Intrepid01:your parents raised you right when you were calling me a fool for simple english you now admit you didnt read correctly? Who is the fool now? you failed to comprehend what you read like so many on Nairaland and I said you displayed a lack of english comprehension which is a fact! |
Alexpeters:Yari is not happy is different from North is not happy. Are Ganduje, Ndume not from the North? |
garfield1:IMHO section 42 clarifies the status of the voter in FCT. you cannot enact or implement a law in such a way as it gives a citizen in a community a special advantage or disadvantage over a citizen in another. c'est finni Section 42 of the constitution. (fundamental rights of citizens) 1) A citizen of Nigeria of a particular community, ethnic group, place of origin, sex, religion or political opinion shall not, by reason only that he is such a person:- (a) be subjected either expressly by, or in the practical application of, any law in force in Nigeria or any executive or administrative action of the government, to disabilities or restrictions to which citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions are not made subject; or (b) be accorded either expressly by, or in the practical application of, any law in force in Nigeria or any such executive or administrative action, any privilege or advantage that is not accorded to citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions. |
so long as he isnt taking the cars away..no problem |
00FFT00:the constitution does not grant FCT voters any special status. and if it does section 42 overrides it. The earlier the law in the constitution the more weight it carries because it is the basis on which others are built. the earlier laws set the framework for all others, particularly the laws in chapters 1-4 or sections 1-46. that is why things like the definition of the country, states, etc, the objectives of the country, powers of the federal govt etc, citizenship, fundamental rights are spelt out in the early pages of the constitution. It tells you there will be a president in chapter 1 before it tells you how the president will emerge in chapter 6. Similarly it spells out the fundamental rights of citizens in chapter 3 before talking about how a president will be elected in chapter 6. So whatever is in chapter 6 cannot breach chapter 3. section 42 precedes section 133 and section 42 says no law can give any citizen an advantage or a disadvantage over other citizens. the constitution clearly says in section 42, that you cannot apply any law in such a way that it gives any citizen any advantage or disadvantage simply because belongs to a community...i.e FCT. The vote of the man in FCT cannot confer any greater advantage or status than the vote of the man in Abakaliki, Ondo or kafanchan. |
Intrepid01:I am not an Obidient, if you read what I wrote properly you will see I am saying there is nothing special about FCT, the president does not need 25% in FCT nor does he need to win FCT. I am simply saying what the law says, no citizen in any community can have any special privileges above any other citizen and no law can give any citizen any special privilege or disadvantage any other citizen. The vote of the man in FCt is the same as the vote of the man in ilesha. It is illegal to grant the FCT voter a status above other citizens according to section 42. All citizens are equal that is the essence of section 42. Like I always say many Nigeria have a poor grasp of English comprehension. |
KingsCity:If that is the line of logic you are taking then common sense would have told you that it is unfair for the FCt to be governed by someone who did not win the FCT or for laws of the FCT to be passed by senators and assembly men whom the residents of the FCT did not vote for. Why is a senator from Ondo central passing laws for the FCT? Like I said section 42 surpasses all laws that is why it precedes all other laws. It establishes the rights of citizens. You cannot pass a law or implement a law that gives a resident of the FCT superiority over a citizen of Aba, kaduna or ondo. |
OneCandleAway:Unfortunately for you the Supreme Court is not interested in your allegation of hypocrisy only what the law say. |
OneCandleAway:Just telling you what the law says. |
OneCandleAway:BTW the real inhabitants of The FCT have been formally relocated. Officially and technically speaking there are no indigenes of the FCT in the FCT, the inhabitants have been relocated and compensated. |
OneCandleAway:I have told you what the law says on the equality of all citizens and the rights of all citizens, if you like continue to argue with yourself. You cannot pass or implement a law that gives you an advantage over me simply because of where I live or where you live, it’s there in black and white. |
Much has been made of the FCT and the requirement to score 25% to be declared president. I however say such an interpretation of the requirement is unconstitutional and a breach of the rights of other citizens and I refer to section 42 of the constitution which states clearly that you cannot CREATE or IMPLEMENT a law in such a way that a citizen in one community is given advantage or disadvantage over a citizen in another community. By interpreting the 25% of FCT to mean that a presidential candidate MUST get 25% in FCT, you are giving advantage to citizens of the FCT and disadvantage to citizens of the other 36 states. Section 42 of the constitution. 1) A citizen of Nigeria of a particular community, ethnic group, place of origin, sex, religion or political opinion shall not, by reason only that he is such a person:- (a) be subjected either expressly by, or in the practical application of, any law in force in Nigeria or any executive or administrative action of the government, to disabilities or restrictions to which citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions are not made subject; or (b) be accorded either expressly by, or in the practical application of, any law in force in Nigeria or any such executive or administrative action, any privilege or advantage that is not accorded to citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions. |
