It'd honourable for him to resign and seek redress concerning forfeiting his whole money. If onoghen resigns he is finished, seek which redress?,if saraki had not stood firmly he would have long been a goner, there are certainly concrete ground for onnoghen to fight his case,I would do same if I were in onnoghen's shoes.what you just said means since buhari is against onnoghen he should just go n not necessarily because he is guilty, that buhari should not be questioned no matter what!. |

I sometimes, see Judges and Lawyers, as individuals who make laws that has not been clearly thought through. The EFCC was unable to prosecute Fayose on the clear ground of Immunity, but the FG has been able to influence the Judiciary because, the law is not clear on that. The NJC would have resolved the issue long before now, but rather, they also are divided. I don't get your point, the CJN been on trial doesn't stop the courts from sitting,it doesn't stop the NJC from sitting,so what are you saying exactly?,if I were in onnoghen's shoes I will certainly fight for my name n not give in to any nonsense pressure to resign, except if I know I'm guilty. |

Monday is it!
I also like the noninvolvement of the acting CJN. He's left out of the process and it's cool.
That way decisions cannot be influenced and Nigerian people can see its transparency. Yes let all the legal processes go on to logical conclusion but onnoghen should be allowed to fight for his name legally n not cajoled to resign just to suit the agenda if his traducers. |

Yes I agree with you but you know too well as I do that those behind the buhari agenda would rather this country be destroy than let what you are suggesting happen,if you look at this onnoghen issue critically you would realized it's premeditated, from the onset buhari never wanted the man,now no one has come out to say the man embezzled so so money or so so person paid him illegal money for this or that, it's just that how can have this much.is it possible for someone of onnoghen to have that much or more, yes it is,let the man defend himself, this idea of coarsing the man to resign which is not a legal provision is only meant to validate the agenda of buhari,if I were in onnoghen's shoes I will never resign except if I'm not sure of my facts, like I said before investing money to earn profits is not same as establishing n running a business let onnoghen fight this case,if he resigns today forever he will be refers to as one of the corrupt persons 'saint' buhari dealt with.look at the case of buratai who was army director of procurement for years but buhari/Apc will tell the world that all other generals were corrupt except buratai, perhaps a law should be made that only buhari should decide who is corrupt or clean in the country. |

odiks: Twenty Senior Advocates of Nigeria, under the aegis of The Justice Reform Project, have described the corruption allegations against the Chief Justice of Nigeria, Justice Walter Onnoghen, as “a manifestation of deeper malaise” in the nation’s judiciary.
The SANs, who said they were deeply embarrassed by the Onnoghen saga, said it pointed to the need for urgent reforms in the judiciary.
They admitted that there were cases of litigants and lawyers procuring court judgements and orders, saying the spate of conflicting judgements being churned by judges is one proof of the corruption and incompetence in the system.
As a result of the rot, the SANs noted with regret, that unlike in the past, judgements from Nigerian courts were no longer being cited with approval in foreign courts.
From the composition of the National Judicial Council, to the process of appointing judges, to the criteria for the award of the SAN rank and others, the SANs said the system needed to be reformed.
They said these in a statement on Saturday, which they jointly signed.
Those who signed the statement are Mr Ebun Sofunde, Mr Kayode Sofola, Kola Awodein, Ademola Akinrele, Dr Eyimofe Atake, Mrs Olufunke Adekoya, Oluwafemi Atoyebi, Mr Yemi Candide-Johnson, Olasupo Shasore, Dr Babatunde Ajibade, Osaro Eghobamien, and Mr Babatunde Fagbohunlu.
Others are Mr Wemimo Ogunde, Mr Jibrin Okutepa, Mr Olumide Sofowora, Prof Ernest Ojukwu, Mr Olatunde Adejuyigbe, Dr Adewale Olawoyin, Mr Adeniyi Adegbonmire, and Mr Oyesoji Oyeleke.
The group said, “Certain facts are hardly contestable. There is a widespread perception that there is corruption in the judiciary and this perception is supported by anecdotal evidence.
“Unscrupulous litigants and some complicit lawyers, including some Senior Advocates, procure judgments and orders by corrupt means. It is also beyond dispute that the system for self-regulation in the judiciary and the legal profession has failed. Lack of transparency and a depreciation of the basic ethos of governance in the processes and procedures of the relevant institutions lies at the very heart of the challenges that the Bench and the Bar are currently facing.”
The SANs declared their resolve to engage with other stakeholders in the judiciary towards reforming the system.
https://punchng.com/onnoghens-trial-proof-of-deeper-rot-in-judiciary-sans/ This so call SANs will condemn onnoghen but will never condemn the buhari/Apc government of procuring a fraudulent ex parte order from the CCT,they will never condemn the CCB from flagrantly disobeying the law by refusing without reasons to respond to legal FOI request but allow government sponsored NGOs illegal access access to public documents,if you challenge them now to provide proof of their claims they will start chewing their tongues,a lawyer just stated that there's no law that prohibits anyone from investment n earning profits as that is different from running a business as the CCT act frowns at, onnoghen should summon the courage to fight his case to logical conclusion, which ever angle one looks at the onnoghen saga it's clear that there is a hidden agenda behind it, somebody must weather the storm to say no you can't keep destroying everyone just to suit yourself. |

