irokop: You are simply an ignoramus fellow, op story is apsolutly correct in fact there are too many victims like this,
This guy never do any thing wrong, the system made it look as if he commited crime, the European law says if u are in civil relationship after blablabla you are instilled to stay in the country legally.
The problem here is what the uk board believed cos the guy says he is married to a French lady although you must be living to gether but hang on how many couples in Nigeria lives in port harcourt while their wife is on Abuja or Lagos, the answer will be too many.
Ops problem is May be the lady is no where to be found or some of them are very silly if the uk board officer screw them and some times promise them one or two juicy promises they will open up and tell them that may be they ware giving money. Had it been op had pregnanted any lady there his Tory for change under article 6 that is human right, some of our commentators here are very ignorant of the subject matter that why they are making blonders. Obviously you are actually the ignorant one here. These people are not married, he wanted visa and she wanted money in exchange for it and at process of doing that they were caught. its sham, it's fake Marriage and the EU or British law do not recognise it. Article 6 of EU convention on human right does not deal with right for private and family life, Artcle 8 does. |

esere826: I am not a lawyer, and neither are you I suspect.
My argument is premised on this logic: 1) two people enter into a legal binding marriage contract >> 2)The system determines that this marriage was intended to get unfair access to the goodies of the system>> 3) the system goes ahead to block the privileges that could be got from this marriage contract.
Question/Idea 1) Although the system has activated logic 2 and 3, was the marriage at Logic 1 annulled, i.e deemed to have never existed in the eyes of EU law or has there been a legal divorce?
If it is still legally deemed that they are married then it comes with some universal privileges whether na sham or not. Depending on the region, such privileges can be switched on. Look at the article on sham marriage and you would see how tricky it is. I doubt if anyone as actually challenged it. Maybe because rich folks who can challenge it don't need to follow that route. Some old men get married to young ladies so that they can have carers. While the young ladies are after inheritance.
Question/Idea 2) The OP was told to sign a document. He does not say that he was taking before a court of law. It is possible that in the document, he decided to wave some privileges that the marriage would have got him in exchange for some soft landing. So what would make sense is to review what soft landings were granted him. Not all data is shared even within the UK just like that.
Idea 3) I narrated a case were someone was banned from travelling to the UK for 10 years for what the UK deemed as a crime -falsification of document I'm not praising the person for doing this. However the person travelled to the US recently and might be relocating to Canada soon I am aware that the person wasn't quick to write a narrative to the US embassy of how she was banned from travelling to the UK
What suggestions do you have to share? Do you rather we stone him to death You really need to stop attending night school and do some home reading, when does sham marriage becomes legally binding marriage? Which system legalized it? A marriage was deemed illegal by UK law and you are here writing pages of theories. |

Ikebesupa: It is absolutely well with my soul... When i had looked on my experience abroad(UK) i tell my goodself that i really tried! An immigration officer that handled my case was totally dumbfounded because she couldn't ascertain why i have gone for the sham marriage. She never stopped talking about my immigrantion history which she really admired: if she was to be theresa may, she would let me go but its totally out of her jurisdiction( she just called my name and said "accept the slap" ;( and i did by signing documents to return to mother Nigeria. Someone talked about impatient! Yes you are right about but i dont want to believe your second name to be JOB. When you got no helping hand and its just only you, if i had not got any work permit from nigeria to study in the uk with student visa as well, i might not travel as it will be extremely hard for me cos i know where i have come from. I went to UK to study and work as well to support my studies. But i had the work permit and genuine visa and everything is going fine until they stopped immigrants working while studying as they thought immigrants was taken away jobs from their people.. Ask me what kind of job, odd jobs that students do to partly support themselves. I have been to the UK and i thank them very much indeed for giving me the opportunity in the first place. I will always confess that i was made a criminal cos of what the UK govt believe and not because of what i have done Was your school a private college? |

ManInTheMirror: Dude do u know how to use Google? Basically if an individual commits a crime and he is sent to prison, after 7 yrs from the expiry of his sentence, the crime becomes spent which means he doesn't have to declare it anymore on application forms for jobs or whatever except for crimes of violence. I hope you have been educated now. Another misleading info from you, in many job and visa applications you are instructed to declare any crime committed whether spent or not including police warnings. You many not be allowed to enter a country like Australia if you have spent a year or more in prison even if you declared it in your landing card. |