illuminutty:Let me take these so called issues one by one 1. Narcotics. He wasn’t convicted, even if he was convicted, according to the constitution it does not disqualify him because it was over 10 years ago. Section 137. (1)e. (e) within a period of less than ten years before the date of the election to the office of President he has been convicted and sentenced for an offence involving dishonesty or he has been found guilty of the contravention of the Code of Conduct; or 2. 25% of FCT. Section 42(1)b. States 1) A citizen of Nigeria of a particular community, ethnic group, place of origin, sex, religion or political opinion shall not, by reason only that he is such a person:- (a) be subjected either expressly by, or in the practical application of, any law in force in Nigeria or any executive or administrative action of the government, to disabilities or restrictions to which citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions are not made subject; or (b) be accorded either expressly by, or in the practical application of, any law in force in Nigeria or any such executive or administrative action, any privilege or advantage that is not accorded to citizens of Nigeria of other communities, ethnic groups, places of origin, sex, religions or political opinions. 3. Whether or not he presented a forged certificate in 1992, 1999 or 2003, The issues before the tribunal is Did he forge the certificate for this election? If not you have no case, Adelekan forged certificate in his last election, today he is governor because the certificate he presented this time is not forged. 4. Inec not following rules. Supreme Court has just ruled yesterday that INEC does not have to transmit results to IREV. It is a guideline not a law. 5. You may have a case here, this is the one I don’t know how the court will determine. But if it rules against Tinu u then Obi is also disqualified for not being a member of Lp 30 days before primaries. 6. This will be determined by the evidence. Obit will have to prove he won more votes than Tinubu. I can’t comment as I haven’t seen his evidence. All I can say is that even if he can prove he got more votes than Tinubu, unless Tinubu is disqualified outright, the election goes into a rerun and obi cannot win a rerun against Atiku or Tinubu. 7. Citizenship. Diplomatic passport is not citizenship. Countries give other nationals diplomatic passports for different reasons without them being citizens. A good example, when NADECO members fled Nigeria via Cotonou, they were issued passports of other countries to enable them flee to Europe and the US. Tinubu himself said this is his biography that he was issued a UK passport to enable him land in the UK. Sometimes small countries issue influential people diplomatic passports. It does not make them citizens or mean they are citizens. The only issues here are is 5&6. The others are dead on arrival. |
Ofunaofu:Like I continue to say, Nigerians lack basic English comprehension. The Supreme Court has just told you there is nothing in the LAW that requires electronic transmission. A guideline is not a LAW! Inec guideline is not The same thing as electoral law. |

After a 3 term deputy senate president disgraced the country with human trafficking, some people want us to reward the Se with senate presidency |
IyaTola:Men have always paid for sex, there is a reason why prostitution is one of the oldest professions in the world. You won’t find computer engineer in the Bible but you will find prostitutes. The only difference is more women especially those who are not poor or from broken homes are now willing to unashamedly exchange their bodies for money. In such an environment you will always find willing men. |
When you were voting 97% you didn’t know? |
No region has had more senate presidents than the SE and deputy senate president for 12. Are you the only tribe in Nigeria that you must always be senate president? In 16 of the last 24 years, an ibo man has been SP or DSP. An ibo man served as DSP for 12 and his gratitude to Nigeria is to disgrace the country with human trafficking and we should reward you again with SP? |
Why? Are they public figures? |
israelmao:Nobody insults, brags, abuses like you, like I said in a previous post, that is your space, you own it, that is what you do, that is where you excel. Tthat is why you are serial losers in whatever guise be it Atiku or Obi. We on the other hand deal in issues and strategic thinking, that is our space, that’s why we are heading to Aso rock. |
“formal dissociation from the untenable”, I hope you are all seeing the man you say has character, throwing his supporters under the bus. |
israelmao:What is secret about something that is publicly available on IREV portal? Better pray and fast that stupidity not continue to be your portion. |
israelmao:Very unintelligent, emotional arguments but I will dignify it with a response just to say the following. 1. It’s been more than 40 days since the election, results have since been uploaded to IREV. You and others have had ample time to compare the results on IREV with results announced. With the exception of Rivers that we all know was rigged, why is it neither albino and his followers are talking about discrepancies in the results announced and the results on IREV, do you need more than 40 days to compare the results? Whether the uploading was delayed or not, are the results different from the results announced? If so by how much, surely with all your social media noise, you should have that info by now that the tribunal is seated? 2. Why is it that after the results have finally been uploaded you have all gone quiet of the results but instead talking about forfeiture, shetima and FCT? Could it be the results announced by INEC are actually a reflection of what transpired on the day? Co |
it is not Soludo you are hurting but yourselves. it is your region that will continue to stagnate, repel investors and forcing all of you to run to other places to seek a livelihood. Soludo's page in history is assured as a governor, his children and descendants will have the honour, pedigree and priviledge of descendants of a former governor. Doors will open for his future generations just for bearing the name "Soludo". Soludo's financial future is assured as an ex governor. continue to hurt yourselves. poor people with poor mentality. thats why you continue to remain poor. BTW Ekpa and Kanus's children will not suffer thanks to all the IPOB money they have amassed to secure their financial futures. |
RighChannel:like I said Nigerians have poor English comprehension "You cannot represent an individual" is not the same as "the individual must be present in court". The individual is already represented by his lawyer. The judge did not say Tinubu must be in court and Tinubu will not be in court. one of the biggest problems we have in ths country is English!! English together with ignorance amongst the so called educated. Read section 42(1)b and you will see your 25% in FCT is DOA. if you understand English, you will understand from the very statement you quote that in matters like these an individual does not need a representative...read again. |
seunmsg:The question is not Do these people have sense? The question is do they want to have sense? |
