Sale of assets: Ribadu lied – EFCC

The Economic and Financial Crimes Commission (EFCC) has described a statement by its former Chairman, Mallam Nuhu Ribadu, on the disposal of assets of convicted persons as insincere and fraudulent. While reacting to a statement by Ribadu through his lawyer, Charles Musa, the anti-graft agency, in its statement signed by its media spokesman, Femi Babafemi, said Musa lied when he said the present Chairman, Farida Waziri, supervised the sale of the assets while Ribadu only investigated and prosecuted the convicts.

“In a reaction to claims by Charles Musa, who is a lawyer to Ribadu, that the present EFCC Chairman, Mrs. Farida Waziri, supervised the sale of the assets of former Bayelsa State governor, DSP Alamieyeseigha, and those of Emmanuel Nwude, the commission said the lawyer was being economical with the truth.

“It is obvious that Musa lied in his statement when he claimed that Ribadu only investigated and prosecuted Alamieyeseigha and Nwude’s matters while Waziri sold their assets.

“The question then is, was Waziri the EFCC chairman in 2006 when Alamieyeseigha and Nwude’s assets were sold in breach of EFCC Establishment Act and Extant Financial Regulations or was it Waziri that supervised how the proceeds were diverted then? Was Waziri the EFCC chairman in 2006 when all of Alamieyeseigha’s property in Port Harcourt and Abuja were sold to the same person under the guise of two different legal non- entities?” the anti-graft commission asked.

According to its statement, the EFCC said though it was not aware of how the report being disputed by Musa got to the media, it confirmed that some of the facts in the media reports were part of the findings of a committee which had in 2009 worked on the disposal of assets of convicted persons.

According to the statement, Waziri had on assumption of office in June 2008 invited Ribadu to come and provide information on case files and assets of convicted persons whose lawyers had written petitions alleging shady deals in the sale of their property since there was no proper handing over but Ribadu took the commission to court.

Subsequently, the statement said a committee was formed to ascertain the entirety of assets seized by the commission from inception to date, among others.
“The committee later turned in a report which raised mind bogging observations on the sale of Alamieyeseigha, Nwude and Tafa Balogun’s assets.

“Musa may still need to tell Nigerians and, indeed, the world why his statement failed to explain the sale of Tafa Balogun’s property. Could it be because there was no reason to attribute that to Waziri or because he was scared of mentioning that out of nine companies that bought the property, six of them are fake companies?
“He needs another statement to explain the individuals behind these ghost companies and why the bulk of the houses were sold to them at ridiculously cheap prices. Or could it also be because he was scared of letting the public know that the property were sold at rates below the value of the land they were built on because the same person was the valuer, seller and cashier?
“If Musa has started shifting blame at this point, what will he do if he sees the entire report of the committee? We like to remind Musa that these are atrocities that are better defended before a competent court of law rather than an attempt to blackmail in the media,” EFCC said.

Intense pressure mounted on senators by Senate President David Mark and the other Senate leaders yesterday saved Professor Dora Akunyili from rejection at the ministerial confirmation hearings, according to a senator who spoke to Daily Trust last night. Mark himself acted due to pressure from the Presidency, which said Akunyili’s rejection by the Senate would be a humiliation for the Acting President. Prior to the intervention, he said, Akunyili was well on her way to be voted out.

Chairman of the Senate Committee on Information and Media, Senator Ayogu Eze also had an explanation yesterday for the widespread but ultimately incorrect media reports that Dr. Shamsudeen Usman had been dropped from the ministerial list. Briefing newsmen shortly after the confirmation exercise, Eze said the media reports were “as a result of conflicting signals from the Executive.” It was learnt that the Senate President’s skipping of Dr. Usman’s name from the line-up of ministerial nominees who were screened on Tuesday was actually at the President’s request. Jonathan had wanted to replace Usman with former Kano State deputy governor Dr. Abdullahi Umar Ganduje at the insistence of former state governor and PDP chieftain Dr. Rabiu Musa Kwankwaso. Usman however survived the affair through the night.

