Penguin2: So where did the Tribunal derive the power to cancel result of an election because of over-voting?
electoral act gives only polling unit officer and the court the power to cancel votes. It was on the basis of this that hope uzodinma won in supreme court cos his votes were cancelled by ward collating officer's and not the polling unit officers. The law is the law. Those who know it, know how to use it.
kel4soft: APC agent protested at that collation centre especially on Ede results. I saw him on television. The Returning officers ignored him and seeking redress in court is the proper thing to do
actually, electoral act gives the power of cancellation of votes to only polling unit officer and the courts.
fergie001: See, the Tribunal Chairman based his evidence on the BVAS report which is a secomdary evidence rather than the primary evidence, the machine itself.
What about the voter's register.... Useless to Justice Kume.
One of two things will happen at the Appeal Court, either it is upturned or a retrial will be ordered but since there is no time, it should be upturned.
It is funny....just take a look at the majority judgement and tell me you wouldn't laugh.
no upturning. No retrial. I have never known you to be emotional. Appeal will uphold it. It's very clear.
Penguin2: The lead judgment of the Osun Tribunal was hinged on over voting.
But what did the 2022 Electoral Act say about over voting?
Read the provision of the Electoral Act on over voting as captured in section 51 and decide for yourself if justice was truly served in Osun or not.
Nlfpmod Mynd44 Fergie001 Garfield1 Kyase
read well. That section is applicable to events on election day. Results were not cancelled by polling officers but by the tribunal. That section does not apply to tribunal. It's clear.
millionaireman: Synchronised BVAS Report from PDP and BVAS Report from APC. How come the BVAS Report of PDP was tagged Synchronised, but the BVAS Report of APC was accepted by 2 out of the 3 Tribunal judges for awarding victory to APC?
Anyway, the Appeal Court, and possibly, the Supreme Court, shall have their own pronouncements.
when elections are concluded and winner declared, inec gives political parties copies of the result and BVAS report. That was the BVAS report apc presented. Unfortunately what inec brought to court to defend themselves was a different altered BVAS report they tagged "synchronised"
kcnwaigbo: Oga please stop making a fool of yourself. The electoral act stipulates cancellations and also stated that no return should be made if the cancelled votes are more than the difference without a rerun
kc, mind yourself. You know me from Egbeada does not give you liberty to come here and show ur inherent madness. Read that electoral act and see the part you are talking about has to do with events on the main election day. That has been overtaken by events.
AdedoyinO: A supplementary election should be held in the affected polling units, that's what EA 2022 stipulates for this incidence.
Mere deductions of votes is not enough to return Oyetola as governor
what you quoted is with respect to events on the day of the main election. You can't match it with this cos declaration has already been made, a candidate returned and sworn in. That section was referring to the main election where cancellations are made by the polling officer. If the cancellation is reasonable to affect the outcome of the election, no winner should be declared. That has been overtaken by events as the cancellation in this case is not being done the polling officer and is post declaration, post return and post swearing in.
Johnnyessence: APC urchin, Na lies and propaganda will destroy you more. Appeal Court and Supreme Court of justice will decide on the Bvas reports . It’s not over yet
it will be hat trick for Oyetola. The case is very clear.
LegendHero: 1) The BVAS is truly a game changer and should ordinarily be above manipulation.
2) The BVAS ascertains or validates voters' identity, and it is mandatory prior to voting. Every voter must be BVAS'ed before they are issued with a ballot to vote. In short, BVAS accredits voters.
3) After elections, the results are then collated and entered manually on INEC form EC8As. However, the number of voters on INEC Form EC8A must never exceed the number of accredited voters on BVAS. That's over-voting and automatic cancellation under the EA 2022.
4) When a winner was declared by INEC in Osun elections, it was assumed by all that the BVAS and Form EC8As tallied. It was thought that Adeleke won and Oyetola lost.
5) APC applied for the BVAS report and Form EC8AS to file their petition days after the winner was declared.
