The persistent revenue shortfall experienced by the country due to oil theft will likely continue next year, a report has predicted.

This, it said, may result to a decline in the federation account allocation to the three tiers of government as well as the budget.

Standard Chartered Bank's London-based Head of Macroeconomics and Regional Head of Research for Africa, Razia Khan, stated this in a latest report titled: “Nigeria – Politics Takes Centre Stage,” obtained at the weekend.

Indications emerged last week that the Excess Crude Account (ECA) had depleted to $3.18 billion.
The finance ministry estimated the amount of stolen oil to be at about 80,000 barrels per day (bpd), just as a Chatham House report had estimated the trade to be worth $38 billion a year.
The amount of production shut in as a result of oil theft was said to be costing the country close to one-fifth of its output.


However, Khan noted: “With domestic politics dominating in 2014, Nigeria is unlikely to make much progress on tackling oil theft. The passage of the long-awaited Petroleum Industry Bill (PIB), an ambitious plan to reform the upstream and downstream oil sectors, is also uncertain.

“With the PDP’s majority in the National Assembly looking increasingly tenuous, PIB passage is unlikely. Uncertainty over future fiscal terms has exerted a high cost on Nigeria’s oil sector.
“The number of deep-water wells drilled in recent years lags far behind regional peers. Near-term, robust local appetite to buy onshore assets from international oil companies is likely to be constrained by the availability of financing.”

The report pointed out that the power sector reforms would be a key influence on the economic (and possibly the political) outlook.
The first half 2013 gross domestic product (GDP) was negatively affected by supply disruptions from the West African Gas Pipeline, driving power generation to new lows.

The report also stated that power supply might improve meaningfully only in the medium term, adding that agric sector reforms and the focus on the agriculture value chain was expected to have a positive near-term effect on the economy.

“The 2014 budget was not presented in November 2013, the typical timeframe. This was ostensibly because of disagreement over the benchmark oil price. The contentious political backdrop raises the risk that no budget will be passed by end-March 2014 (the deadline for approving the budget).
“In addition, the still-ambitious oil output assumption (2.39mmbd versus 2.53mmbd in 2013) is likely to require further augmentation of budget revenue using ECA proceeds.

“With ECA savings thought to have declined to close to $3.3billion, this raises upside risks to borrowing projections. Given revenue constraints, the capital expenditure budget will be cut according to the Medium Term Expenditure Framework, with the share of recurrent expenditure set to increase to 74 per cent,” it stated.

In addition, the NEITI official drew THISDAY’s attention to revenue leakages arising from the operations of the Nigerian Petroleum Development Company (NPDC), the exploration and production subsidiary of NNPC.
He recalled that Shell, Agip and Total had sold their 45 per cent equity interest in at least six oil blocks, which NNPC had insisted on transferring the operatorship of the said blocks to NPDC.

“Meanwhile, NPDC lacked the technical or financial capacity to operate these oil mining leases (OMLs). So what it did was to turn around to appoint two local oil firms with no track record in the upstream oil and gas sector under a shoddy financing arrangement for the six OMLs.

“From investigations, all the two firms did was to put down $50 million, which has enabled them lift up to 60 per cent of NPDC’s crude oil under the cost recovery programme.

“It is the likes of such firms that Sanusi referred to in his letter when he drew the attention of the president to the bureau de change (BDCs) that have purchased several hundreds of millions of naira from the interbank market, but were unable to account for these monies.

“This is clearly a case of money laundering by persons with links to the oil and gas sector, and this was the reason behind the withdrawal of 20 BDC licences last September by the CBN,” he revealed.



He insisted that the audit of NNPC’s operations had become imperative, but felt that PricewaterhouseCoopers (PWC), which had already been appointed by the Minister of Petroleum Resources, Mrs. Diezani Alison-Madueke, should be reinforced with the appointment of an extra independent audit firm to scrutinise the books of the corporation.

“Under the NNPC Act, it is meant to be audited annually but NEITI has never been given access to its accounts. This is unacceptable for a national oil company,” he said.

The furore raised by a letter written by the Governor of the Central Bank of Nigeria (CBN), Sanusi Lamido Sanusi, to President Goodluck Jonathan notifying him of the non-remittance by the Nigerian National Petroleum Corporation (NNPC) of crude oil proceeds amounting to $49.8 billion into the Federation Account shows no sign of abating with industry experts calling for a comprehensive audit of NNPC’s operations.

They have also called for the establishment of a technical committee comprising the Federal Ministry of Finance, NNPC, CBN, Department of Petroleum Resources (DPR), Federal Inland Revenue Service (FIRS) and representatives of the auditors general of the 36 states of the federation, among other relevant stakeholders, to undertake a proper reconciliation of crude lifting and sales proceeds by NNPC and oil companies, identify revenue leakages and implement fiscal controls to plug the leakages.

