Sir, I think you are mixing it up. Not all evictions, for lack of a better word, need to go through the courts. The cops are usually called to enable a smooth process, ensure there is no public breach of peace, or avoid violence in the process.
Let me put it to you in another perspective - if a friend visits you and stays for a month and you want them to leave. If they refuse, will you need to go through the law courts? No, you can get the cops to help you lawfully remove them. In this case, if you remove sentiments from it, the husband has just as much rights as the friend, None.

The wife is the only one on the lease, hence she has all the rights. She can lawfully remove anyone else she doesn’t want in there, including husband, family, children, friends as she so wishes. That’s the law. So what transpired between the husband and wife here is a lawful removal process.
The husband should have made other arrangements when he knew his wife wanted him out. Because he already knew previously. Instead, he went to council to council to get case officers etc.

Why stay where you are not wanted? Especially when you don’t have much rights.

A friend who came to visit, came to visit...they don’t have any home right in UK law.

And the fact that it is only her name that is on the lease does not mean anything and does not breach the husband’s home rights.

Don’t be fooled. There is no violation of rights here, no 50-50. Only a law court can determine if it’s to be shared 50-50. Even at that, this is a tenancy, not outright ownership. So residence is up to the person on the lease. If his name is not on it, his rights of residency is as long as she allows it.

Absent of a pre-nuptials agreement, all properties acquired after marriage are jointly owned on a 50-50 pro-rated bases, it does not matter whose name is in what and if one person is working and the other is not.

And no, the Judge does not decide if it is 50-50, that is the law; the Judge decides who gets what base on their previous earning capacity, who the kids will be with, and in the case of residence the home is usually given to the party that the kids will be with, but the interest of the other party will be protected.

Sometimes the value of the home will be accessed and if given to the person that will be staying with the kid, the other individual will be given their pro-rates share of the value of that home in their settlement agreement.

All properties are subject to the same rule, including rental properties. This is call “Matrimonial Home Rights” in the UK. The law protects the individual whose name is not on the lease and they both have equal rights to the home, only a Judge can decide otherwise...a Police cannot just show up when one partner called and kick the other out absence a domestic violence report.

Yes you can be evicted on the lease holder’s mood swings if he or she wants. Married or not.
There are pros and cons to all the choices you make as a couple. Married or not, doesn’t give you residency anywhere. It’s whose name is on the papers.

That is not an illegal eviction. They are totally within their rights. If his name is not on the lease, he lives there as long as the lease holder permits. End of story. And I’m not here to debate the state of their relationship or reasons. That’s their wahala.

I didn’t say, you can’t be evicted.

You can only be evicted through a court order. The lease holder can not wake, call the cops and get you kick out, absent a domestic violence or assault, they have to go through the proper legal eviction process.

No one can kick you out on a house you are paying the bill with name on it. If they tried that, then leave the bills to them and sort your yourself out.

Not true!

There are many reasons couples don’t put both of their names on a tenancy agreement or mortgage note and in many situations it is a prudent financial decision.

If you are married you cannot be kicked out merely because your name is not on a tenancy or mortgage note.

What the cops did above is an illegal eviction and they can get in trouble for it, at least a re-training, if the guy pursue the case against them.

I can tell you that, what those police did is illegal and he can get compensated fir the violation of his right if he sues them.

Absent a domestic violence, a police can’t show up and ask someone to leave their home. It does not matter who owns or renting the house, they are married therefore irrespective of ownership, it is joint property with 50-50 ownership.

If she wants him to leave, she can do that by causing a friction, argument or instigate something and if the guy is so naive or stupid to lay his hands on her, then he gets kick out.

The other way to get him out, is to file an eviction notice with the court and a Judge will hear the case and render a decision and an order.

You are going into sex with the wrong mindset. You are excited, happy, want to satisfy yourself,etc.

Change your mindset, you are there for one purpose alone and that is to satisfy her...anything you do, let that principle guide you...when you are getting too excited or hype, do anything you can to blunt that feeling either by redirecting your thoughts, reduce the speed of thrust, pause, change position, direction, etc.

Continue in this pattern until she comes, then you can get your come.

Once you master it, it become easier and you can gradually add your own excitement.

Until all the facts are in, it is premature to call anyone heartless.

