I told some guys here about a week ago that the section 299 that Tinubu lawyers and supporters are hinging on to argue that the FCT is just another state in Nigeria, only referred to the administration of the territory and did not preclude the place of the FCT as one of the provisions that must be satisfied before a presidential candidate is declared.

They argued with me then, but I’m happy to see my argument incorporated by Obi lawyers in their written address in response to Tinubu and Shettima at the tribunal.

Questions for determination:

1) If the FCT is a state (in the sense canvassed for by Tinubu lawyers and supporters) why was there no governorship election in the territory on March 18, 2023 when the rest of Nigerian states had their gubernatorial elections except for those whose election have been staggered?

2) In the 1979 constitution, the condition that a presidential candidate must satisfy before being declared a winner was to “get highest number of votes cast and 25% in 2/3 of the states of the federation.” No mention was made of the FCT which was Lagos then. The question therefore is, if it was not intended that a presidential candidate must score 25% in the FCT, why was that provision attached in the 1999 constitution? Why didn’t the requirement just end with “… and score 25% of votes cast in 2/3 of the states of federation as it was in the 1979 constitution?

3) Because the FCT has no elected governor or mayor, the president appoints a minister who administers the territory on his behalf. Does it not make sense therefore, that man who will appoint the administrator for this territory MUST have at least 25% approval of indigenes and residents of the territory?

The truth is that like is popularly said, the law is a bitch. It cares not about your sentiments and biases, it will serve justice by letters and spirit of the law.

Tinubu did not satisfy the constitutional provision to be declared a winner which makes his declaration null and void.

During the presidential election it is always treated as a state. There are SC judgements on that which have never been vacated..

A country that has long sunked since the time of Jonathan's administration, the last good/fair government we had was Yaradua and Obasanjo's administration. Jonathan is the architect of the present country we have, Buhari couldn't do any better and Tinubu is just trying to pull us out by the drastic decisions he's taking which has it's negative impact which would only be for a very short time before we start seeing the positive effects of his decisions. In my opinion BAT shiukd have prepared ground before implementation. It was yesterday that the fuel pump price increased again. Must we be increasing it because if the market forces?

IN SUMMARY..
If the APC agreed that Shettima was nominated on an earlier date,, (which was supposed to coincide with the last possible date for his nomination, without which Tinubu gets disqualified), then Shettima would go in for double nomination..
And then, if they agreed that Shettima was nominated on a later date, then, Tinubu must already had been disqualified,, being that his 14-days for replacing the resigned place-holder had already elapsed long time ago.

Apart from the sociological factors, the petition is defective at its root. The only problematic point or issue is the 25% in the FCT and the Court will devise a way to split the decision with the majority construing Section 134 to mean a state in line with prior precedents of the Supreme Court. The Supreme Court will also deliver a split decision to save Tinubu and Nigeria.

God will help everybody. I have some legal chops so when i saw the written address, i knew there was no way for Peter Obi. I am very cleared eyed about things due to my training.

There is no way the Court will rule for Obi. As for the issue of 25% in FCT, the Court will use good old common law constitutionalism to dispense with that problem.

In addition, the judges will choose to offend Obi & Igbos than Yorubas and the Southwest where Lagos is situated. If the Court rules against Tinubu, Lagos and Nigeria will boil and that is inimical to Nigeria's national economic interest. Obi does not even have IPOB or the Niger Delta boys in his corner. And for many Nigerians, they do jot care if igbos burn down their own region to the ground in anger. Igbo land is not important to Nigeria.

Also, wants to die for a stingy and effeminate Obi? But plenty area boys will die for Tinubu. These are some of the sociological factors the Court will consider in reaching their decision. Judges are human beings just like ordinary Nigerians. Just that they have a legal training and have been elevated to the bench.

With regards to this petition, i am confident that the Court will dismiss it with costs.

