or interest bore out of what you have written in a SOP? Why have you not considered doing a 4 year nursing program in nigeria where it is cheaper than in canada where it will take a fortune from you and considering the applicant just married and need to be close to spouse?

Another important thing you should know is the system of the western world(US inclusive) and Africa is different. While theirs have genuine intentions in almost all they indulge in, alot of people in africa have the opposite and visa officers working in this region bear this in mind. The scrutiny is intense because the large majority of intent are situational rather than genuine. So using the example of the 78 years old woman might not be applicable in africa where a 60 years old person is already retired and withdrawn to isolation.

Most schools in canada know the issues with applicants from africa, the visa scrutiny and all. So when they review undergraduate applications, they consider the AGE so it will be a smooth visa process not just for the admission.


So while i agree with you in SOME points, most are largely not obtainable the way you make it appear. Canadian visa officers are well trained to work in this part of the world. They most certainly would have seen all manner of well written SOP, it may not be sufficient to just write without showing atleast a little activity in what you are writting about same as explaning any gap without recourse to traces ascertaining for themselves. Infact, they more an applicant try to convince them in writting without evidences, the more difficult it becomes. The have discretion and every part of an application show speak for itself and help them exercise such discretion.

You have to be sure that nursing is what you want, not just because of travelling but because it is going to be worth your while. While applying, you have to include your total education history without leaving anything out and explain your reason for this career switch.

(2)Apply alone, if you get the trv, your wife can apply for a SOWP later. Applying with her especially when you guys are newly married might lead to refusal of your trv. Applying alone gives you a kinda hometie.

(3)As a side note, since you have a.bsc in.statistics/comp sci...why not apply for a masters in statistical machine learning? It is a combination of statistics, computer science and certain aspect of medicine(depending on where you choose to focus on).

I think exactly what you think and thes would have been my sentiments too.

one other thing to note @douglaseguakun is that your AGE is going to play a major role in both being admitted for a bsc program and applying for a study permit with a bsc program.

So like most people have advised, get your study permit using a master degree and when you get to canada, you will have opportunities to study and do what you so desire.