Speaking on the issue at the weekend, officials of the Nigerian Extractive Industries Transparency Initiative (NEITI) and International Oil Companies (IOCs) warned that it would be dangerous for the federal government to ignore the serious concerns raised by Sanusi and attempt to obscure the issues under the guise that it was politically motivated.

“What Sanusi wrote was not new. Remember that in our 2011 report on the industry, NEITI raised the alarm over revenue shortfalls of N3.2 trillion.

Similarly, Nuhu Ribadu, in his report on the industry last year, raised a similar issue, stating some $30 billion could not be accounted for.

“Yet all these issues were ignored and swept under the carpet, while NNPC always embarks on media war to obfuscate the issues. But we can no longer continue like this, otherwise the economy will collapse,” the NEITI official warned.


He said he had studied Sanusi’s letter carefully and noted that the addendum indicating crude lifting, sales proceeds and actual remittances was quite revealing.

“If you notice in the data provided by the CBN governor, it showed that total national crude oil lifting over the 19-month period was 1,287,742,641 barrels as provided by pre-shipment inspectors. This comes to an average of 67.7 million barrels a month that was lifted from the country from January 2012 to July 2013.

“A further breakdown showed that Nigeria exported on average 2.29 million barrels per day (mbpd), and when this is multiplied by the average crude oil price of $110 per barrel, total national crude proceeds would come to $142 billion as shown by CBN.

“Of the total national crude oil lifting, NNPC exported 594,024,107 barrels or an average of 31.26 million barrels a month as its share of equity crude. But of the amount, NNPC was only able to repatriate $15.528 billion into the Federation Account and has insisted since Sanusi’s letter was made public that the revenue shortfall of $49.8 billion was remitted into the Federation Account by DPR and FIRS as royalties and petroleum profit tax respectively,” he explained.

He said this could not be true as it was obvious that there were considerable leakages in the crude oil lifting and sales regime, which had outweighed the oil theft and deferment caused by vandalism to pipelines and oil facilities.

According to him, “If you add what NNPC has repatriated, that is, $15.528 billion and the shortfall of $49.8 billion, what this implies is that Nigeria is only making earnings from an estimated 40 per cent of total national crude oil lifting and sales, and this is impossible as Nigeria should get a lot more.”

The NEITI official also demanded to know how much of the $49.8 billion was actually paid into the Federation Account by DPR and FIRS as claimed by NNPC.

He further sought to know the breakdown paid by the IOCs, indigenous oil firms and NNPC, stating, “We are not even certain NNPC pays its share of PPT and royalties from its equity crude because when the IOCs are asked, they provide conflicting figures from those submitted by NNPC.”

When reminded that there is a Modified Carrier Agreement (MCA) for Joint Venture operations (JVs) and that the corporation also takes out 445,000 barrels per day (bpd) for domestic refining, and these may account for the drop in NNPC’s equity crude oil lifting and sales to 40 per cent, the NEITI official maintained it is in these areas the leakages are most prevalent.

If you had read my post very well and carefully, you would have seen tha I divided the issues into two. For the issues I first listed, they really don't need any so called proofs, except from lazy minds or paid hacks. Go and read again.

The second part which I said Obasanjo was cautious in talking about need more proofs. Again, read.

In any case, all intelligent and discenring people can see that most of the issues raised need no further proofs.

How come you ignored all of them and decided to hold on to issues that I had earlier said Obasanjo was cautious about?

This is not a time for hairsplitting or back and forth or bringing up nebulous issues or opening silly threads. Many issues there don't need further proofs because they are self-evident or already have references. It is absolutely ridiculous, foolish and asinine to wave off all the contents of the letter on the altar of proofs, Obasanjo's intention or his personality.

Currently, a lot of people feel very strongly about what's happening in Nigeria. I believe that Jonathan's supporters, paid and unpaid, should also for the fear of God show remorse, introspection and patriotism rather than continue to bury their heads in the sand.

I'm not ready for any rubbish ping pong on this matter that's so clear to every reasonable person that's acting reasonably.

You still want Obasanjo to provide more evidence on the one term, his previous letters, water project for Port Harcourt, polarization of the country along ethnic and religious lines, insecurity, division of the Governors' Forum, Buruji Kashamu, politicization of the Police, inability to tame corruption, Bola Tinubu's visit to Jonathan, heavy oil theft, support for non-PDP candidates, kidnapping and armed robbery, increasing unemployment, threat of war by ethnic champions, the Olokola and Brass LNG, withholding of investment by IOCs, allegation of $7b, etc
Did you read the letter at all?