kahal29: Some have argued that section 3 (d) of the code of conduct bureau and Tribunal act exonerate the suspended CJN Justice Walter Onnoghen from his present trial however going by his statement to the CCB it could be clearly seen that section 6 (b) of the same act indicts him assuming without conceding that he is exonerated by section 3 of the act.
According to section 6 of the CCB ACT...
Restrictions on specified officers:
Without prejudice to the generality of section 5 of this Act, A PUBLIC OFFICER SHALL NOT
(a) Receive or be paid the emoluments of any public office at the same time as he receives or is paid the emoluments of any other public office; or
(b) Except where he is not employed on full-time basis, engage or participate in the management or running of any private business, profession or trade; but nothing in this paragraph shall prevent a public officer from engaging in farming or participating in the management or running of any farm.
http://lawnigeria.com/LawsoftheFederation/CODE-OF-CONDUCT-BUREAU-AND-TRIBUNAL-ACT.html
Now according to Justice Walter Onnoghen's response statement to the CCB he said and I quote
https://www.nairaland.com/4995693/onnoghens-response-code-conduct-bureau
Therefore, going by Justice Onnoghen own admission of engaging in other businesses such Forex trading, AGRICODE (what ever that means) and investments which is prohibited by section 6(b) of the act i think it would be easier for the camel to pass through the eye of a needle than for CCT to free Justice Onnoghen at the end of his trial.
Finally, could be the realisation of this very fact that his legion of SAN'S are now looking for a soft landing for him as reported in the Punch Newspaper of Today? Could it also be the reason why the CCT Chairman, Justice Danladi is not bothered about his earlier rulings? If this is the way the law is then all government officials especially the big ones are corrupt n should be dealt with without exception,I still main that onnoghen's case is purely political.so the only business government officials can n should do is farming!,ok can't can't their spouses or children engage in any other businesses too?,na waoh!. |

