From a legal perspective- the sale was shady - and a lot could have been done to make sure that the sale yielded positive results.

Secondly- your analogy of my dad’s old car begs the question; if I sold off my dad’s old car... shouldn’t I pay off the driver and mechanic who maintained the car initially, failing which I use the proceeds to pay them off?

If your ur dad or mum was part of those who had to wait years to get paid what they worked their hearts out for - I m sure you won’t defend those thieves.

Emmanuel Macron wasn’t a governor in France before he was elected president... I just detest having to recycle same old guys who made a mess of Nigeria’s commonwealth. Even Obasanjo attested to Atiku’s corruption.

When the government announced payment of Nigerian airways pensioners September last year, we were all very happy and relieved as their last payment was over 10years ago. Verifications started in October and my father finished his on the 24th of October, credit alerts started coming in in November but my father never got any. In December he got less than a 100K which was his supplementary payment and till now, his main money hasn't come in. He has called and visited their offices plenty times and it has been one thing or the other. They did say it wasn't a verification issue though.

After weeks of back and forth, he had to go to Abuja two days ago, please note that we live in Lagos and this is an elderly man. With no real reason, it now seems like some people have messed with the money and hope that he gets tired and gives up. He is not the only one affected, from what i heard they are about a hundred and some have gotten tired and resigned themselves to fate, these people are old people that have worked for this money, it is bad enough that the payment took over ten years to be paid, now imagine your colleagues spending their money while you look on

He is still in Abuja and making no head way, this isn't right, we do not know what to do again

Those are one of the many failures of Atiku.

He sold NEPA, Nitel, and Nigerian Airways... and they failed to pay the pension of many of these folks.

He has vowed to sell NNPC too.

I am surprised lots of Nigerians are even considering voting in this guy.

All Nigerian Airways staffs were rendered jobless. More than 75% of Nepa staffs were retrenched. Same goes for Nitel.

You may be really young at the time - which may be the reason you are ill-informed.

Trials are protracted for many reasons outside of the courts’ own doing.

1. Technicalities: Defence lawyer can sometimes drag cases in order to generate more appearance/representation bills...
2. Loads of Interlocutory applications, which needs to be resolved as the trial goes on
3. Evidence: e.g. witnesses may fail to testify for fear of reprisal attacks on their family- and you need to get new witnesses
4. Multi-party trials - as in this case... up to 6 different accused - each defendant has to be given a fear hearing.

Loads of reasons. But this does not mean the judicial system is itself perfect. The whole point is that non-lawyers do not have an idea what it takes to get just one case to close! And imagine how many such cases end up in the HC daily.

I checked out the news last night on BBC bro...

Yes - apparently the contract was already concluded - and the documentation complete. I am surprised Cardiff hasn’t even paid any part of the money at all - which became due after 7 days of completion of the contract.

I read they were suing for the first payment - and according to the concract / the payment is spread over 3 years.

I am afraid Nantes is entitled to enforcement of the terms of the contract as it appears it was all concluded before the players demise. The court cannot invoke Frustration due to doctrine of sanctity of contract. Frustration only applies if there is a pending obligation; from either party, and the contract is either silent or imposed an onerous term in the event of such occurring.

The only issue now is Insurance. Cardiff must honour the terms of the contract, and the insurance company will have to bear the cost for repayment. I also read Bordeaux has a 50% stake on the player’s purchase price oweing to a clause in his contract of sale from Bordeaux to Nantes.

But between me and you: if I was representing Cardiff I will have a sit down with Nantes’ lawyers and Bordeax’ - on the possibility of a reduced payment. The only thing is that it will be at the discretion of both parties to agree to a reduced price.

You should please ask Buhari to prosecute Ganduje before you come back to talk to me. After all he is also another glaring corrupt public servant.

Well, it's not new, even Evans the kidnapper have a lawyer that represents him.
The law is sacred... there is a presumption of innocence, until proven guilty in a competent court of law; even where he has admitted to guilt - he still deserves a fair representation (S. 36 of the CFRN).

This is even More so where the CJN - The Most Senior Judicial Officer in the Land, is involved.

Lawyers need to protect their profession from a tyrannical president. If this was left to fly - it will create a bad precedent - that future presidents can, at their will, remove Judicial Officers without recourse to due process.

One thing the public fails to note about these suits is that they do not bother on the substance of the allegations - they are just about due process and constitutionality of the suspension.

Buhari is just another dictator - in a sane country he won’t even be considered by a political party let alone the presidency.