If they are all going on strike and no medical personnel is going to be on attendance at the ICU, I do not expect the Nurses to abandon the baby.

More so, it is stated that, they discharged the baby, which means the baby was handed over to their parents.

I sympathize with the Nurses in this situation, all the Doctors and other medical personnels have long abandon the hospital and left them with the difficult and moral decisions either stay around and work without pay or discharge everyone and move or koko abandon dem self.....I the scapegoats here are going to be junior Nurses or Nurses in trainee because the Senior Nurses must have all absconded long time ago, just like Oga/Madam Doctor.

One of the major take away from this news is the confirmation that recent cement price increases are actually from the manufacturers.

Up until now, they have been feeding us lies that, it is the distributors and middlemen that are increasing the price because of shortage of cement from the manufacturers and that, the manufacturers are still selling to these distributors at the old rates.....also that, the manufacturers were taking a lost initially just to meet their distribution quota and that, it is only now that they are making some profits.

Though any decerning adult knows that, those were cock-n-bull stories and that the manufacturers have a hand in the price hike, the FG government has now authoritatively confirmed it.

I think that, you have not made up your mind to kick her out and slam the door against her face, maybe because of the seemly benefits of the relationship to your kids....otherwise, you wouldn’t be here asking ‘how you can do it’.....if you have made up your mind, a million and one ‘how to do it ’ will automatically appear.

Eventually, the combined US Government intelligence efforts will catch them, the company can’t wait that long as they have to resume business otherwise they can go bankrupt or a competitor can take over their client or base.

This is not the first time, this has happened in the US....just like everywhere else, individuals, families and companies do negotiate with the bad guys just to rescue their love ones precious commodity despite the stands of the Government.

If you are still at the NVC stage and you are going to submit your documents to NVC after May 15, 2021; it will be better you use AGI from the filed 2020 IRS form 1040, they should have access to this if they have filed their 2020 taxes, if they didn't file their taxes themselves, they just have to contact their tax preparer of the CPA they used to file their 2020 taxes.

Only use the W2 when it is absolute that, you can not at least get hold of the filed IRS form 1040 for 2020. Also note that, regardless of what you used to get DQ, when going for the interview ensure to get the IRS transcripts for 2020 or at the minimum the filed IRS form 1040.

If you are submitting your NVC documents before May 15, you may totally exclude the 2020 tax information and NVC may not hold that against you, because they know that, taxes are not yet due; but like in the above case, since the interview will occur after the tax due date, your interviewer at the embassy may require you to come with them to the interview.

That said, back to your question....

If this is their total gross income for 2020, and for a total dependent of 4 plus you making 5 (assuming you are not migrating with another person that they are also sponsoring and they had not sponsored anyone else in the past who is now a US permanent resident), you should be okay. I-864P for 2021 requires a minimum AGI of $38,800 for a household size of 5.....as a general rule for a dependent of 4....US AGI are about 5% - 10% less than gross income, so even if you assume the worst-case scenario and use an estimate that 90% of that $62k will be their AGI, that will be about $55k8, which is much higher than the required $38k8 needed....and, if this is a joint-sponsor, the threshold you have to cross become much lower, since they will also consider the income of the petitioner.

The OP was probably referring to IRS Tax Transcript which is always the document they request for I-864

I believe I understood what the OP was asking for and addressed it, you can read my piece again.

FYI, there is nothing like TurboTax 1040 form, TurboTax is a Tax agency that adopted IRS form 1040 just like other Tax agencies like TaxAct, etc....and you do not ‘get’ IRS form 1040 when you file your returns, rather you use IRS form 1040 to file your return...and IRS do not ‘issue’ returns....unless you meant ‘issue refund’ even at that...your transcripts are not ready when IRS issues refunds....and not everyone that filed taxes get issued a refund, but everyone that filed taxes can get their tax transcripts by contacting IRS.

IRS Tax transcripts and IRS form 1040 don’t always contain the same information...1040 is what you filed with IRS and Tax transcripts is IRS rendition of your filed taxes and can contain corrections, updates, adjustments, additions, subtractions, etc made by IRS.

