You can only sue for damages if you presented your cases and the government still went ahead to sieze the money, when the court is convinced that you have no business with drugs.

Nobody proves innocence in court. I doubt the feds would have to pay damages for a legal seizure and lawsuit. The asset Forfeiture laws make give the federal government lots of latitude. If you have legal precedent backing up damages arguement feel free to show me examples. I already answered your 2nd question if you don't agree just say so.

On the second it depends how I earned the money and how much I have. Fed cases in the US are tough and sometimes a minor loss is preferable.