First of all, i will start by saying Non-Igbo supporters of Peter Obi really tried for him during the election period. For example, I as a yoruba man made many enemies because I supported Peter Obi. But that is in the past now.

The crux of this write up is that Peter Obi wasted a rare opportunity of utilizing the unity of Nigerians caused by Buhari's misrule to galvanize real change. Since he knew he will be cheated, why did Peter Obi not mend fences with the Igbo elites and perhaps his IPOB brothers to instigate some sort of uprising after should he be cheated? I attribute that to the disorganization and powerless position igbos have found themselves in Nigeria. Igbos are confused, disorganized, defeated and disoriented in handling their regional and collective affairs in Nigeria. Most Igbos are now refugees in other regions having fled their own region due to conflict. Their wahala is a self-inflicted one because they are a very arrogant and disunited people. I know Peter Obi won that election but he is a small boy to Tinubu and he cannot fight him in any way, shape or form. It is a sad reality we all have to deal with. State capture is real.

As for the case in Court, having read the final written address by Chief Wole Olanipekun (SAN) i can categorically state that the petition will be dismissed because there is no way that any Court of law will rule in favor of Peter Obi given the plethora of legal and evidentiary issues plaguing Peter Obi's petition as dissected in that final written address (I urge every interested person to read and digest that Final Written Address). The doctrine of covering the field was used to block all legal loopholes in Tinubu's case and he is well guarded. I cannot wait for the response from Obi's legal team and i can confidently preempt their written address by stating that they wont have any cogent points but to try and distinguish the legal authorities cited by Olanipekun & APC's legal team. Tinubu has Peter Obi cornered already and there is no escape for Obi.

Even if there were no legal issues bedeviling the Peter Obi's petition, the Courts will still rule against Peter Obi and nothing will happen. Peter Obi does not have any extensive network, neither does he come from a strong region which can trouble Nigeria. Heck, even Igbo elites are not on his side because as a people, Igbos dont just have any leverage in Nigeria. They cannot shake things up.

I know Igbos and Obidients (mainly made up of IPOB remnants now since other non-igbos have left the movement) will insult me for saying the truth but the truth must still be said.

My advice is for everybody to move on and not hope for any favorable judgment from the Court. The petition will be dismissed with punitive costs for being frivolous, speculative and time wasting.

From the first day at the court I know LP and PDP are just waisting their times to challenge BAT victory.
The hearing became a TV drama when televisions were taken to the court to show only journalists reporting what INEC chairman said.
All the LP and PDP lawyers shiukd be flogged in public for their poor way of defending OBi and Atiku.
In their petitions neither of them came with a correct result of the election that can make them winners of election

The written address of Olanipekun has summed up my opinion on the case and jettioned all the pleas of Obi and Atiku.

Reading through the written address of Tinubu and Shettima lawyers at the ongoing election petition tribunal led by supposed respected senior lawyer Wole Olanipekun, one can’t help but giggle at the hollowness and shallowness of their defense.

In the address, Mr Olanipekun was busy citing the case of Shagari vs Awolowo that happened as far back as 1979 under the 1979 Constitution and in election conducted by FEDECO, as our electoral commission was called then.

Since 1979, we’ve have had many reformations to our electoral laws and have even changed our constitution.

If anything, the most relevant case as far as election cases are concerned in Nigeria today, is the Supreme Court ruling in Osun in case of Oyetola vs Adeleke. This case is the most relevant because it is the only Supreme Court decision since the Electoral Act 2022 came into force.

Ironically, Mr Olanipekun surreptitiously ignored the Osun case which has a lot of similarities with the case at PEPT as they both bother on the place of technology in our election and to what degree INEC can choose to apply or ignore technology in our elections.

It is pertinent to state these things for the world to hear, read and see, so that we all keep an eye on the judiciary and see what comes out it.

