nice2: Silent reader and i must say, this group is loaded. I just saw my result and i cant keep quiet anymore. I'm devastated right now. I dont know what i am doing wrong o. Ielts has been holding me down since July. First three attempt is with BC. 1st attempt: LRSW 8.5/6.5/7.5/7. 2nd attempt: 7.5/6.5/7/6.5. 3rd attempt: 8/7.5/7.5/6.5. Applied for EOR this December so i'm yet to get result. Fourth attempt is with MOD 8.5/8/8/6.5. Please what should i do as i'm fed up already. ECA has been ready since September. Ask for a remark of your fourth attempt. Don't be discouraged, notice how your results have been improving with each attempt. That counts for something. |

Express Entry system determines for you the program you qualify for based on your answers and the ranking is this CEC>FSW>FST.

I just submitted the profile yesterday night and it shows both FSW and CEC were met. Are we good to go sir/ma without the proof of fund? Yes, you should be alright then. During our time, if you wanted to be picked based on CEC, you were to put 0 in proof of funds. That will make the system put you under CEC when you get your ITA. I'm not sure what happens now but if the system places you under FSW after ITA and you don't include POF, you will have to put in an LOE explaining that you qualify under CEC and that's the stream you are interested in. |

Yes, if there is no LMIA and you are applying under FSW, you must provide POF because you do not have a qualifying job offer. LMIA also gives you 50 extra points. If you are applying under CEC (which based on your posts you are not) then you do not have to provide proof of funds. In your case, you have to provide proof of funds. That your wife is working in Canada does not automatically mean she is exempt from POF. |

The rank of priority for the 3 Express Entry programs is: CEC, FSW and FST.
The case OP has already stated that the PA is authorized to work in Canada and with her Canadian education she qualifies for CEC.
Under CEC, she only needs to have obtained the work experience legally.
Proof of funds is only for FSW and FST.

A valid job offer under Express Entry means a job offer obtained with an LMIA (Labour Market Impact Assessment). Did your wife's company get an LMIA when employing her? If not, then her job does not satisfy the criteria of a valid job offer. To know if she does, she will have an LMIA number given to her by her employer. The only reason she won't need to show proof of funds is if she is applying under CEC or her employer obtained an LMIA when employing her. People working in Canada usually have issues with this question. I know people who have been rejected because they answered yes to 'do you have a job offer in Canada. Technically they do, but under CIC rules, they don't. |

ontarioissauga: Did you read the thingy? You can't use self-employment to claim migration points under CEC. He said he was an employee, but they found out he is the director, the owner. Unless to move it to personal history and bring in his Mexican work experience earned within the last 10 years. If he had a qualifying NOC, his agent would have asked for it. Generally, you cannot use self employment for CEC but there are exceptions and each case is considered on its own merit. There are 7 qualifying factors which CIC uses to determine if your self employment actually qualifies as an employer-employee relationship. This is because some companies try to circumvent the law in a bid to avoid paying some taxes and CPP and label you a contractor when you are actually an employee. The onus is on the applicant to prove how they meet those qualifying factors. To support their application, applicants can also petition the CRA for a ruling on their status which they will submit to CIC. However, this ruling is only persuasive. The family in this case took the second step but did not take the first step of letting the officer know how they meet the qualifying criteria. In this case, they relied fully on the CRA ruling forgetting that it's only persuasive. So no...they were not trying to be sharp...they followed the rules and took a gamble. The same case before a different officer might have turned out favourably. There are people who have applied as self-employed and gotten PR under CEC. Again, each case is considered on its own merit. Finally, CIC did not 'find out' he is a director in the company. When you are submitting self employment documents, you will be submitting your articles of incorporation which will show how many shares you hold in the company. If he had indeed misrepresented, the article would have mentioned A40 proceedings and not an attempt to renew their work permit. |

You are part of the problem many people are running away from in Nigeria, part of the decay in the Nigerian society and it's unfortunate that while many genuine and well meaning Nigerians are running to Canada to escape the ills of Nigeria, we have people like you, who like cutting corners, who see nothing wrong with an absolute lack of integrity also coming along. You may have to reconsider if you will fit into this new country you want to call home because behaviours like this are abhorred in sane climates and if you are someone who cuts corners, expect to be disappointed. So how is the poster supposed to solve this issue that seems like an anomaly? If she follows the same process again and gets NECO to send it, how is she sure it won't still be rejected. Please download a new IMM form, at the top of the form, indicate that it is an updated form and indicate clearly the section you have updated (this should be the section for personal/work history). Fill and send this form via a CSE as soon as possible. If you wait until you are asked, then it's a gamble. A huge percentage of similar stories end up in an A40 decision. Good luck. |