6) APC in preparing their Petition found discrepancies between BVAS report and FORM EC8As in over 700 polling units. The votes recorded on Form EC8As literally exceeded were BVAS accredited. There were over-voting by people who must have literally bypassed the BVAS either for not having PVC or other dubious reasons.
7) Once INEC, PDP, and the Governor were served with the APC Petition, they all filed their responses and added another entirely different BVAS report, which INEC now called a "SYNCHRONISED BVAS Report.". So, there were two BVAS reports before the Tribunal. The one issued to APC before they filled their petition and the one issued to PDP during the pendency of the petition.
8.) At the Tribunal, each party strove to prove which BVAS was credible and which was not.
You now be the judge. Which of the two conflicting BVAS does your conscience say is credible? The first one that was used to declare a winner on the elections day or the other "SYNCHRONISED BVAS" that issued almost 30 days after a winner was already declared and during the pendency of a suit?
What does your conscience say?
I think INEC National should be grateful to APC/Oyetola/Osun for helping them expose the manipulation that dubious politicians can subject the BVAS to. Plus, voters must now know that bypassing theBVAS is not helpful. Everyone must be accredited by the BVAS to be eligible to vote.
Copied: Musibau
APC2 see this. Read number 3. That explains why a rerun was not requested. Electoral act stipulates outright cancellation.
ChinemeremFidel: Like I said before...Nigerians are Nigerian Problem.. We need to burn some people with fire..
Are they celebrating the person who had put us in this mess of today??
What is actually wrong with Nigerians??
you are one of the biggest problems of Nigeria. Hate filled imp. Start with burning Peter obi with acid. What did he do for Anambra as a governor that you think he deserves leading Nigeria? Evil thing.
kponkedenge: Mr know it all. How do you now explain Uzodinma's own that they gave the slot to him from 4th to become governor...... Bypassing the other candidates
you are too emotional to understand the law. The figural representation of the law is blind cos it sees no emotion nor sentiment. Legally, that judgement declaring uzodinma Winner is correct. Morally, it's wrong. Court doesn't act based on morals but evidence before it. That judgment will always stand correctly upright before any objective judge.
APC2: Since the number of votes in the over-voting areas is more than the number of votes needed for declaring a clear winner. The tribunal should have rule for a rerun, not deducting the votes from Adeleke votes as there was no any forensic verification that all the votes deducted belong to Adeleke. The justices failed woefully
now this is a very reasonable criticism of that judgement. One would expect a rerun. It's left for his lawyer to do the needful in appeal. Truth is that they cheated with the BVAS. They should ask for a rerun in appeal instead of asking the higher court to overrule the judgement of the lower court. If they ask for the later, they would lose.
IgOga: educated illiterate....na bvas data exposed the overvoting......how una dey think reason like this
if you had followed the tribunal, you won't sound this unenlightened. BVAS is meant to prevent electoral fraud (so we were told) from the onset not meant to discover already perpetrated fraud. We were made to believe with BVAS, there cant be rigging. But the tribunal has disproven that.
SmartPolician: INEC is not foolish. Instead, Nigerians are natural crooks. If the tribunal cancelled the votes in several polling booths, it means that INEC officials were compromised, not Mahmood himself. Mahmood cannot be everywhere.
There should be a consequence for wrongdoing in this country. INEC says it's too overwhelmed to punish electoral offenders. An arm should be created in the police force to specifically deal with them.
you typed beautifully well till you added police to your write up.
The 2015 Hyundai Sonata 2.0T vs 2015 Toyota Camry XSE. CarContinent and I spent some time with these amazing cars and we showed their best sides and their not-so-cool sides. Which of these two is the better sporty daily driver to own?