Politics › Re: I Can Vouch For Atiku Anywhere - Obasanjo (reasons) by Deepthoughts: 7:29pm On Jan 30, 2019 |
PoliticsNigeria: @POLITICSNGR
Former President Olusegun Obasanjo on Wednesday said he could vouch for the presidential candidate of the Peoples Democratic Party (PDP) to reposition the country.
PoliticsNGR learned that Obasanjo made the statement in Lagos while speaking at the 2019 Island Club Quarterly Business Lecture. Abubakar had earlier delivered his lecture themed: “My vision to get Nigeria Working again”.
Obasanjo, in his remark said he believed that Atiku had the experience, the capacity and passion to move the country forward.
He said Nigerians should no longer find his support for the former vice president strange going by what he said or wrote about him in the past.
He reiterated that he stood firmly by whatever he said in the past about Atiku and indeed President Buhari.
He, however, said the PDP candidate had demonstrated what was expected of a committed and sincere leader by owing up to his past mistakes and showing remorse.
Obasanjo added that Atiku had not only apologised to his political party and the nation, but also apologised to him for the past disagreements he made as his deputy.
He said that Atiku was not infallible like every other human being and that he, (Obasanjo) would be playing God by not forgiving the former Vice-President.
“I have been called names because of my position on Atiku Abubakar, the Waziri Adamawa.
“Everything I have said as far as I have knowledge of Atiku, I have not retracted and I stand firmly by them because they are to the best of my knowledge true.
“And neither has what I have said and written about Buhari been controverted, if anything, they have been confirmed and proved beyond any shadow of doubt.
“But Atiku has done things which are absolutely imperative for a leader to be followed and believed.
“First, know who you are and present yourself as you are – a human being in blood and flesh and susceptible to human mistakes and human frailties.
“Don’t cover up with sanctimonious veneer of bogus integrity, incorruptibility, uprightness, goodness and false figures and statistics, all of which are contrived to deceive, to cheat, to plunder and to destroy.
“Atiku never claimed to be a saint and I never described him as such. I will never so describe any human being alive let alone calling him a Messiah.
“On an occasion in the past when I said that someone was not a Messiah, some Nigerians out of bad “belle’’ were up in arms.
“For me, as a Christian, the only Messiah I know and have is Jesus Christ and even then, the man aspect of Him was imperfect while the divine aspect of Him was perfectly messianic.
“Secondly, a leader must be honest to himself and to the people he serves or he wants to serve.
“He must identify and acknowledge his situation, mistakes, shortcomings and inadequacy; show remorse where and when he has erred, seek forgiveness and repent; and not passing the bulk or keep blaming others and fail to accept responsibility.
“Atiku accepts responsibility for his mistakes, shows remorse and seeks forgiveness from his political party and subsequently from Nigerians.
“He asks for forgiveness from me and as a believer, a Christian as such, I forgave him in accordance with the teaching and instruction of my Saviour.
“For, if you forgive men when they sin against you, your heavenly father will also forgive you.
“But if you do not forgive men their sins, your father will not forgive your sins (Matt 6:14-15 NIV).
“If anybody blames me for forgiving Atiku, I leave such a person with God Almighty, especially as both Christian and Islamic clerics joined Atiku to visit me to seek forgiveness.
“Anybody who does not forgive when forgiveness is sought with contrite heart cannot be a true believer and should not expect the forgiveness of God,” he said.
He said past disagreements notwithstanding, Atiku demonstrated great leadership qualities when he was in office as Vice-President.
Obasanjo said he believed with the experience and courage of Abubakar, he remained the best candidate to move the country forward.
“I must reiterate that Atiku is not a saint. Who is? But from what I know of Atiku, he will be a performer in all respect. I can say that again from my personal experience.
“He knows the problems and he handled some of them in the past.
“We now know that both Buhari and Atiku have issues and all of us as human beings have one issue or the other in different magnitudes.
“But judging both of them empirically and for the task at hand, Atiku will perform much better than Buhari.
“And he will seek for good and able people around the country and beyond and make use of them to achieve his mission and vision for the general good of Nigerians and the country,” he said.
Obasanjo claimed that the state of affairs under All Progressives Congress (APC) had been disappointing and called on the citizens to effect a change with their votes.
He also commended Island Club for providing the platform for leaders to articulate their visions for the country through the lecture.
He said the series of the Club’s lecture had helped enriched discourse on nation-building.
https://politicsngr.com/just-can-vouch-atiku-anywhere-obasanjo-reasons/ Good, Obasanjo has spoken, now those that are always so quick to believe his past uterances about Atiku n reference it to cast aspersions should now also believe him n reference this great revelations to support Atiku, henceforth any one that still refers to the past is an unbelieving hypocrite that wouldn't be forgiven. |

