This is where the relevant law that tackles responsibility comes in. Of course you solely responsible, but there's a loophole in the system that allows the appellant to demonstrate  his/her standing in the community by providing a character reference. Besides that, wait, won't argue with you 'cause you know little.

Law is all about proving wrong the allegation levelled against you, whether truthfully or otherwise. It doesn't matter how you go about fighting the case, just win.
I really hope that people don't take you seriously and go ahead with your AJ-kingdom immigration law because it will only end in tears and heavy financial lost.

@justwise,

so what do you advice someone in my case to do ? embarassed embarassed cry cry tell the truth or use another lie to cover another lie
Tell the truth, lying to cover another lie will only get you deeper into the mess, tell the truth and keep your new identity which is genuine, i know it may take time but at the end of it all you know that you got nothing to hide or worry about immigration wise again.

@justwise, now I know you don't know much about law. Have you read or seen relevant case laws regarding this issue? I guess not! Precedence have to be followed. No separate law for A, and another for B, except ofcourse a biased or prejudiced one.

Just that I don't know you personally. We would have done a bet, and see who wins.

Pls note: It is not a prerequisite that you must fill and submit your application yourself. However, you'll be required to provide your finger prints during the processing.
Whether you complete it and submitted it yourself or somebody else did on your behalf you are solely responsible for whatever information in that form, as long as you are an adult you can not blame anybody else for whatever false information in that form, its your responsibility.

I have called the embassy several times they cant tell me if my Local Govt can be my sponsor they keep telling me to check the web,i have sent series of email and they have refused to reply, This Uk System is something Else even America and Canada is not as though as this, i will go ahead and apply and submit it with their bank statement
A Tier 4 (General) student can receive official financial sponsor from Her Majesty’s 172. Government, the Tier 4 (General) student’s home government, the British Council or any international organisation, international company, university or an Independent School.
If one can be sponsored by his company,Uncle, etc i think my Local GOVT can sponsor me, paying the money into my account they might think will abandon my education and run away with their money, you know how Govt thinks. i will go to my Local Govt before monday i will let u know the outcome
Well i can only wish you the very best of luck, strange things happens in visa cases sometimes.

Justwise kindly access my case. I submitted my application already, and i only submitted my laminated degree certificate. Thats the only thing stated in my cas. I also submitted my bank statement with a cover note from the bank. Now the thing is all i need to show in my account is N2.6m, my account has not gone below N2.9m for over 2months but money goes in and out. Now this is my fear, i deposited some money for my sister, about 1million naira which i took out to help her pay for something cus she wasn't in the country then. the payment took my balance to about 4million naira and wen i took it out, i still had 3m. now my quest is the transactions are on the statement i submitted i hope there won't be any quest about it. And by the way, i still hav a running 2yrs uk visa on my passport hope dat counts for good.
As long as the transaction did not affect the 28days counting then u will be ok.

thanks for the response, i am really happy you opened this thread, it is an eye opener for me, i have made up my mind to tell them the truth, nothing but the truth, i dont want to complicate issues, i might get the visa now if i lie but i might get stucked somewhere in d future, so i think honesty is the way forward and im ready to bear the consequences,

@paris,

bros i go really need your help and your advice too bro, please expantiate, how can one go about this
Don't waste your time and money appealing that case, you can not convince the American embassy that it was an honest mistake, telling them that somebody applied for the visa lottery without ur knowledge will not be taken as a credible excuse.

Listen to me @poster, believe me, these are your best options if you still want to go the States:

A lot of people don't understand immigration law on this forum. Whilst reading your post, I noticed you mentioned honest mistake and some unnecessary details.  You can appeal this decision of refusal.

Whether you were given appeal right or not, trust me you can win this case. Well, very easily!

A decision will be made whether you knowingly used incorrect and forged documents or an honest mistake (which does not come from your part) contributed to you being denied a visa.  The standard of proof is on the Case Worker to show evidence and proof beyond reasonable  doubt  that you actually intended to deceive them.

Pls note that you were refused based on common sense and by immigration regulations that deals with forged documents and false representation. This is can also challenged.