The CJN has clearly committed a crime: to which he already admits. I imagine he doesn’t want to be prosecuted for it... which is typical of most high ranking public officials. But as the head of the Nigerian Judiciary - he has a higher burden - and I believe he should be prosecuted and made an example to others.

My only reservation is the manner in which the president has gone about it. With the level of public outcry - it could still have achieved the same end if he had gone through the NJC before the CCT.

The constitution is the grundnorm and he has just set a bad precedent - that future leaders can disregard the clear content of the constitution as long as they achieve their aim.

The CCT cannot give a Order for the president to suspend a CJN.

At best - it could have just ordered the CJN to step aside from his position pending the conclusion of his trial. If the CJN then refused - the whole shame will be on him - which will tarnish his imagine and reputation.

In the judgement of justice Onnoghen in 2012, the CCT has exclusive jurisdiction to try code of conduct violations, and the CCT also has powers to mete out punishments to violators.
It is still an inferior court of record. They enjoy exclusive jurisdiction - means - they are the only court that can hear the matter at First Instance.

but this does not mean they are not subject to the higher courts - in respect of Court Jurisdiction. In a sane country - where the legal system functions properly - if a higher court grants a stay of proceedings on a lower court - It Stays!

It’s a ritual - it’s just the same way a commander can ask his subordinates to keep matching against the wail - you don’t question it no matter how absurd.

So any refusal from the CCT to honour orders from the CoA is a slap on our Judicial system and to the Nigerian constitution which gives authority to the hierarchy of courts.

I think it will be naive to say that there are no spiritual husbands/wives.

You are right to hold on to the belief - that once saved - we are free indeed from such entanglement. Buh somehow I think - the believer has to come to that knowledge. Plus, somehow, the salvation of most Christians is not genuine.

Because you still see many Christians who are oppressed by the devil.

So for me - being saved is one part, understanding and living in that reality is another thing entirely. Even angels fall out of grace.

Since they initiated the purchase of the player and most likely hired the aircraft which ferried him to Wales for the signing.

I am not particularly familiar with the facts of this case.

But if, like you mentioned,
1. They initiated the contract, and
2. Contracted the ferrie which occasioned his death;

they still have a good case.

Many times - terms of the contract will contain the conditions for performance and how Any dispute will be resolved - if one comes up before performance.

But - assuming there here are no such provisions in their contract... the general principles of contact law will apply. I would imagine some amount must have been paid upfront. Contracts have been signed - and may be the final payment is tied to some final obligations from Nantes (e.g transfer of insurance policies, documents, etc.).

Where the above applies - and the player - WHO IS THE SUBJECT OF THE CONTRACT - is now dead? then performance of contract is not yet concluded - frustration will apply. This text explains it better;

The Restatement (Second) of Contracts, Section 265, defines frustration of purpose:

Where, after a contract is made, a party's principal purpose is substantially frustrated without his fault by the occurrence of an event the non-occurrence of which was a basic assumption on which the contract was made, his remaining duties to render performance are discharged, unless the language or circumstances [of the contract] indicate the contrary.

Now it is not an argument that the ferrie which killed the player was contracted by Cardiff - the flight was not within their reasonable control; if anything, Cardiff can bear some financial liability (and compensate Nantes - but not for the full balance for the player) - and Cardiff can in-turn pursue the ferrie company to recover their expenses.

I imagine that’s how it will play out if it goes to court. Buh the UK are quite good with out of court settlements/arbitration: especially to respect the dead player.

It all depends on the terms of the contract - and the law that is stated to apply where a dispute arises. There is a doctrine in English Contract law - doctrine of frustration. It allows the contract to be set aside where performance of an obligation by either party is impossible.

“Frustration is an English contract law doctrine that acts as a device to set aside contracts where an unforeseen event either renders contractual obligations impossible, or radically changes the party's principal purpose for entering into the contract”

It’s simple - they can try to settle amicably and reduce the amount obligated to be paid for the player - which I imagine will Be done in this case. Buh if they proceed to court Cardiff would most likely win the case. Insurance issues comes in as well.

This man is ageing real fast. If you ask me, I think he is the most hardworking VP we ever had.

Plus, his combination with Buhari is enviable - to think that they are so different in religion and ethnicity- and yet they work so perfectly together, regardless of their differences, speaks volumes about their character.

If Nigerians are wise - they will vote in the best man; and to be honest neither Atiku nor Buhari have the requisite credentials to lead a Modern Nigeria. It doesn’t matter if the man you chose wins - at least, you Can be happy you chose what’s best for your children.