PoliticsNGR has gotten more details on the rejection of a motion filed by the suspended Chief Justice of Nigeria, Walter Onnoghen by the court of Appeal.
It was gathered that the Court of Appeal in Abuja rejected the request of Onnoghen to stay proceedings in the charge pending against him before the Code of Conduct Tribunal (CCT).
A three-man panel, led by Justice Abdul Aboki, in a ruling, dismissed the application Onnoghen filed to that effect.
The court said, in view of the provision of Section 306 of the Administration of Criminal Justice Act (ACJA), it lacked the power to stay proceedings in criminal cases.
https://politicsngr.com/exposed-real-reason-court-appeal-struck-onnoghens-case-details/ You see if buhari had just waited for the appeal court, now would have been the best time to seek the ex parte order n neatly achieve his objective whether clean or selfish but now for jumping the gun n engaging in illegality of procuring a questionable ex parte order to suspend onoghen without recourse to the NJC/NASS both onoghen, tanko Danladi should all go. |

QuotaSystem: A video has been making the rounds of a disgruntled legal practitioner who has been identified as Okere Kingdom Nnamdi, protesting outside the Federal High Court in Abuja, in which he claims the new CJN is unqualified for the position because "he was never called to bar and is a Sharia court Judge". Upon research from information freely available on the public domain, these claims were however found to be patently false.
His words: "There are so many lacunas in the 1999 Constitution,” he said. “That same constitution will tell you that an Islamic scholar from a Sharia Court of Appeal can be promoted to the Supreme Court of Nigeria, not minding that he was not called to the Nigerian Bar, that he didn’t read law, because he is an Islamic Scholar.”
“That was how the likes of Tanko Muhammad came to the Supreme Court. Let him tell us his enrolment number. Every Nigerian lawyer that is called to the Nigerian Bar that attended a university and the Nigerian Law School has an enrolment number. He does not have any,” he alleged.
THE FACTS
1. Justice Tanko attended Government Secondary School, Azare where he obtained the West Africa School Certificate in 1973 before he later proceeded to Ahmadu Bello University where he received a bachelor's degree in Law in 1980. The new CJN was called to bar in 1981 after graduating from the Nigerian Law School. He later obtained a Master and Doctorate (Ph. D) degree from the same university in 1984 and 1998 respectively
2. He was appointed Chief Magistrate in the FCT High Court in 1989 where he served for 2 years (not Sharia court, but they won't mention this).
3. He was sent to the Sharia Court of Appeal (Bauchi) in 1991 where he served for ONLY TWO (2) YEARS before he was appointed as a Justice of the Court of Appeal (again, not Sharia court) where he served for THIRTEEN (13) YEARS on the bench...before being sworn in as a Justice of the Supreme Court in 2007(again, not Sharia Court) where he has served the country for the last TWELVE (12) YEARS.
https://en.m.wikipedia.org/wiki/Ibrahim_Tanko_Muhammad
THE VERDICT: The new CJN is more than qualified to hold that office regardless of whatever some disgruntled semi-literate ignorant folks say...and he will remain in that office until Onnoghen is able to clear his soiled name if he ever does.
It is also important to note that Justice Tanko Mohammed is the natural successor to Onnoghen as he is the 2nd most senior Justice of the Supreme Court & Vice Chairman of the National Judicial Council (NJC). You have failed to clear the real issue, what is his legal enrollment number or hasn't he got one?,that is what will actually clear all doubts no storries you wrote up there,so please go back to Tanko n ask for his enrollment number if you truly want to defend n exonerate him. |