Yes, you can submit your signed files submitted IRS form 1040 they pack the same legal power as an IRS transcript before any United States agency home and abroad. I864 form instructions clearly stated you can use “... IRS Form 1040 or IRS Tax Return Transcript” even W2 though not accurate in determining AGI can also be used and if the gross income on the AGI is very high, the interviewing officer can do a wrong maths on the spot to gestimate your AGI and if fall within a vey wide range compare to the baseline, you should be good.

Want to make a correction to the previous post on AGI....your AGI and the figure you will enter into your I864 for the IRS form (202), it is item 11 and not 15 as previously stated.

The quoted part above is questionable, or unless he does not know what he is saying or he might be mistaking the form 1040 with IRS transcript

You file your taxes using form 1040 and if the taxes are submitted to IRS electronically, you can print out the form 1040 and that becomes your official filed tax document and accepted everywhere and he can give you the AGI from his 2020 form 1040, and if they physically mail their form 1040 taxes to IRS, you are usually advised to make a copy of it...IRS does not send back you 1040s. But, what will not be immediately available is the IRS transcript, as the transcript is produced by IRS and it takes time...but, he/she does not need to wait for the IRS transcript as the IRS transcript is IRS' own records of what you sent them via your form 1040.

As to your second question; you really cannot get AGI from W2, AGI take into considerations your exact tax bracket, allowed deductions, dependents, etc.....and you do not know your true AGI until you complete the form 1040. W2 contains information you sent to your employee and it is 'cabbage-in cabbage-out'.

All that said, you can use the gross on W2 info, but when going to your interview or when NVC want to DQ and tax filing date for 2020 has past, they may ask for 1040s or IRS transcript and since your AGI is going to be lower than the gross on W2, it may impact if you income of your support is sufficient to cover all their current dependents plus you and all derivative applicants on your application that they are supporting.

For example, this is an IRS form 1040 below and that is the form most people in the US use to file their individual tax returns and if he or some agency or accountant has filed their 2020 taxes, they or that agency or accountant will have a copy of their 1040, they just have to contact that place and ask them to give them a printout.

Line 1 is what is on your W2 or combination of all your W2s, 1099, earned income, etc....AGI is what is on line 15 and that is what needed on your immigration document.

Whereas, there are some people with great self-control in addition to the Grace of God, no matter how the hunger beat them reach, they would always control it until they can get to that their favorite spot and food....Note that, these set of people the choice did not come naturally, they did it in spite of the urge to 'settle' for mama put, in addition to the Grace of God in their live plus their huge self control that did not come naturally, but through previous daily tasks and undertakings.

This appear to be a negotiation between the FG & the cement company for bulk purchases for the proposed FG Housing estate.

Instead of going through the effort and giving you specific example that show that violence in churches in Anambra, I will challenge you to give me an example of election violence in churches in any other state, as other states uses churches and I will in turn give you an example of election violence in in church in Anambra..., mosques and residences of prominent people in the community for INEC elections.

My only query for INEC is why are they not carrying this same exercise throughout the country? My guess is, if they do, there will not be enough places to conduct INEC Elections throughout the country.

The major reason why Anambra elections are usually peaceful and don't witness violence like in neighbouring states is that elections are held within church premises which deter thugs who are scared of engaging in nefarious activities in such sacred places. INEC goofed on this. It shows that they plan to disrupt the peaceful conduct of the election to rig it for somebody. The should reverse this decision immediately especially that of the church.

Whatever you guys do.....DON’T transfer the money to another account given to you by someone, not even by the bank.

Even if she takes you guys to the police station and the ‘settlement’ at the station is to transfer the money elsewhere, don’t do it.

By spending the money, you are stealing and you guys could get into trouble for that.

I will advise that, you refund the part you guys have used including the fees and either leave the money...

1. As-is in your account to be generating interest - not the best option.

2. Transfer it back to the original sender. - good option.

3. Petition EFCC or CBN and copy Sarah (Evenly) - another good option.

And you guys should be very careful with Sarah (Evenly), if this is fraudulent and they try using your mom’s account as a conduit, they could be very dangerous and can even trace you guys and mount unbearable pressure with threats to transfer the money to a third party account, that is why just seating on the money and not either sending it back or contacting the authorities is dangerous.

And if transferring it back, don’t transfer the 3m, remember that the bank charged your mom’s account some fees on receipt and they will also charge you guys fees when you transfer it back.

Yes AGI on 2019 IRS transcripts, since as of date....that is the most recent taxes filed.