Explaining Akunyili’s narrow escape to Daily Trust, the senate source said, “When we came to the chamber in the morning, the leadership mounted serious pressure on us that we should confirm her. Even some of those that were seen to be against her called on us to support her confirmation. Honestly I didn’t understand the rationale behind it but you see, this is parliament and in parliament we all do lobby for one thing or the other and if you refuse to support your colleague in his time of need, you too might come with your own in the future. The parliament is a place for compromise, lobbying and concession.”

Soon after Mrs. Akunyili encountered withering fire during her appearance before the Senate on Monday, Deputy Senate President Ike Ekweremadu summoned a meeting of South Eastern senators, who resolved to do all they could for her. The senator said, “You know they (South Eastern Senators) were even the ones that had issues with her nomination. They decided to forgive her of every wrong she must have done them. The National Interest Group (NIG) also played a role since they are the ones that had been meeting with the ministers. They see her as one of their own.”

Atiku's return to PDP should be deeply examined. Dont forget he is a protege of the late Shehu Musa Yaradua, and led the PDM (the Yaradua's political machine's party) that eventually formed the PDP and practically drew OBJ out of oblivion. In the same scenario, we also have Shehu Musa Yaradua's son in the Federal cabinet. And Umaru Musa Yaradua is still President, albeit an inactive one. The only part of the Yaradua clan that is presently losing out is Turai's crew of usurpers, and they were never a part of the original strategy anyway. It seems the true Yaradua political machine is slowly consolidating. Very interesting. I hope GJ is not boxing himself in a corner. It will also be interesting to study el-Rufai's reaction to his former master's return to party relevance. Atiku exhumed el-Rufai from his bleak Quantity Surveyor existence and made him a political force only for the latter to turn and rub salt in his face because OBJ promised him Presidency.

As far I could tell, what happened between Kanti Bello and Dora was some personal Poo that was aired in public. They are both obviously part of the Yar'Adua kitchen and he's pissed that she could be so brazen in her betrayal. It must have been a very cosy cabal for him to have been so miffed by her action - the guy almost passed out! And did you notice how uncomfortable Dora was when he stood up to question her? Only God knows what Kanti was doing for Yar'Adua while Dora was cooking for Turai!

By the way she has not been confirmed Minister. The Senate still has to vote during 'consideration'. What we saw was the 'screening'. I believe David Mark made that abundantly clear during Dora's questioning.

In August, the EFCC had obtained a court order to temporarily freeze N104 million she had allegedly tried to launder through one Mrs. Nancy Ebere Nwosu. The EFCC said it had reason to believe the seized funds belonged to the public. In a sworn statement, Mrs. Nwosu implicated Patience Jonathan, the EFCC said.

But what I'm even reading into this whole thing is that GJ is starting to use Farida the way OBJ used Nuhu Ribadu just before elections - to deal with perceived enemies. Only that OBJ was never indicted by the same EFCC. But what the heck, Senate just amended the Constitution to allow 'indicted' Nigerians to run for office. Eyes open people! Blink and you'll miss it!

The funding is not coming from the Saudi Govt but from super rich individuals funding these charities. Unfortunately, a large number of them are fundamentalists who believe that they will secure grace and a place in paradise by propagating their own brand of religion – wahabism, the most intolerant brand of Islam. They used to sponsor preachers to various Countries to teach that brand of Islam but now they also fund weapons and violence. Sadly, this has been going on since the early eighties, with a substantial number of these missionary preachers found their way to Northern Nigeria, that’s why the hausa muslim is less tolerant than his Yoruba counterpart. Most rich religious ppl donate money to missions to fund the propagation of their own brand of religion, its just the vast resources involved that made this one what it has become – were talking hundreds of thousands of filthy rich oil sheikhs!

The Saudi Govt has recognized this and has taken very strong measures to counter the trend because terrorism has come to bite them in the a.s.s. The govt now sponsors preachers of a tolerant islam abroad + other measures, pls google, the info is out there

As for your conspiracy theory on Jos, terrorism is a multi-million dollar business. Wherever they strike, you can be sure there’s much at stake. You tell by the quality of weapons or, where they use basic stuff, the deadly simplicity of execution. I doubt if Jos was on their mind.