Ikebesupa: @justwise.. I got my visa here in Nigeria with weekly work permit as applicable to students. My visa ran out in the course of study and i renewed again and still got my visa. I was legally studied and was law abiding. As i have mentioned in my comments earlier, most people that have been in the UK btw 2012 till date can testify UK immigration policy on stripping working permit for most foreign immigrants. To be honest, there are those that abuse the privilege of working while studying be it nigerians,Pakistanis, Bangladesh, Indians etc. The policy really affected me. My school record was very fine, my immigration record was fine as well. I need the working and studying as well as i am not from a rich family so i wanna support my humble self. I didn't hurt anyone by the marriage, it was just to get work permit. I got almost 18 months visa when all these are happening. In the summary, i was made a criminal not because of what i have done but because of what they believe. Only GOD can judge me!! Listen bro...credit to you for been honest with the whole situation, what happened will not stop you from moving forward positively from here. Yes PSW was cancelled in 2012 and many foreign students suffered because it, i personally benefited from PSW just after my first degree and when it was cancelled many of my mates who came 2012 hoping to stay back and work suffered, some went back while some went on to do more studies. Sham marriage is risky, its a crime, yes some do get away with it while some are not so lucky and get caught, jailed then deported. Even when you got away with it you will still be looking over your shoulder hoping that your partner in crime will not get in trouble in future and get you necked when her marriage history is traced. Move on with your life, you can still travel in future but don't try to do anything silly by using short-cuts, you still have a lot to live for. |

Na beg i dey beg una oooo my wise people. I just got deported from the UK on Feb. 2014, i went as a student but things got very though cos of UK immigration policies every now and then. I got to marry a french national but it busted so i couldn't help the situation. They said i need to return home and i accepted and signed the documents but it is not because of what i have done but because of what they had believed. Note: its not because my visa had expired, ofcourse i had my valid student visas but not allowed work at all. Now i am in my fatherland thou not planning any travelling anytime soon, i want to find out from wise people on here if this situation has jeopardise any future travel plans anywhere in the world ofcourse except the UK. What do you reckon? share whatever you got on here. Cheers mate esere826: @Ikebesupa I am aware of a lady who while in nigeria was banned for 10yrs from travelling to the uk her boyfriend who was then in the UK had to relocate back to nigeria they are now married, and she recently travelled to the US for a visit without any issues my bad advice to you is for you to gradually and carefully test the waters you were not deported, neither were you convicted so, i see no reason why you should offer more information than neccessary also, you are still legally married to that lady if i am not mistaken (i only read the 1st page of your thread) try to confirm this from the authorities you probably should try travelling to her country as a first step Read well before you give people wrong adverse, sham marriage is illegal and its a crime. |

pappilo: False.
Countries do not routinely share visa applicant details. You can apply for US, schengen or Irish visa but obviously you wont declare your deportation.
I personally know 2 people who have had UK home office wahala.
First guy was deported. Went to the high commission and applied for a UK visa with another name (before finger printing), collected 6 months, then 2 years and finally a 5 year visa. By the time the 5 year visa expired, the finger printing process had started so he has never bothered to reapply for a UK visa. Since then he has been to over 20 countries including the US and several Schengen countries. He has a house here he rents out so anytime he needs to come over, he flies to Ireland on his Irish visa and people wey sabi can fill in the rest.
2nd guy ran away from a police investigation and returned to naija. Kept coming in on his 2 year visa. When he reapplied, they pointed out the error of his ways in running from plod and They kukuma dash am 10yr ban. Since then he has obtained a student visa and studied in western Europe and has also applied for and obtained a 2yr US visa. Bro I'm not talking about what is criminally posible which is what your story is all about, I'm talking about reality here, your second person experience narrative happened before finger printing was introduced so it's not applicable in this case. |

EndtimeBlessing: I have someone here with me as I am typing this. She came to UK on a 2yrs visiting visa. The law is that you must not stay more than 6 months at once. She violated this law by overstaying the 6 months at a stretch. The 2 years visiting visa was then canceled. She re-applied after 1 year and she's back now on another 6 months visiting visa.
My question is: were you banned from re-applying for 10 years as part of what you did? If the answer is no and you are sure, I can tell you it's not as bad as you think. You will only need prayers and a good immigration adviser on the next step to take. Its 90 days ....3 months and not 6 months. The two cases are not related, over staying and engaging in sham marriage are not the same. |