Prince Tony Momoh, a national leader of the ruling All Progressives Congress (APC ) and former Minister of Information in this interview with TEMIDAYO AKINSUYI speaks on the controversy trailing the suspension of former Chief Justice of Nigeria(CJN), Walter Onnoghen and other issues. Excerpts:
As a lawyer and someone who has held a high public office, what is your perspective on the controversy trailing the suspension of the former CJN, Justice Walter Onnoghen?
It is not what I think but I know what the law says. Section 172 of the Constitution says that every public officer at federal level will abide by the provisions of the 5th Schedule. The 5th schedule is the Code of Conduct provision in the constitution. Then Section 209 says that every public servant at the state level will abide by the provisions of the 5th schedule. The first part of the 5th schedule creates the Code of Conduct Bureau (CCB) and the Code of Conduct Tribunal (CCT). Part 2 states those who are subject to the Code of Conduct Bureau and the Code of Conduct Tribunal. The first on the list is the President and the Vice-President. Going down the line, you will see the Chief Justice of Nigeria and other judicial officers. Going down the line, you will see the President of the Code of Conduct Bureau and the Chairman of the Code of Conduct Tribunal. All public officers both at the state and federal level are subject to the provisions of the Code of Conduct . Before they take office, they swear to abide by the provisions of the Code of Conduct. Whether you are taking the office of President, Governor, National Assembly or Chairman of Local Government, all public officers at the state or federal level swear to abide by the Code of Conduct provision in the constitution. If you are taking office, the CCB will give you a form to fill declaring your assets. If you declare your assets, every four years, you renew that declaration. If anything turns up before the four years, you will revisit that declaration. If there is any problem about you declaring, they will ask you and then you react. If they think it is necessary, they refer you to the CCT.
What then are the functions of the CCT?
The CCT is not a court, it is a disciplinarian body that disciplines those who are working at both the federal and state level. So, technically, the CCT has no jurisdiction over those who are not public servants. Public servants are those listed under Part 2 of the Schedule, starting with the President down to the Councillor. It means therefore that you are not protected by the immunity which Section 308 of the Constitution grants to the President, Vice-President, Governors and Deputy Governors. There is however a proviso. The protection by immunity is during the period of office when they are performing the functions of office. No court can try these four persons during that period. But you can be investigated and when you are investigated, there are two bodies that will deal with you, that is the House of Assembly in the case of the governor and the National Assembly in the case of the President through a process called impeachment. Then the other body is the CCB and the CCT.
Your own functions are in Schedule 7 when you take the oath of office. Before you assume office, you take the oath of allegiance to the constitution of Nigeria and then the oath of office. The President, Vice-President, Governors and Deputies, Ministers and lawmakers all take the oath of allegiance where what they are supposed to do is spelt out. There is nowhere in that oath of office where it is said that you will be corrupt or be a money launderer. So, if you look at it, the immunity clause does not protect anyone who is corrupt because corruption or money laundering are not functions of an office.
If for instance, there is anything about filling the forms; it will go to the CCB and not any other person. That is the body that monitors the performance of your office irrespective of your position or the office you are holding.
Some are arguing that the CJN should have been made to appear before the National Judicial Council (NJC) and not the CCT. What is your take on that?
If there is anything wrong with your asset declaration, it will go to the CCT. You don’t take your case to NJC or any other body. The NJC is a disciplinary body for judicial officers and when you do anything wrong in the performance of your functions as a judicial officer, you go there. Anything that has to with criminal acts goes to either the High Court or CCT.
So, if I were the CJN, since I have agreed that there was something wrong in my filling of forms which calls my integrity to question, I will resign. I put all the blame on the CJN. As far as I am concerned, since he has accepted that there is irregularity in his filling of forms, let him save us all the trouble by resigning or stepping aside.
Do you think President Buhari breached the constitution by suspending him from office?
If you refuse to step down after you have admitted guilt, what do you think will happen? You think the whole world should be laughing at us that we have corrupt officers in our government? Someone should save us the embarrassment that Onnoghen’s remaining in office is causing us and that is what President Buhari has done by suspending him.
What is your take on the recent claim by former President Olusegun Obasanjo that President Buhari is behaving like a dictator and that he has perfected plans to rig the forthcoming presidential election?
Looking at Obasanjo, my own take is that he has established himself as the most present former head of state in the history of Nigeria. He is present and vocal in every regime. He was present during Shagari’s time, he was present during Buhari’s first coming between 1984 and 1985, he was present during Babangida’s era between 1985 and 1993, he was present during Abacha’s time from 1993 to 1998, he was present during Abdulsalami Abubakar’s time, he was present during his own regime when he worked with Atiku Abubakar, whom he said can never be anything but has now come to be his agent. He was present during Umaru Yar’Adua’s time, he was present during Jonathan’s time and he is also present now. So, there is no time he has not shown his presence at any regime and God has given him good health for him to be able to be active.
But looking at his records, he has shown to the average person that he is a loser and unfortunate nuisance. Obasanjo is national nuisance. To him, there is no other person apart from Obasanjo. He is very active but wants to continue to be in power when he is no longer in power. https://www.independent.ng/buhari-saved-nigeria-from-embarrassment-by-suspending-onnoghen-tony-momoh/ Tony momoh an Apc stalwart as is typical with them is only been clever by half, the CCB act states clearly that where an individual admits mistake in filling the assets form,he should be invited for clarification n not to be referred to CCT automatically, secondly resignation when been accussed is purely an act of self honour it's never a law.The chair of CCT justice Danladi also has a corruption case against him but he hasn't resigned infact it's becoming clear that Apc has kept him just to executive hatched jobs for them, buhari is simply pursuing a predetermined agenda and those supporting him like mommoh are only taking a tigers ride, let them continue to celebrate while it last. |