Within hours after the Court of Appeal, Enugu Division threw Mrs. Joy Emodi out of the Senate, several senators commenced a campaign for Acting President Goodluck Jonathan to nominate her as a minister to replace the controversial former Minister of Information and Communication Prof. Dora Akunyili, who is one of the nine former ministers already nominated for reappointment. Emodi, like Akunyili, is from Anambra State.

The Court of Appeal had ruled yesterday that Mrs. Joy Emodi, who is a Peoples Democratic Party (PDP) member, was not the Senator duly-elected to represent Anambra North senatorial district. The Court, led by Justice Ola Kayode Ariwola, unanimously ruled that Mr. Alphonsus Uba Igbeke of the All Nigeria Peoples Party (ANPP) was the authentic winner of the seat in the April 28, 2007 election.

A reliable source at the Senate told Daily Trust that many senators are determined that Mrs. Akunyili will not return to the Federal Executive Council. They said the Acting President should either drop her nomination or they will ensure that she fails at the Senate screening. As soon as Emodi lost her Senate seat yesterday, they cashed in on it and proposed her as a replacement.

The Election Petition tribunal had earlier returned Emodi as winner of the 2007 election, but Igbeke appealed the ruling on the grounds that she was not duly elected by a majority of lawful votes cast at the election and that her return was invalid by reason of substantial non-compliance with the Electoral Act, 2006. He said he polled the majority of lawful votes cast at the election and ought to have been declared winner of the election.

He said there was no election in all the polling units/booths in Onitsha South and Ayamelum local government areas of Anambra North Senatorial District on April 28, 2007 and that all the votes credited to all the candidates at the polling units in both Onitsha South and Ayamelum LGAs be set aside and nullified.

According to him, election held in only five out of seven LGAs of Anambra East, Anambra West, Ogbaru, Onitsha North and Oyi LGAs of Anambra North Senatorial District but the electoral body did not collate the results of all the wards and LGA collation centres but proceeded to award arbitrary figures to the candidates not related to the votes cast at the election as declared by the Presiding Officers, and that they went ahead to return Emodi as the winner of the election.

He said that the non-conduct of the election in the two LGAs of Onitsha South and Ayamelum due to non-supply and distribution of election materials in these areas did not materially affect the result of the election, going by the total registered voters.

The Court agreed with him and directed the Independent National Electoral Commission (INEC) to withdraw the Certificate of Return issued to Emodi and return same immediately to Igbeke.

Reacting to the judgment, counsel to Senator Emodi, Hipo Onwuegbuka, said as a lawyer, he accepted the judgment since the Court of Appeal is the final arbiter. Also speaking, counsel to Igbeke, Gozie Obi described the judgment as sound, saying though justice had been done, it took a fairly long time in coming. On his part, Igbeke expressed happiness at the judgment and said it showed that the judiciary is the last hope of the common man.

Speaking to Daily Trust on condition of anonymity last night, a senator said, "Several of us have resolved that Akunyili would not be allowed to return to the cabinet which she helped destabilise by her unguarded utterances before the dissolution of the FEC. We have started working to ensure that she is replaced by Senator Emodi who is also from Anambra state."

The senator said Akunyili's nomination is bound to face stiff opposition due to her comments in the wake of the political logjam caused by the illness of President Umaru Musa Yar'adua.

"She made comments unbecoming of a public officer. If you could remember, she was called to order by several highly placed individuals and institutions in the country, including the House of Representatives. Such a person should not be allowed to return to the cabinet," the senator said.

Daily Trust learnt that the senators have resolved after a meeting to push the proposal forward by convincing Senate President David Mark to support the replacement of Akunyili with Emodi.

The senators, according to our source, have resolved that should their bid for the replacement of Akunyili fail, "We will stand as opposition to her nomination during the screening and we will ensure that she is disqualified."

It was also gathered that lobbying has been intensified by former National Planning Minister Senator Sanusi Daggash to persuade senators to support his confirmation during the screening hearing.

"We have suggested to him (Daggash) that he must try to approach every senator because there is problem. There are senators that are bent on disqualifying him because of the problems he had with the Senate when he was minister. If you observe, his name was even booed by senators when it was announced," a source said.

