The opposition of Saraki and co who kept delaying budget passage till Q3 over disagreements arising from their insistence on inserting flimsy constituency projects, I doubt if that could really be termed 'healthy opposition'. Yes - there is nothing wrong with that. And by all means that is how it’s meant to be. The UK has been on Brexit negotiations for 2 years now - largely because of the opposition; and it’s because the parliament believes that deal does not favour its citizens. I am not saying the UK is perfect- I am only saying that a functional government is not propelled by Godfatherism and loyalty between the law makers and executives who are supposed to check on each other. The problem with this current structure is the loyalty. All the Legislatures came in to power because the Executive president stepped in to ensure they did. Gojes EFCC case was taken over so he could step down for Lawan. Same with Omo-Agege. APC also run th leadership of the lower house - all loyal to Buhari and Tinubu. I don’t imagine they will oppose anything brought before them. Let’s see how it goes. |

Member Bills - so here anyone that is a member of the HoR or Senate can introduce a Bill in their respective houses. 2. Executive Bills - these are Bills that originate from the executive arm of the govt - e.g a minister or even the president. 3. Private Bills - these are Bills introduced by any other person; like you and I. However, A bill can be initiated by anybody but only a Member of the House or a Senator can introduce it on the floor of the House or the Senate. So no matter it’s origin - it can only be sponsored in the NA by a Member. And all bills must be approved by both houses before it goes to the President for Assent. Hope that helps |

That body is responsible for the tutelage of All Lawyers in Nigeria. The Bar finals is such a big deal for law students - you should ask around if you have friends studying law. It has a direct effect on your life - lawyers mostly go on to become your law makers, governors, VPs, solicitors - if you are privileged to buy a house, or a car or sign a contract, they would make this happen for you. They are also your advocate when you are involved in any legal tussle. I think it’s in your best interest they receive the right tutelage. |

Well, in a criminal trial the prosecution needs to prove men's rea and actus reus. Men's rea means criminal intent and actus reus means the act.
Ironically, the criminal intent is more important than the act in prosecution because a "child" and "lunatic" who commit the most gruesome crime would not be convicted because of the assumption of the law that they lack criminal intent.
Furthermore, in law intent can be implied through repeated acts that show intention to commit the crime. From the charge sheet, he has received more than 8 bank cards. If you receive one, an emotional person may call it a mistake, you receive 2, we can argue that it is an accident but receiving up to 8 credit cards when you are not a bank itself is enough to prove mens rea.
Also, the way the card details were received can prove mens rea. The legal questions would be were they received in good faith or fraudulently? Intent helps the court decide on a fair judgment.
When someone is caught with drugs, two intents can be established:
1. For personal use 2. To trade.
If an intent for personal use is established in court, the offense is ruled a misdemeanor and the sentence would be mild.
If the intent for trade is established, the offense is ruled a felony and the sentence would be relatively heavy. I wish they could be guided by your comments. |
