El-Rufai Violated Land Use Act - Modibbo

Knocks have again cascaded the way of former Federal Capital Territory (FCT) Minister, Nasir el-Rufai, this time from his successor, Aliyu Modibbo, who accused him of high handedness, and of revoking plots in Abuja for "non-recertification," an action which violates the Land Use Act.

Modibbo spoke out when members of the Nigerian Institute of Quantity Surveyors (NIQS) FCT chapter visited him at work in the city on Thursday.

Rather than revoke, he stressed, el-Rufai should have imposed fines and other penalties to caution the defaulters, since "the revocation of people's plots for failure to recertify them as well as in the areas where infrastructure were absent is an illegal act, not backed by law. The Land Use Act did not provide for that.

"The Act never envisaged a situation where somebody will wake up one day and revoke plots for non-recertification. Instead, other penalties were required."

Modibbo disclosed that his administration is working on a proposal to compel developers to pay part of the cost of infrastructure on their plots. The fees will be per square metre, with the money kept in a bank account for the purpose.

He announced the creation of a Procurement Unit in the FCT Administration (FCTA), to be headed by a Quantity Surveyor.

The FCT Chairman of the NIQS, Akinpelu Adewumi, who led the delegation, noted that despite the huge sums in the national budget spent on capital projects, Nigeria has failed to grow because of fraud in the award of contracts, and the wrong use of personnel.

He commended Modibbo on his policy of 'demolition with a human face,' and sought a plot of land to build the secretariat of the NIQS.

Return Of 'Okada', Street Traders In Abuja

The Federal Capital Territory (FCT), Abuja, is regarded as one of the modern cities in Africa. Lately, the city has begun to witness chaos and disorderliness as a result of non- adherence to street and environmental laws by some residents. It should be recalled that the immediate past Minister of FCT, Nasir el-Rufai made history when he aggressively embarked on the restoration of Abuja Master Plan, which the successive administrations in FCT either distorted or ignored or partially implemented. This development led to the massive demolition of buildings and illegal structures that contravened the master plan in FCT and its environs. The Federal Capital Territory Administration [FCTA] under the leadership of el-Rufai also banned the operations of commercial motorcycle riders popularly called 'okada' within the city centre. According to FCTA, commercial motorcycle operators constituted themselves as nuisance on the roads coupled with incessant road accidents caused by them. In this process, many lives were lost and maimed. In addition, it also alleged that motorcycle operators connived with criminals to perpetrate crimes in the city.

In spite of the hues and cries of the public against the ban on okada, the then FCT administration stuck to its guns by sweeping away okada operators out of the city in October 1, 2006. In addition, street trading and hawking was prohibited. Violators of this order had themselves to blame as able-bodied young men from Abuja Environmental Protection Board (AEPB) were on hand to give them the chase of their lives in the streets. Wares and goods of unlucky hawkers caught were confiscated by "action boys" from AEPB for onward delivery to their office. To this end, many Abuja residents are yet to forget the administration of el-Rufai, who they criticised as being "highhanded, autocratic and ruthless".

However, following the change of government and emergence of President Umaru Musa Yar'Adua and the subsequent appointment of Aliyu Modibbo as FCT minister, Abuja is gradually returning to the old order, as illegal structures are fast springing up everyday across the length and breadth of FCT. For instance, commercial motorcycle riders have swung into action, as they can be easily seen in places, such as AYA Junction, Asokoro Crescent, Power House Junction and Mugadishu Military Cantonment, among others. Unfortunately, some of the okada riders are policemen who ought to enforce the law. Since policemen are involved in the seemingly lucrative business, it becomes problematic to arrest the offenders and bring them to book. In an interview recently with Daily Independent, Deputy Director of Directorate of Road Traffic Services, Y .P Jack condemned the actions of the police and said his organisation would formally write to the Nigeria Police Force on the illegal activities of some bad eggs in the Force.

Meanwhile, Jack confirmed that some of the motorcycles of policemen-turned-okada riders have been impounded. In the same vein, Minister of FCT, Aliyu Modibbo, has inaugurated an enforcement team charged with the task of ridding Abuja of filth, vegetation wastes, demolition of illegal structures and settlement. The enforcement team, which comprises the Directorate of Road Traffic Services, Abuja Environmental Protection Board (AEPB), Development Control, Parks and Recreation, Urban and Regional Planning and Facility Management was mandated by the minister to rid FCT and its environs of garbage, construction wastes, demolition of illegal structures and enforcement of ban on commercial motorcycle operators in FCT. The Chairman of the team, Adamu Argungu, said "offenders would be tried by the mobile court and if found guilty, would be imprisoned or made to pay fine".

He warned those who have erected illegal structures and shanties in places, such as Area One, Durumi, Mabushi, Daki Biu, Ruga and Monkey Village to dismantle them and leave the places as the enforcement team would visit them soon. Adamu also sounded a note of warning to street traders who display their goods and wares in unauthorised places to desist from such illegal practice henceforth, as the long arm of the law would catch up with them.