afroniger: http://thenationonlineng.net/presidential-candidates-back-suspension-onnoghen/ Assuming without accepting that buhari was right to have suspended onnoghen without recourse to the NJC OR SENATE,was the ex parte order given by the CCT legal or genuine?, the CCT sat n adjourned on the 22/1/19,then on 23/1/19 the CCT purportedly issued an ex parte order, now who moved for the order?,was it argued in open court?,why did the order not bear the names of the lawyers who sought it as it's legally required?. which ever way one may look at what buhari has done, it's clearly wrong, fraudulent n dangerous,it should be condemned except if one chooses to be sentimental, onnoghen's case is already in court, let the law takes its course, buhari is clearly pursuing a predetermined objective n like senator shehu sani said, those of you supporting buhari for whatever sentimental reason are only taking a ride on a tiger. |

disturbedman: If this Bureau De Change Onnoghen and his PDP paymasters indeed are for Nigeria to prosper and do the right thing, this "forgetting" and "mistaking" judge will resign on the weight of allegations against him.
You say you don't have a private business and you don't have another side job, but you have millions of dollars, pounds and euros in your numerous accounts! And when you're asked to defend how you got the billions, you run like a headless chicken from one court to the other to stop your prosecution! To show you're guilty of the allegation, you suspend the JCN you head from sitting indefinitely!
If na me be Buhari, I go put you straight in jail. But e do well sha.
SenseWillNotKillMe please can you tell me if there any law that requires anyone been accused to resign?,n if there is why has danladi of the CCT remained as the chairman?,no one is saying onoghen shouldn't be tried but let the law be followed, after all the CCB act itself states clearly that where someone has accepted a mistake in his/her assets declaration form, the matter should not be referred to the CCT immediately but the mistakes should be cleared, it's now clear that the ex parte order granted by danladi was fraudulently procured as no one moved for it,it was not argued in court n it doesn't bear the name of any lawyer who sought it!,so for God's sake on what basis other than hate n sentiments are you people supporting buhari over this very dangerous illegality?. |

Gistpeeps: sometimes I wonder if osibanjo is truly a pastor, even if politics is dirty shouldn't a pastor make a difference,ok you call the opposition pdp thieves but you are willing to accept n celebrate the same thieves when they cross over to your party so what kind of a pastor are you?,Leah shuaibu is still in captivity because of her Christian faith osibanjo's voice has not been heard for her defense or release, but osibanjo is ever ready to lick the anus of buhari even where he is clearly wrong yet osibanjo pride himself as a pastor n proffessor of law, osibanjo's conduct in this government has defeated the essence of the insistence that buhari must have a Christian as a running mate. |

PearlStreet: No one is even asking how Onnoghen got the suspicious funds in his account cos it's normal to steal when you're in Government.
Obi and the lunatics in PDP were comparing Nigeria to China.
If Onnoghen tried this kind of nonsense in China, he would have been beheaded in the presence of his grandchildren and family members. In China the law would have been duely followed n when finally convicted, execution would have followed. |