Remember that it is not enough to do justice, justice must also be seen to have been done.
I read the oral submission of the Tinubu / Shettima . Olanipekun cited what is enough for now to support FCT as having the toga of state and previous presidential cases as precedents in tbe ongoing case.

That he did not talk about Oyetola case has no defect in the case.

What he omitted will be the input of the judges in their judgement.

The judges will rely on the principles of SC on Oyetola's case to strike out the PDP and LP cases

Got a chipped tooth about ten years ago, and those brown stain have cover the chipped parts ever since.

They don't bother me in any other way, except that I love grooming myself and those stains irritates me.

Is it possible to be removed? Or, can a dentist file that part off and make it more even without the stain?

Note that I brush my teeth 2 to three times daily cause I hate it when plaques started building up after eating. But those stains have remained.

While discussing with a group of pals, one adviced him to go for NYSC because they'll request for the certificate when you apply for a job.

He told him about a course mate during his time who was turned down for a private job just because he didn't go for NYSC.

I use to think that only government Jobs require NYSC as a criteria for getting hired.

The National Chairman of the Labour Party, Barrister Julius Abure, said that he has been informed of the plans by the All Progressives Congress (APC)-led government to work ahead of a possible rerun, knowing that the tide of the wind is heavily tilted against it.

The National Chairman also called on the over 10 million members of the party to be on the alert and get ready to further humiliate APC and its government in the polls if their sinister plot materializes.

Barrister Abure stated this on Monday, 10th of July, during an online meeting held with Nigerian-American Coalition for Justice and Democracy led by Professor Eddie Oparaoji, who is the Labour Party Diaspora Chairman in the United States.


Abure said: “Rumours have it that those in government are already planning for rerun and this is one of the support we will be canvasing from you. We should also be getting prepared because since all those in government are already preparing for rerun we too should not be taken unawares.

“So we will be needing your engagement and support on this aspect if par adventure it happens today, that the election is nullified which is not what we are asking for, because we are asking for outright declaration of Peter Obi as the President of Nigeria.

“We believe strongly that we won that election given the statistics we have, given the result we have, we are not expecting anything less than the declaration of Peter Obi as the president of the Federal Republic of Nigeria.

“But supposing that didn’t happened as the government is believed to be planning for a rerun it will not also be out of place for we to be preparing for a rerun election.

“Having said this by the side, I must say clearly that we have put all our evidences before the court we are very hopeful that the tribunal will act on our favour.

“And we are very hopeful that supposing the matter gets to the higher court, the Supreme Court, in this case, it will also act in our favour.

“We are keeping our hope and confidence alive.

“In 9 months we are able to change the political narratives of this country and we must build on that successes and so that we can have a more formidable party that we can strategically positioned fro the down trodden people of Nigeria.”


In his contribution, the Director of ObiDatti Presidential Campaign, Ambassador Oseloka Obaze called on ObiDatti members in diaspora to see the struggle for recovering of our mandate as a collective responsibility and one that no one can actually abandoned for any other reason.


He said: “Great countries of the world are built by the citizens of the country and I think we have in the diaspora enormous human capital.

“What we need to do is to be able to harvest them bring them home and make Nigeria to be a great place.

“The process is ongoing, the campaign to change this nation is not just an event, it is a process, a long drawn process.

“How long it is going to last, we don’t know, but I think what we serve as the most and best is to remain focused on our various sectors; you that are in diaspora do what you can do to support us, we that are in the trenches, we will continue to keep the ground.”

The chairman of the Nigerian-American Coalition for Justice and Democracy, Professor Oparaoji in his speech titled ‘Fostering a purposeful diaspora partnership for a new Nigeria’ said that the group in partnership with all Obidients in diaspora has the potential to contribute significantly to Nigerian’s development.

Professor Oparaoji said: “Through advocacy, human rights promotion, capacity building, investment, education and healthcare support, diaspora engagement, and policy advocacy, we can play a crucial role in fostering Democratic governance, justice, and socio-economic progress in Nigeria.
