The coercive relationship between these tiers of government has led to failure of the Local government in its constitutional enshrined duties. To ensure development Local governments, require fiscal and administrative autonomy to guarantee efficacy accountability and transparency to the citizens in their jurisdiction.

Background:
Local governments are closest to the populace so the offer the most efficient means of service delivery. This is due the fact to the fact they will notice ground level issues concerns. The mandates of local government are to carry out the delivery of said services and ensure grassroots development. The foremost advocate of this theory is Langood (1953). The efficient-services theorists hold that the local government occupies the best position for the efficient performance of certain functions. This is as a result of the fact that they are the government that is closest to the people, and also the fact that they cater for a smaller population when compared to the state or federal governments. As argued by Sharpe (cited in Ola and Tonwe, 2009) the local government is the most efficient agent for the provision of those local services that they have responsibility to provide.”

In the 1999 constitution, Local government is given defined powers and authority with provisions made to them from State and federal government. Statutory functions are listed in the fourth schedule of the constitution include provision and maintenance of health services; agricultural and national resource development; provision and maintenance of primary, adult and vocational education and other functions as may be conferred on it by the state house of assembly.

Relationship and case studies:
The relationship between State and Local Governments is one of subjection. This is done through the State Joint Local Government Account that serves the undermine the local government. Illegal deductions, diversions of funds or simply usurping Local government function by awarding contracts on behalf of local government without their approval. There are many examples of illegal deductions of Local government money including that of Borno, Ondo, Lagos and Nassarawa.

“Ubani notes that: “Lagos state government constructed parks in various parts of the state with money deducted from the state and local government Joint Revenue Account. In Ondo state, government constructed a modern motor park in Akure, the state capital” (2012, p.1). Actions such as these contradict the provisions of the 1999 constitution, which provides that these projects ought to have been executed by local government.”

“According to Dlakwa (2004:121), between March 2002 and March 2003 a total of N13.3bn was available for councils in Borno State. Out of this amount the state government deducted almost half (see Table 1).”

“In November 2009, ‘the total allocation for the 20 LGs in Ogun State was N1.7 billion. But Daniel gave us N700 million, which was less than half of what was due to us. ’Before then, Oladunjoye and some of his colleagues had written to Daniel ‘to deduct only what is statutory from our allocation and specifically the amount of money due to the teaching and non-teaching staff of the Local Government Education Authority, LGEA. ’According to Oladunjoye, nothing came out of that. ‘For example, my bill for LGEA was about N28 million monthly, but the governor was deducting N39 million. That is N11 million in excess. With N11 million, I could build two or three community health centres every month. I was angry. Why should state government pay primary school teachers on our behalf? Was the federal government paying secondary school teachers on behalf of the state government?’ (Akaeze 2012, p.3).”

The Joint Allocation and Account Committee (JAAC) allows State Governments inordinate control. Most JAAC are composed of State government appointees instead of Local government. The Local government councils are hardly consulted and represented as in case of Ondo. All this transpires while State governments don’t contribute 10% IGR allocation to local governments.

Conclusion:
The performance of local government to the development of Nigeria has been abysmal so far even with all the money allocated for it. The constitution needs to be amended to make this important tier of government effective to carry out duties. Full Fiscal autonomy necessary and this goal can be accomplished by getting rid of following rules.
• Abolish State Joint Local Government Account
• Abolish Joint Allocation and Account Committee
• Direct allocation into Local government accounts
• Transparency in Local government affairs (fiscal and administrative)
• Fiscal Autonomy (pass budgets without approval of State governments)
• Local Government need to improve IGR

1. You won't see my disagreeing with you here. I was trying to address the concern that state police would be turned into tools of state governors, and I think locally recruited and funded police are an effective antidote to that danger. All other things being equal, controlling 770 different locally-funded police forces will be a lot harder than controlling 36 state forces, let alone a single nation-wide force.

2. As the saying goes, "It is better that a hundred guilty men go free, than that an innocent man should be unjustly punished". The counterpart to the risk you raise is that, for example, a southerner is accused of desecrating the Quran in Kano, and is then subjected to a judicial lynching to satisfy bloodthirsty mobs of religious fanatics (remember Gideon Akaluka?). I don't think it's a bad thing for police forces to need solid evidence to get forces in other states to cooperate with them, especially given how partial Nigerians are to irrational fervor and mob sympathies.
First off, you are not controlling those police depts. They are autonomous bodies overseen by the people of the communities who appointed them. If they mess up, then the state govt (Or Fed govt) can swoop In and arrest those responsible for wrong doing.