Prof. Akunyili presented a memo to the last FEC seeking to declare President Umaru Musa Yar'adua incapacitated and she severally accused some of her colleagues of being part of a "cabal" standing between then Vice President Goodluck Jonathan and full presidential powers.

Her comments attracted condemnations from many quarters, including the PDP national leadership, the National Governors Forum and the House of Representatives. She was later sacked when Jonathan dissolved the FEC, only to resurface among the 33 nominees whose names have been sent to the Senate for confirmation, the process for which begins on Monday.

Tension has continued to envelope political circles in the federal capital territory over rumoured attempts by some power brokers to press for the replacement of former Information Minister, Prof. Dora Akunyili, with Mrs. Joy Emordi.

Akunyili was one of the nine cabinet members among the list of 33 fresh ministerial nominees forwarded to the Senate by Acting President Goodluck Jonathan on Tuesday for consideration and clearance.

Emordi’s election was nullified on Thursday by the Court of Appeal sitting in Enugu on the ground that her election into the Senate in 2007 violated the spirit and letter of the Electoral Act 2006.

Before her election was annulled, she represented Anambra North Senatorial District on the platform of the Peoples Democratic Party (PDP).

The appellate court had since directed that Mr. Alphonsus Igbeke of the All Nigeria Peoples Party (ANPP), who challenged Emodi’s election, be sworn in as the duly elected member representing Anambra North in the Senate. Igbeke is expected to be sworn in on Monday in line with the court’s ruling.

Investigation by The Nation at the weekend revealed that some unnamed senators were behind the push for Akunyili’s replacement with Emordi. The two women politicians are from Anambra State.

Many of the senators touted to be arrowheads of the replacement plot would not want to be openly associated with the matter, apparently owing to its sensitive nature.

However, a handful of the senators who commented on the matter yesterday on condition of anonymity said that if the reports were to be true, it would amount to grave injustice against Akunyili.

According to one of them, if effected, the development would portray Jonathan and the leadership of the PDP as unstable and fickle-minded, a development which they said could dent the credibility of the administration.

The senator, who represents one of the states in the north central zone, argued that replacing Akunyili with Emordi less than 72 hours after the latter was sacked from the Senate is capable of deepening public perception of the Acting President as someone that can easily be influenced to take the wrong steps.

Obviously worried by the rumour, the lawmaker stated: "If Jonathan goes ahead to replace Akunyili, then the those who kicked against his emergence as Acting President in the first place would have been vindicated.

"During consultations before we passed the resolution to make him Acting President, a good number of the senators opposed the idea because they argued that the man was not firm enough to be saddled with such responsibilities"

"One of the senators particularly kicked against the idea, saying that going by his antecedents, Jonathan, if made Acting President, would end up being an errand boy to some power brokers whose interests may be at variance with the common good. I hope the Acting President will not, in any way, fit this unenviable bill," the senator said.

Another senator from the south-west could not understand why a section of the political class would want to act in manners as to paint the PDP and its elected leaders as lacking in morals by attempting to reward what the Appeal Court has adjudged electoral robbery.

He asked: "Are these people now saying that it is morally permissible for people to engage in electoral fraud and be compensated when they are sacked by competent courts of law? What moral lesson will Jonathan or the PDP be teaching the Nigerian people if the replacement is effected?"

The lawmaker stated that it would have been understandable if Akunyili’s nomination had not been made public in the first place, stressing that the country cannot play politics of exigency over morality.

"Imagine a situation where the Nigerian people and the entire international community had been informed about someone’s nomination only for the person to be replaced in less than one week by another whose election had been adjudged fraudulent by a court of competent jurisdiction. In what light do they want the world to view the political leadership in Nigeria?" the senator queried.

The senator described as unfounded the reports in some dailies that the Senate would work against Akunyili’s interest if her nomination is not replaced with Emordi’s. The report had insinuated that members of the Senate were not happy with the role she played during her tenure in the last cabinet when she advised ailing President Umaru Yar’ Adua to step down on grounds of ill health.

Rather, the legislator said that Akunyili’s action reflected the position of the majority of the senators and members of the Nigerian public as well; stressing that the transfer of power to Jonathan has justified Akunyili’s position.