Don’t forget to subscribe, like and share the link so others can do the same too.
you missed a very interesting feature on that sonata. To open the trunk, just extend your fingers above the plate number at the rear with the remote fob in ur pocket. It opens automatically
Foolishbuhari: Don't be a fool on my mentions please. If you get a hard on with foolish news and misplaced priorities, take it far from here. If your brain doesn't tell you this is just an elaborate scheme to fleece the nation's purse, then you're dumber than I I actually give APC Cr3tins credit for.
Is Dangote refinery govt owned? Should a country of 200 million people depend on a private refinery for her petroleum products? Is it right? Has the govt finished solving health care, education and hunger problems in the Country? As simple as those, they've been unable to fix it but you expect them to manufacture air crafts. Abeg carry your mumu far from here abeg.
name one renowned government owned refinery in the world. Have some sense.
Pure nonsense and lies. The man could have died from the thrombus in the brain. Most ICUs run uninterrupted power supply. If he could stay for 24hrs without oxygen, then he was not oxygen dependent.
Atiku should thread with caution. They should sweep that stadium of all explosives, otomokpo and anything capable of killing Atiku. I don't trust wike. His only chance of contesting for presidency is by eliminating Atiku.
Preciousgirl: I am highly convinced that my boss is interested in me I can't imagine that my boss left his office yesterday to my office and sat before me. He was jittery all through his convo with me and it wasn't work related. He told me he has a surprise gift for me
Is this also not a clear sign? Also, as a married woman, can I accept his gift?
Reading thru zenith bank's response, they have a very tight defence. If the babe is being truthful, she should report to the police and all the guys she was with 48hrs prior to the occurrence of the incident should be arrested and investigated. Even the ones she slept with. Like the bank said, someone had uninterrupted access to her phone. If that iPhone was gifted to her, she should also arrest her benefactor.
Bobage16: Ok. I haven't scanned, let me try and do so, and I'll be back with the reading. I really hope it will help permanently.
in this age and time with all your exposure, you allow road side mechanic to drag you around in a car that is obd compliant. Why do we behave like illiterates despite our Education. Next thing is to berate Nissan on how its a "useless" car. Go and scan that car. You are the pain in the ass not the Nissan.
DaBogu: I am going to share my experience as a recruiter, hiring executive assistants for several clients. Some may not like what I have to say, but I can only speak my truth.
Do we have a major youth unemployment problem in Nigeria, yes we do. While there is a challenge of not enough positions aligned with educated youths, as a recruiter I have seen there is a portion of the youth that is not serious about employment. Almost a sense of entitlement.
Many Nigerian youths have access to data and social media. That is how people find me and apply to jobs. I would think during your idle time, you would take time and teach yourself new skills and level up. Unfortunately this is not the case for many candidates I interview.
Let's say I have 10 candidates that I want to interview. Only 5 of them will respond to my initial interview. The other 5 candidates never respond.
Out of the 5 candidates that respond to my email, only three of them will be able to demonstrate knowledge of excel and PowerPoint.
Once I meet them in person, two candidates will call me the day of the interview with one long story basically saying they can not come to the interview, and only one candidate will actually be ready to present to a candidate.
After going to this process over and over again, I have started to ask myself is it worth it? I want to help more Nigerians get jobs, but it's clear to me overall we are not serious. ver 400 resumes I have for EA positions, only 50 resumes have been presentable to clients.
Nigerian youths if there is not anything else you get out of my message, you need to level up. The Nigerian education system is not preparing you for the workforce. Start teaching yourself basic etiquette of how to apply for a job and the interview process.
Stop sending emails with no subject title or body in the email. Then you attach your resume and expecting a positive response.
Stop embellishing your resume, only to find your are not anything close to what your resume presents.
Do not put a number on a resume that will be hard for a recruiter to reach you.
And finally, if you applied to a position you should be in your inbox more than social media. I can not tell you how many times I get an email from a candidate a week later saying they are just now seeing my email. This is the cold hard truth. As much as I want to help Nigerian youths. Many of us are not prepared for employment.
most Nigerian youths are not employable. All they know is hurling insults on social media and looking for free giveaway. Very lazy lots.