* What to do:

You must write the to US Consulate/Embassy citing the grounds that leads to the forged documents and incorrect personal information (All these would be included in your appeal bundle).

The important part:

I won't say it because people will start calling me names. I do give out vital immigration informations but it seems people tend to take the meek out of everything.

Nigerians would abuse the system. If everyone agrees that my post would not be quoted, then I'm ready to reveal how to beat the system and then delete it later.

And if your appeal is not successful, come here and call me whatever you want to call.
I will delete it before anybody sees it, if you have genuine advice then give him here, no dodgy dealing please.

Please JUSTWISE someone from the BCIE sent the email below but i totally do not agree with him
Dear Osamede,

Thanks for the enquiry. Please be informed that the UK Border Agency does
not recognise Local Govts as financial sponsors. Only the Federal Govt of
Nigeria is qualified to sponsor you. The option available to you now is to
convince your local govt to pay the money into your account or that of your
parents. Anything short of this will earn you visal refusal.

If they said that local govt can't sponsor you then let them pay the money into your account since the scholarship is given to you already. It will save you alot of trouble that way.

Thank you very much Just wise for answering my questions and very fast
How should my Local government write my supporting letter and the award/scholarship letter what should be included as per the BHC requirements things to include in their letter
I'm pretty sure that your local govt will know exactly how to word those letters but all i can say is that you need two pieces documents from your local govt.

One is the scholarship award letter to you and another one is supporting letter addressed to the ECO from your local govt, confirming that you have been awarded a scholarship by them, details of the scholarship and reason(s) why you are the deserving winner of the scholarship. Both letters should state whether the scholarship is a full one or half scholarship, by that i mean whether the scholarship will cover all your school fees and maintenance fees or half of it.

The information below is from this website http://www.ukba.homeoffice.gov.uk/visas-immigration/studying/child-students/evidence/money/# you can check it out
Evidence of an official financial sponsor or government sponsor Close

If your Tier 4 sponsor is giving you any any official financial sponsorship, it can include details of this on your confirmation of acceptance for studies (CAS). You do not need to provide any documents as evidence of this official financial sponsorship. If you do not know whether your CAS contains this information, you must ask your Tier 4 sponsor.

In any other circumstances where you are being given official financial sponsorship, you must provide send us a letter of confirmation from your official financial sponsor. The letter must be on the organisation's official letter-headed paper or stationery, and must bear the organisation's official stamp. It must show:

*
your name ;
*
the official financial sponsor's name and contact details;
*
the date of the letter;
*
the length of the sponsorship; and
*
the amount of money that the official financial sponsor is giving to you
, or a statement that it will cover all of your course fees and living costs.
In this case they are referring to scholarship given to you by your school. Your school is referred to as Tie 4 sponsor

well, i dont wanna share that information up here because it might encourage others to use that same route and end of in a situation like mine. However, i can tell you that i didnt use any fake documents and i used my real name to study. infact, ive never used any fake documents or fake names before.

All i just wanna know if theres any immigration law that can aide my situation. i've read through a lot of immigration laws, but sometimes you gotta seek knowledge outside the box to gain a broader and more practical perspective.

i wanna return home now because i dont want my skills to go wasted here. Also, i wanna be sure i can get only a year ban for returning voluntarily. how true is this? has anyone here overstayed before and got only a year's ban for returning @ their own expense?
I know where you are coming from and i wouldn't encourage you to go into any detail here.

As per for the ban for over staying and going home voluntarily . . that will depend on how long you over stayed, it ranges from a year to about 5yrs or 10yrs i think. . . need to check that out.

You would have been in a better position to win the appeal case if you are married with kids because in that case you have a right to family life.

The evidence of money held must be of cash funds in the bank (this includes savings 163. accounts and current accounts even when notice must be given), as a loan letter or official financial or government sponsorship available to the applicant. Other accounts or financial instruments such as shares, bonds, overdrafts, credit cards and pension funds are not acceptable, regardless of notice period.

Means i have to show bank statement, Am i right?
The line in bold says it all. Show that to your local govt and see if that will convince them.

I'm 22 years old, currently in the UK, i have a very complicated immigration situation and some genuine advice from you guys would be much appreciated. i dont know where to start this, but any questions please feel free to ask.