Meanwhile, the South East caucus in the Senate is reported to be cautious and will not like to jump into the fray until the signals are clear enough. The caucus, led by Deputy President of the Senate, Ike Ekweremadu, is said to be studying the situation with a view to making its position known at the appropriate time.

In a sharp reaction, the Conference of Nigerian Political Parties, (CNPP) has described the alleged replacement plot as irresponsible, stressing that if it is effected, it would serve as a reward for dishonesty.

Commenting on the issue on yesterday, National Publicity Secretary of the CNPP, Mr. Osita Okechukwu, said that the entire scenario shows desperation on the part of Mrs. Emordi "after reaping bountifully from a stolen mandate for three years".

Okechukwu stated that under normal circumstances, rather than being made a minister, Emodi would have been compelled to refund all the salaries and allowances she collected as a senator on a false mandate for three years.

"I do not know where that story of replacement is coming from and I honestly do not want to believe that it is true. How could someone who had enjoyed a stolen mandate for three years and was refused by the Court of Appeal be dashed a ministerial slot? That is simply not logical and I know that will be a slap on the Jonathan government", Okechukwu told one of our correspondents yesterday in Abuja.

The single most important factor that can make one rich in Nigeria is our population - thats why pure water producers make so much. Half the population gives them at least N1 every day. But we cant see it! Foreigners are coming to take advantage of our population before our eyes:

Dana Group - indians - Plastics, IV drip for hospitals, drugs, drinking water and a host of other products for the masses
Chi - indonesian - chivita juice, hollandia milk, custard, yoghurt, drinking water
Stallion group - indians - rice, cars (every bank buys from honda place)
De United - Indonesian - INDOMIE

And most of us are still running from pillar to post acquiring useless certificates looking for who will make us their servants. At least the Taxi drivers are doing something with their driving skills and enjoying the fruits of their labour instantly. They're not waiting for pension or gratuity or for the NSE shares they bought with their 'bonus' to rise! And they sure as hell don't live on credit.

If history is anything to go by, then Jonathan lost the presidency the day he desired it. The seat of the President of the Federal Republic of Nigeria belongs to the Dark Horse - and he always emerges at the last minute. EVERYONE who has ever 'expressed interest' in ruling Nigeria is either dead or cursed and consumed with the desire to rule. Even OBJ didn't want it when he was 'selected' in 1999, and he failed woefully in his infamous Third Term bid. Zik, Murtala, Gowon, Obj of '7?, Shagari, Ibb of '86, Buhari of '83, Shonekan, not sure about Abacha' story (hints anyone?), Abdulsalam, OBJ of '99, UMYA, 2011?

Then check out Shehu Yar'Adua, MKO Abiola, Buhari of today, IBB of today, OBJ of today, and a host of others living with the all-consuming cancer of 'One day, I will be King (again)'. They just cant stop themselves and will poison and destroy everything in their path - slowly but surely. Most of them are hiding under the cloak of 'Kingmaker' but their evil desires still shine through.

I find it odd that Jo will surround himself with these same sharks who can barely conceal their hunger for the Presidency: Aliyu Gusau, T.Y. Danjuma, IBB, OBJ. These same guys have made some very memorable DESPERATE moves to 'reign' or 'reign forever'. And he's even letting them select cabinet members for him!

Come 2011, the desperate moves will again be deadlocked and we will have another 'Dark Horse'!

You are coming home to visit your family for Xmas from 23rd Dec to 5th Jan - N200k is enough - its home after all, abi? Free house, free car, free food! Your family will be glad to see you, and if they get too demanding you can always take back a list of their wishes and promise to sort them 'later'. It'll probably be another couple of years before you show face again - you'll know how to deal with it.

If you're coming for a shopping spree like most Nigerians at home do when they travel abroad for holidays, then N200k is nothing. If you are coming to show off, then definitely not in any of the big cities. Its up to you - what are you coming for? and most important, what impression have you already created?

I find it vey amusing that Diaspoorans believe the boys at home are waiting to 'leech' every guy that lands from jand or yankee. You guys need to realise that it is when you try to form that people at home get sharp and 'deal' with you.

The average Nigerian will not even contemplate a four week holiday abroad with just N200k cheesy
