My mum petitioned for me and my brother and we are already at the NVC stage. We have paid all the necessary fees and we are filing our Visa forms and about to start uploading documents.

The place of birth on my brother's NPC birth certificate carries Owerri while the one on his passport carries Mbaise. We are confused as to whether to use the information on the passport or birth certificate to fill the form.

He would have requested for another birth certificate that would tally with the information on the passport but he already submitted this current birthday certificate to USCIS. And knowing that USCIS transferred the case to NVC, NVC might have this current birthday certificate already.

Won't we complicate issues if they discover that we uploaded a different certificate

The real question is, where was your brother born, Mbaise or Owerri?

I understand that you have been previously advised to go with mbaise. But you have to stick to a straight storyline.

If you guys are sticking with mbaise, I will advise that you use mbaise to complete all your forms, but go ahead and do an affidavit stating that your NPC birth certificate have the wrong place of birth and go ahead to obtain a corrected BC that will have mbaise on it.

You should not submit this new birth certificate, but have it with you along with the affidavit when going forward the interview, incase the question comes, you cab easily tell the interviewer that, there was a mistake on the previously submitted BC....here is the affidavit and corrected BC.

It is important that the info on your BC are accurate and tallies with your other documents, because in the US, you will depend these documents from time to time, so use this opportunity to straighten them up.

The Nigerian National Assembly passed the Terrorism Prevention Act of 2011, which was signed into law on June 3, 2011, by President Goodluck Jonathan.

And during Jonathan Administration, a few people were charged federally using the Act.

Nigeria also rectifies the UN convention on terrorism, which proscribe hostage aka kidnapping among other terrorist Acts.

I would say wait until interview details come in or something to know what you need to do in addition to medicals. This is uncertain time and some things may be waived.

I will agree that, a wait is needed until the interview date is known, this way one will know what documents to bring.

But, I doubt if they will waive anything and you wouldn’t get much of a detail beyond what is obtainable on their website to bring photographs, do medical, bring originals or certified copies of “all supporting documents” submitted to CEAC.

Now, if you don’t go with any document they want or expired documents, you wouldn’t be denied, it will just delay your visa as you will have to make another interview date.

Are you saying the tax papers would be ready by May 15, if so would you rather I just wait for my petitioner to get it since we are already in May.

Secondly, will I get DQ/CC without submitting all documents while I have the unsubmitted documents available for the interview.. I'm just being desperate because it's taking my petitioner and joint sponsor so much time to get these documents ready.

May 15, 2021 is the deadline to file 2020 taxes, their 2020 Tax transcripts wouldn’t be ready by May 15, it may take more months, since IRS is the one who prepares the tax transcripts based on their submitted 2020 taxes and send it to them upon request or they can print it from IRS website.

However, they should have their filed tax 1040 forms & schedules by May 15, ask them to send those to you along with the W2s.

You are good, you did not need the 2020 tax documents to get DQ, because those taxes were not due when you submitted your documents to NVC.

However, just like you will need to get a new police report for your interview if the one you submitted to NVC have expired (more than one year), it will also advisable to also get updated tax documents for your interview, including the ones submitted to NVC.

Yes, you can but it is tricky as W2 do not give a complete picture....preferably to use IRS transcript.

However, I doubt they will insist on 2020 transcripts when for an interview date occurring in 2021 before official tax due date in the US for 2020 taxes which is May 15, 2021.

To be on the safer side, go with three years worth of IRS tax transcripts, plus the 2020 W2s ie transcripts for 2017, 2018, 2019 & 2020 W2s.

Also make sure to ask your sponsor to write a letter introducing themselves, how they know you and the fact that they understand the obligations and responsibilities in sponsoring you and they intend to dutifully carry out their responsibilities and obligations towards you.

Yes, PD for May 15 2008 became current on December 2019 and the rest PDs for May 2008 became current Jan 2020.

If you are DQ, you are placed at the back of a very long queue for an interview, and I heard that it is a very very long queue, due to the fact that, the embassy is not fully opened yet and they are dealing with the backlog of cases that piled during the shutdown due to pandemic and those cases that were put in Administrative processing due to Trump's Executive Orders that got revised by Biden.

You may have to wait some more months more, the best way to deal with it is to forget about it and go about your life.....when you are called for an interview, you may have to get a new police report....as embassy consider police reports to have expired after one year.....and your police report must be current when you are traveling to the US.