I came to the UK when i was 16 on a 2-year tourist visa which expired during the process of an Indefinite Leave to Remain (IDR) application. Some of my direct family members like my dad, step-mum, sisters and brother live here permanently as british citizens by birth, by Naturalisation, or have IDRs. They all got this when they were young through my dad while he was working here. But my mum and my other siblings live in Nigeria. My dad has now retired and he's on pensions and benefits from the government. I couldn't apply for IDR through him because we read in the UK border force website that he has to prove that he can sponsor me without recourse to public funds. So we decided to do it through one of my older sisters that works (which all do), when i turned 17. The application was refused on the grounds that my sister cannot take the sole responsibility for my upbringing if my parents were still alive. And they suggested i returned back to Nigeria to live with my mother instead since it was her i just departed from. As at the waiting period of my application, i started on my A-levels and before i completed them, i got the refusal letter.

So instead of dropping out of school, i completed my A-levels and got admission into university as a home-fee paying student. I took the offer, and 3 years later i graduated. I got a part-fee scholarship to do my masters of which i'm now undertaking, but i'm so scared of what to do next. My family have been very supportive including my step-mum and they really contribute a lot (both financially and affectionately) to my upbringing. They also do not want me to go back because they really like having me around. I also have a girlfriend who is british and she too doesn't want me to leave. I also hear i could get a 10-year ban if go back. I complete my masters degree later this year and i don't know what to do after. I hear routes of this EEA family thing or by marriage, but i don't know what to do. I've been here 6 years now also.  undecided
Boy!! you really dig deep into the system and come out with some really complicated issues for yourself.

How did you convince them that you qualified to study as home student? What document did you present to the university?

There could be a way out but its not going to be an easy one.

One more thing. . . check your school website about payment system as regard to people being sponsored by an organisation or govt.

And read UKBA Tie 4 policy guidance about people being sponsored by their home govt, there are some helpful info there.

Thank You Justwise, I do not want to take any chances you are very familiar with VISA system, Do you know if they have any special requirement that i need to submit with my VISA application in this regards? Has it worked for any one you know? In tier 4 students requirement that you are familiar with is it possible to apply without the bank statement?
A scholarship award letter from your local govt should be enough in place of bank statement as long as that award letter can be verified through an official channel by the BHC. When you are given a scholarship by a govt i don't necessarily expect them to attach bank statement, an official letter explaining the details of the scholarship and why you deserved to be given one will do

You should inform your school that you are being sponsored by your local govt and the award letter forwarded to them as well.

I have explained in details over and over to the Local Government that they have to attach their bank statement, they keep telling me that they will give me an award letter/scholarship letter that they will be sponsoring my education in the UK, that since it is my Home government that is sponsoring me that i do not need bank statement
In that case go ahead with it.

I have been given an offer for Msc in Uk, Can I use my Local Government as my sponsor, or they should pay the money into my account
If I can use my Local Government as my sponsor what are the documents I need to submit to the embassy along with my application
Your sponsor has to show evidence of finance available to you and the letter addressed to the BHC. Or they put the money in your account

I am new to this forum but my question is in line with the Tier 1 post study work permit.

thank you for your request for an administrative review regarding our decision to refuse your application as a Tier 1 Post Study Worker in the UK.  I have duly considered your grounds for appeal but am satisfied the decision to refuse your application was correct.

You state in your grounds that you have submitted evidence of funds up to and including 26 August but this is not the case.  Your most recent account only covers the period to 15 March 2011.  You suggest the entry clearance officer should have contacted the bank to confirm the current balance but this is outside their remit and the bank would not have been able to provide the relevant information due to data protection issues.  The onus is on the applicant to provide sufficient evidence to support their application and you have quite clearly failed to do that on two occassions.  I have therefore upheld the decision.

You are entitled to re-apply at any time.

I have more than the required amount in my UK account but I relied on them to verify from my bank and they mentioned data protection. Moreover, the last sentence confused me the more. Can I really reapply even though it is over one year ago that my certificate was issued to me. I need your advice before they CHOP my moneyhuh
I think you can re-apply with a year old certificate, check UKBA website for that.