Some of the issues that Obasanjo was cautious to talk about are training of snipers, people under political watch list, etc.

Short of telling him to come and run the government, Obasanjo has done his bit. The ball is now in Jonathan's court.

As a piece of advice, these are testy times for the Presidency. It is better to keep quiet than come up with some watery, silly and hollow responses to Obasanjo's letter.

So far, some of the inane and foolish responses to the letter have come from Reuben Abati, Tukur and APGA.

Ignore the letter if you've got nothing of value to say.

The man was specific in many parts of his letter. He cited instances and named names. Then all some people can do is to call him names and abuse him. I don't know what God put inside the heads of some people!

Those claiming that the state Judiciary is 'independent' say so because it's convenient.

The Senate is 'independent' but we have seen the way they have handled Stella Oduah's saga.

This same people say that Obasanjo rigged elections even though INEC under Obasanjo was 'independent'.

This same people say that Jonathan permits free and fair elections even though INEC under Jonathan is still 'independent'.

A court also declared that the House of Reps cannot take over the functions of the Rivers State House of Assembly. As soon as the 'independent' court's judgement was delivered, an 'independent' Police Force, shooting tear gas and live bullets, prevented pro-Amaechi lawmakers from reconvening but sneaked in the anti-Amaechi lawmakers. That is also another manifestation of 'independence'.

In other words, being 'independent' depends on who is using it.

On paper, the three arms in 'independent' but those who know the practical workings in the corridors of power (like Obasanjo who also accused Jonathan of the same thing) know that it's all a charade.

4. If the commander in chief of the Nigerian armed forces and also the chief law enforcement officer of Nigeria can pardon ex convicts and international fugitive still wanted abroad, so why shouldn't the courts or any other entity in Nigeria replicate the President's action?

It's all about the tone set by the commander in chief and the corrupt atmosphere he created and operating in.

I have highlighted what I think are the critical parts of your post. I do understand your valid point.

But you see, the point you're making flies over the head of the rancorous group that is yelling all over the thread.

Whether or not he is the one behind all these quashing and clearing, they are happening during his time as the number one citizen and leader of the country. This says a lot.

Tolexander: Definitely, if James Onanefe Ibori was convicted here and sentenced in Nigeria, the conviction would also be quashed.

Different ways to make the convicts relevant for the 2015 general election from pardoning a criminal to discharging and acquitting after sentencing to death and now quashing of conviction.

It is curious that the 'quashing' Court says contract-splitting is 'unknown to law'.

See excerpts from the Public Procurement Act 2007:


Fundamental Principles Section 16(4).
37. The appropriate methods, procedures and contract award for public procurement of goods and works shall be subject to the prior review thresholds as may be set from time to time by the BPP.

38. Value for money obtained through efficiency, fair access to bids and transparency, shall remain the main objective of the Procuring Entity.

39. Contracts shall not be split into smaller units in order to avoid competitive bidding or be distributed among various lots to different bidders to enlarge bidder participation at the cost of lesser economy and efficiency.


I thought it was an exaggeration when it was said that it is somebody's destiny to bankrupt Nigeria.

A panel of judges headed by a controversial judge, John Afolabi Fabiyi JSC, ruled that the charges of "contract splitting" upon which Mr. George was convicted is unknown to law.

The pattern of today's[b] quashing[/b] of George's conviction was similar to that of a Lagos Court of Appeal ruling which similarly quashed a death sentence conviction of Major Hamza Al Mustapha's for the murder of Alhaja Kudirat Abiola in 1994. In Lagos, a panel of Court of Appeal cleared former Chief Security Officer of late maximum dictator, Sanni Abacha Mustapha of murder charges under controversial circumstances. Al Mustapha later wrote a letter thanking President Jonathan for arranging his judicial pardon.

Al Mustapha case was handled by the same lawyer, former president of the Nigeria Bar Association , Joseph B Daudu was Al Mustapha's lawyer in the Lagos case. Mr. Daudu, a senior advocate of Nigeria, also played a lead role in securing Mr. George's freedom today.

Since leaving prison a few years ago, Mr. George had been closely linked to President Jonathan, even sometimes openly bragging that his conviction will be upturned.


This is the season of quashing and clearing.

The report did not mention the quashing of Alamieyeseigha's conviction. Never in the annals of Nigeria's democracy have more convictions been quashed and individuals cleared than now.

More and more convictions are being quashed and cleared under the corruption-friendly administration of the Chief Quasher himself, Conviction Clearer Quashluck JonaClear.

Nigeria may be on the brink of being quashed and cleared!