All F4 categories for Nigerians filed on or before Oct 1st, 2007 are now current...anyone whose PD is in this date range and have not received notifications from NVC to start sending in their documents, should call, email NVC or send a message to them from their website.

Chart A is final action dates.

Please, what does it mean for a PD to be current and how can I determine that? I am a novice.

e.g. the date that USCIS receives your relatives immigration petition on your behalf is your PD, this date is noted on the upper section of the response letter USCIS will send back to your relative.

Now, your PD is current, if the date listed on the Visa bulletin for this month and is on or after the PD indicted in your USCIS. This means you must have or will soon receive notification from NVC that your case is ready for processing and for F4 category for Nigerians, as per current bulletin, it will take about 14 years....eg I filed for an F4 relative in 2007, their PD became current last year, 2020.

Note that, PD becoming current is different from your immigration petition getting approved by USCIS, in most cases for F4 category, USCIS would approve your petition within one year and send your package to NVC where it will sit in queue for another 13 years.

Also note that, since these are immigration petitions, there could be further delay due to any Presidential executive order or an Act of congress e.g. during Obama years, since they could not get Congress to approve the DREAMERS Act, they decided that they will borrow visa cap from currently approved immigration caps and assign them to DREAMERS, this further reduces the number of available visas to family immigrations therefore further increasing the wait time.

Also note that, immediate relatives are not subject to these wait and these are mainly your unmarried children below certain age spouse and parents who immediately go to the front of the line once USCIS has approved their petitions.

Priority date for F4 category, filed on or before Oct. 1st, 2007 are not current....So, you are looking at 14 years and not 10 years any more!

Infact, count yourself lucky, if you were otherwise a Mexicans, you will be looking at 22 years wait periods....no wonder they are jumping the fence. The truth is, the wait time will only increase with time, because the more Nigerians that get immigrated to the US, the longer they increase the wait time, hence Indians, Mexicans and Phillipines have the longest wait time.

This is not true, there is nothing in the immigration Act that states, a joint sponsor must be a family member.

However, the joint sponsor must show that, he/she understands their undertaking and will abide by it....to diffused, this in addition to completing the joint sponsor forms and sending their IRS tax returns, the joint sponsor should write a personal letter to the embassy stating how they know the applicant, if they understand what they are doing and their commitment to abide by it.

I have joint sponsor for many, most are not family members, but friends.

On mad Maxine firstly, she's not a private citizen she's a public servant, Secondly, even the judge admit it could be a ground for appeal .

Anything can be ground for an appeal, we all know the defense was going to appeal regardless. They have been asking the Judge to throw out the case right from the beginning.

That you appeal does not mean you will win, it is just like getting arrested by a police, they can arrest you for any reason, but they have to convince the court that you are guilty.

All American citizen have first amendment rights to free speech, private or public. Also, at the beginning of the trial, the Judge issued a gag order to the Defense and Prosecution and journalists took him to court to invalidate that order, he had no choice than to rescind it, especially when he found out that, the Defense and the Prosecution were selectively leaking stuff that make them look happy to the media.

Jury sequestration is an option open to the Judge, you can’t success on appeal because of lack of sequestration of the jury....though they were sequester during deliberations. The court always try to balance the easy to serve in jury, otherwise it will be hard to find people who will serve in jury.

Jury tampering is a basis for appeals to start with.

Stupid people everywhere, they couldn't keep their damned mouth shut .

He got a fair trial, Maxine Waters is not a court official, not subject to the court jurisdiction and not part of the case in any form or shape.

She is a private citizen and entitle to her opinions and project by the first amendment. The Jury had earlier been advised to ignore public comments or the publicity.

If court verdicts begin to be tossed out because a politician said one thing or another, no conviction will ever stand, because no matter the case, there will be people with strong opinions on both sides and it will only take one to over turn a verdict.

Though the defense can try and appeal, but they will have a hard time.

I empathize with you as it’s a very difficult situation...but, it’s false to conclude that, it is not possible to know before acquisition, if a land is government owned or free...

Most likely you did not do a survey or went to the government office with your survey to search their records....even in high cost area like Lagos, it cost about N70k to hire an omonile lawyer to give you the facts about the land.
