This depends on the citizenship laws for the country eg for most countries including the UK at least one of the parents must be a citizen or LPR hence if none of those apply the child will not be a citizen of the UK. The child will take the citizenship of the parent by default. If the baby was born in US airspace where jus Solis rules then yes the child will be a US citizen because the US grants citizenship to anyone born within it's territory. Beautyaddy: |
At bolded not necessarily. Yes the child will be registered in the UK but that does not mean the child will be a UK citizen. The child will only be a citizen if at least one of the parent is a citizen or LPR. If none of the parents are either a citizen or LPR then the child takes the citizenship of it's parents which in our case would be Nigeria The registration will simply state UK as country of birth but not citizenship. Being born on a plane above UK airspace does not give special priviledges over those born on the ground in the UK. Regarding your story about NY and Massachusetts it's not possible as citizenship is a federal issue not state so there is no way the baby can be a citizen of Massachusetts or NY, the baby is a citizen of the US. If you do your research the 14th amendment was passed after 13th amendment which freed slaves to ensure children of slaves were not denied citizenship. It was not passed for birth tourism or for people to just fly in and have their babies. You are right he cannot change the constitution without Congress, but the Supreme Court can make a law based on interpretation. Same as DACA which was signed by Obama, the new executive order will be taken to court and Trump is hoping it is forced through to the Supreme Court which is now conservative leaning thanks to Kavanagh. If the Supreme Court rules that the 14th amendment does not cover illegal immigrants then tat becomes law and does not need congress. Also to correct you, an amendment needs either congress or 2/3 of the 50 states not both. The bolded will be the bone of contention for the Supreme Court. Bro think of it, this has been an ongoing issue for years and if you look at the hostory of the 14th ammendment on which this is based, the objective was to ensure children of freed slaves were citizens as some states still tried to restrict them. It has now been used as a loophole for people to fly into the US to have babies and by illegals. The UK stopped it in the 70s or 80s because of the birth tourism abuse and most of Europe Australia etc also stopped it. There's a massive industry of agebta who specialize in birth tourism especially for the Chinese. We know Nigerians we do it as well and it also encourages illegal immigration from South and Central America as if they enter and have a child it makes it difficult to enforce laws given you can't deport the US citizen child and the parents are illegal.
