A person commits fraud to the tune of 1.1bn and the total fine I’m seeing here is not even up to half of what he stole. And then he goes free if he is able to pay the fine. Lawyers in the house I’m sure there is something I’m missing here. Can someone explain the sense in this pls? I didn’t see any statement concerning restitution in the judgement given too.

Well, he is also facing a civil case on the same issue and with this conviction, he may likely lose the civil case and pay more. That's the reason given by the judge for not adding a refund of the total loot as one of the sentences.

In the US, smuggling a truck of cigarettes from the state of Delaware to New York can fetch a profit of 2 million dollars.

Smuggling 100,000 cigarettes from Malaysia to the UK can fetch as much as 150,000 pounds in profit

The offence here is the evasion of customs duty. Buying cigarettes in countries with low duty and selling in high duty countries is a brisk, criminal business.

And candidate B wins 15 states, has higher numerical figures but doesn't get 25 % in 24 states.

Who would be declared winner?

Nigeria is different from those countries. There are court cases to decide who the actual candidate is up till a week before the election. What happens if the candidate is changed?

Electoral college does not exist in Nigeria.

In the US, each state gets electoral college seats equivalent to the number of legislators (house of reps+senators) that the state has (based essentially on population) and whichever candidate wins that state gets the electoral college seats for that state.

Hilary Clinton had more total votes but not as much electoral college seats.

If Nigeria used Electoral college system, then states such as Lagos, Kano, Borno, Rivers, Katsina, Kaduna and Oyo will be must win as each states election will be winners take all. Obi will stand no chance in that scenario. States like Ekiti, Ebonyi and Bayelsa, no one will bother campaigning.

It will be a rerun between the two highest candidates. A critical part to even look at is if the 25% in 24 states doesn't include FCT, what will happen? That may involve going to court for an interpretation.

Not the two highest candidates. The potential rerun is between the candidate with the highest amount of votes and among the others, the one who won the most number of States.

Also, the 24 States does not have to include the FCT. Shagari had 12 out of 19 and was considered to have met the conditions. You only need 24. If you have 23 States, then you can use 25% in FCT to meet it up.

You guys don't read the constitution, you just assume.

Go and read section 134 of the constitution thoroughly.

The runoff is between the candidate with the highest votes and of the other candidates, the won who most amount of states.

Below is the section 134 in its entirety.


Section 134 of the Constitution of the Federal Republic of Nigeria
(1) A candidate for an election to the office of President shall be deemed to have be been duly elected, where, there being only two candidates for the election -

(a) he has the majority of votes cast at the election; and

(b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.

(2) A candidate for an election to the office of President shall be deemed to have been duly elected where, there being more than two candidates for the election-

(a) he has the highest number of votes cast at the election;

and

(b) he has not less than one-quarter of the votes cast at the election each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja.

(3) In a default of a candidate duly elected in accordance with subsection (2) of this section their shall be a second election in accordance with subsection (4) of this section at which the only candidate shall be -

(a) the candidate who scored the highest number of votes at any election held in accordance with the said subsection (2) of this section; and

(b) one among the remaining candidates who has a majority of votes in the highest number of States, so however that where there are more than one candidate with majority of votes in the highest number of States, the candidate among them with the highest total of votes cast at the election shall be the second candidate for the election.

(4) In default of a candidate duly elected under the foregoing subsections, the Independent National Electoral Commission shall within seven days of the result of the election held under the said subsections, arrange for an election between the two candidates and a candidate at such election shall be deemed elected to the office of President if -

(a) he has a majority of votes cast at the election; and

(b) he has not less than one-quarter of the votes cast at the election in each of at least two-thirds of all the States in the Federation and the Federal Capital Territory, Abuja

(5) In default of a candidate duly elected under subsection (4) of this section, the Independent National Electoral Commission shall, within seven days of the result of the election held under the aforesaid subsection (4), arrange for another election between the two candidates to which the subsection relates and a candidate at such election shall be deemed to have been duly elected to the office of President, if he has a majority of the votes cast at the election.