Secondly, Sharia law is contradictory to the constitution of the Fed republic and should be illegal. Any state that wants sharia should make a decide if it wants to be part of the republic and abode by its rules or leave. You can't eat your cake and have it at the same time.

Mr Omohayek,here are the points I was trying to make;
1.The state governors or even local government chairpersons' wouldnt be the ones issuing the arrest warrants; the police should be independent and have power to act unilaterally.In your post,you alluded to the state governors being able to issue a "federal arrest warrant",something only the court can do.
2.The issue of jurisdiction; If say an ijaw man kills another man in Lagos and runs to Bayelsa,what happens when the bayelsa police department refuses to aid the arrest of such a person probably because they suspect tribal persecution?,even if they are willing,the process will be slow(involving sharing of intel,investigation,profiling and perusal of criminal record from one state to another) and by the time action is taken,the suspect would be on the run again.
However,I think the idea could work only with completely independent and autonomous police forces.
Bros, it doesn't matter. If you commit a crime in Texas and you flee to New York and are arrested there they usually send you back to Texas so jurisdiction don't mean much as their is a federal database and if you truly want to get rid of this so called tribalism then get rid of the stupid concept called "State of Origin". It is one of the dumbest things I have ever heard of. It's the reason that after all this year's Nigeria is still not United. How can an ibo guy born and raised in Abeokuta be told he is not from Ogun state simply because his father is from somewhere else. Mind you the guy probably goes to his so called father's state of origin once a year (Christmas or easter). The stupidity of that concept is mind boggling at times.

UR points are good bro.. BUT for me, Nigeria is not ripe for state policing YET. My points are as follows:

1. FUNDS: Almost all states are finding it very difficult to pay their workers salary... Police cannot afford to takee that.
The only for a child to learn how to walk is to WALK. If they fall then they should try again. All this babying of local govts has not worked. Let them be given autonomy to raise revenue from local property taxes and create their own police force. That's how things work in developed countries.

2. State/Local police will be use to oppress the oppositions or minorities.
Everybody keeps saying this but this are unfounded fears. It's this fear that stops Nigerians from pursuing the right policies. State/local police cannot necessarily be used to oppress people in a community if the head of the police or the state commissioners (and judges) are elected by the people themselves. If they do so then the federal govt can step in.

If we are truly serious about security, then each state has to own it's policing. There is no way a Fulani man can be a DPO in Delta state and fight crime like a local who knows the pains and gains of an efficient police force.

This current system is being supported by those who use the police to keep the masses tied to their selfish interest. That is why someone can stay in Abuja and rig elections in Bayelsa state.
Nope! Policing should be left to communities or local govt and their police commissioners (and judges) should be elected by the people.

I feel that we must first restructure our federalism before giving the LGs full autonomy.Some LGs are not even viable and there are cases where boundary is disputed.
We do not want to have a situation where LG chairmen use tax payers' money to sponsor their personnal political ambition in a bid to get to Abuja.
Wrong! The best way for a child to learn how to was is by walking. Let the LGA's be given the independence (autonomy) to elect there chairman, representatives, school education board, Judges and police inspectors. That's how things work in developed countries. For nsija to work the Fed govt needs to decentralize a lot of power to the lower tiers (levels) of govt (state and local govts).

During plenary on July 4th, Dino Melaye, Senator represnting Kogi West raise the the issue of his recall battle from his constituency accusing the Kogi state governor, Yahaya Bello of sponsoring the wasteful process.

In his response, The DSP, Ike Ekweremmadu said the process is dead on arrival, according to him, It's a long process and that the senate would also verify the legitimacy of the votes before a conclusion is made.

I disagree...


There's always a reason for every action or decision to beat a woman.
Now some of those reasons may not be justified.

But women, are wired strangely...they claim to hate men who beat women but won't be loyal or respect those who don't.

When a woman calls you romantic, check yourself well...there's a 75% chance you are a sissy with her.



Well...I've hit a woman more than once; I had my reasons and the beatings were productive. I may not be proud of it and I don't by this endorse my belief in battery but I'm better than the male hypocrites who condemn beating women on forums as this.

When real life all they do is beat women.



Not up to 2 in 10men can honestly say they've never hit a woman...