Beyond issuing threats, observers believe that the enforcement team should as a matter of necessity get down to business. First, they need to carry out massive re-orientation of Abuja residents, particularly the traders who see nothing wrong in obstructing traffic and risking their lives in the course of transacting business. Again, many waste bins and dumping sites should be provided and mapped out by Abuja Environmental Protection Board.

It is noteworthy that FCT Administration has set aside the last Saturday of every month for environmental sanitation. Therefore, all residents should be sensitised and mobilised to participate actively to ensure a cleaner city. However, a cross section of street traders interviewed by Daily Independent expressed their inability to afford the "prohibitive cost of shop rents" in Wuse market and other markets within the city. Some of the traders now stay in front of the office of the Head of Service of the Federation opposite Eagle Square to transact their businesses. They appealed to the government to assist them by reducing the cost of shops in FCT. Other traders prefer to be on the streets because of the high patronage of their goods and wares by passers-by.

Ahmadiyya

In India around the year 1879 a Muslim, Mirza Ghulam Ahmad (1835-1908), came to believe that he had been chosen by God as a reformer of Islam. He established his own movement, Ahmadiyyat, and very soon promulgated many changes to the beliefs of orthodox Muslims. He believed that he himself was the Mahdi - the reviver of Islam and the second coming of Jesus in the Spirit. Orthodox Muslims were incensed but could not stop him. According to Ahmadiyya sources there are about twelve million adherents of this sect in the world today.

Ahmad, influenced perhaps by western philosophies, announced a new doctrine, foreign to Islam, that Jesus had indeed been crucified. He went on to claim that Jesus was rescued from the cross in a state of collapse, recovered in secret, and after passing through India he reached Kashmir, where he died at the age of one hundred and twenty. Ahmad argued vociferously against orthodox Muslims, saying: "Those Muslims who believe Jesus to be in heaven in his physical body, are guilty of uttering an absurdity against the Qur'an." It is surprising, however, to find that Ahmad and his followers support this gospel of Barnabas. He wrote, "the gospel of Barnabas, which contains the prophecy about the latter day prophet, is declared by Christians to be forged, because it contains a clear prophecy about the Holy prophet." He gives two reasons why Christians reject this gospel: —"that the book or the story happens to contradict the Gospels in use;" and "that the book or the story happens to agree with the Holy Qur’an" [1]. To what extent the gospel of Barnabas is in conflict with the Qur'an is discussed in the In Conflict with Islam section. So, how does this gospel compare with the Ahmadiyya sect?

The Ahmadiyya movement believes that their leader was a prophet of God after Muhammad. In contrast this gospel states that "there shall not come after him true prophets sent by God, but there shall come a great number of false prophets, " (Barnabas, chapter 97).

The gospel of Barnabas relates the stories of the healing of the sick and the raising of the dead by Jesus. The Ahmadiyya movement does not believe in these miracles. Mirza Ahmad wrote in one of his books, ", a thing which is not possible for the Holy prophet (Muhammad) - the best of prophets , how can it be so for the Messiah (Jesus)!" [2]

This Gospel denies Jesus the title of Messiah and yet the Ahmadiyya accept it as a fact, as seen from the above quote.

Mirza Ahmad is very suspicious about the authenticity of the four gospel accounts in the New Testament. He says that these gospels contain many things which show that they have not been preserved in their original form. For example, he refers to Luke 7:36-50 and comments that no prophet "had ever set such an example of freedom that he would allow an impure and adulterous woman, a noted sinner, to touch his body with her hands, to let her rub oil into his head - bought out of her immoral gains - and to rub her hair on his feet, " [3].

On this he bases his conclusion that the four gospels are not in their authentic form. Yet the very same story is recounted in the gospel of Barnabas (Barnabas, chapters 129-130).

Mirza Ahmad believes that just as John the Baptist was Elijah in the spirit, (Matthew 11:14;17:12), so he himself is Jesus in the spirit. Where does he get his knowledge of John the Baptist being Elijah in the Spirit? Certainly not from the Qur’an because it does not mention him being Elijah and certainly not from the "one true gospel" - the gospel of Barnabas where the Baptist is never once mentioned. He took it from the Bible (Malachi 4), which he says he does not believe.

This Gospel says that Judas was crucified in the place of Jesus, while the Ahmadiyya movement believe that it was really Jesus. Further, this Gospel would have us believe that Jesus was taken into heaven bodily before the crucifixion, while the Ahmadiyya believe that he was crucified but did not die on the cross. They say, ", it is impossible for us to think that Jesus the Messiah is alive in heaven while Muhammad, our Holy prophet lies buried in the earth. We cannot think so, " [4]. So, as in the case of the orthodox Muslims, the Ahmadiyya movement is in a very precarious position, if they depend on this gospel to confirm Mirza Ahmad’s teachings.
