For seemingly the umpteenth time…
The relevant legal issues in this case was NOT the issue of consent.

The offense of trafficking in human organs is a “strict liability” offense in the UK…
So long as the prosecution can show FINANCIAL INDUCEMENT, all these other side issues are legally irrelevant.

How is a 21 year old man referred to as a boy?
The wicked 21 year old man will die shamefully for lying against a man whose only crime was that he wanted to save the life of his ailing daughter.
Nope, Ekweremadu “only crime” was NOT that he wanted to save the life of his ailing daughter (I think most people can EMPATHIZE with that), but rather that he tried effectively to BUY “human spare parts” and put the life of someone else’s son in mortal danger.

Take advantage of the boy?? The boy took advantage of a sane environment. But I think it’s just terrible to cheer the family’s misfortune. The family could have erred, and their inactions or refusal to use their influence in the past, may have cost lives, that they should deserve our utter contempt- but we shouldn’t mock them nonetheless.

Of coz, they are likely to understate the consequences when discussing with him, but let us assume they didn’t and instead, they explained to the boy very well, what the long-term effects could be.

Of coz, there shouldn’t have been any monetary incentive, but I think many would be willing to support such a request, with cash or other supporting incentives. (A crime ??)

Let us assume, the family that needs a donor thought so too.
For the donor, could the monetary or other incentive be more propelling or compelling at the onset? Let us assume it was.

His kidney was going to be yanked, he wouldn’t give that without a promise for exchange of another reward. Let us assume the boy was naïve, and he was underpriced.

If he wasn’t underpriced, and the supposed donor wasn’t short on intelligence. Could the donor experience decisional regret? Of coz he could. In fact, recent studies on decisional regret among donors, indicate that younger age and lower education are predictors of regret.
So regret was an item and when it was time for the procedure, it became more stark. So stark, that the ‘affective’ theatrics couldn’t help; of coz, he knew that it was only because of the transplant, that anyone cared. Such reflection on the expectation of care can be sufficient to create an utter dissonance and complete turnabout.

After this, the Ekweremadu’s probably couldn’t keep him any longer, the promises of reward or the reward given were withdrawn; he is to return to wherever or whatever condition he was from, with his kidney. They were probably others as well, putting pressure on him, invested in all of it, with a rebuke for the boy.

So, what could he have done? Now, we know he is not likely returning to that condition he came from and he’s still got his kidney. In a year or two, his family would be with him in the UK.

Was Ekweremadu naïve and exploitative? Perhaps. Was he an organ trafficker? Then, he must be foolish as well to have decided to have the transplant in a standard hospital in the UK, and not in Iran or some shady place, where the donor’s consent is not required.
The offense of trafficking in human organs is a “strict liability” offense in the UK.
So long as the prosecution can show FINANCIAL INDUCEMENT, all these other side issues are legally irrelevant.

The Ekweremadus’ case is PRECISELY why these laws were enacted - to prevent using the poor as “human spare parts”.
There’s a reason why they picked a poor street trader who’s a stranger, rather than a family member (extended or immediate).

PS: Btw, do people actually realize that many donors need lifetime healthcare?!

Then what judgement was passed against david for telling police that he was 15...until details of his passport and bvn proved otherwise...no judgement for that ?

He gave false information during investigation...

So giving false information during investigation is not an offence in UK?
NO legal offense arises (or attaches) simply for lying to the police….
Unless a person lies under oath (perjury) or is actively OBSTRUCTING justice!

FxMasterz:
You're right. But I think by putting him in the Victim position as a result of the inducement, they overlooked the crime. Moreso, no one pressed charges against him for this. It would have been the responsibly of Ekweremadu's lawyers to bring it to the attention of the court.
The Ekweremadus’ lawyers raised it, but the judge RIGHTFULLY discounted it…
The allegation against the Ekweremadus was LEGALLY PROVEN by financial records, and not by the dude’s testimony.

The offense of trafficking in human organs is a “strict liability” offense in the UK…
So long as the prosecution can show FINANCIAL INDUCEMENT, all these other side issues are legally irrelevant.

But the boy was not kidnapped or coerced to donate his kidney, he offered to. He was the one willing to sell his kidney to highest bidder so why make him a victim? Ekweremadu is a corrupt politician that deserves to be flung in jail for stealing but that boy is no victim! He agreed to it, he's not underaged neither is he mentally unfit to decide on his own. I hope the UK authorities deports his snaky ass.
On the contrary, the UK authorities are protecting him in the UK…
Because they realize he could be harmed if he returned to Nigeria (where the lives of regular CITIZENS means nothing)!

In a case involving Nigerian CITIZENS on both sides - one as an alleged perpetrator and the other as alleged victim - the Nigerian government deployed resources and employed the instrumentalities of the state ENTIRELY AND SOLELY ON ONE SIDE ONLY, with the Nigerian courts, the Immigration Service, NIMC, the Attorney General’s Office, the Nigerian High Commission, etc., each of working expeditiously to, among other things, provide consular and legal assistance to Senator Ekweremadu and his family and to place in the public domain, private and biometric information about the alleged victim, capped by a delegation of Nigerian senators reportedly flying over the UK (almost certainly on Nigerian taxpayers’ funds) to provide “comfort” and “assistance” to Senator Ekweremadu.

A CIVILIZED society is characterized by how it treats the weakest among its population.
Conversely, in BACKWARD nations like Nigeria, some citizens are officially deemed more WORTHY than other CITIZENS.[/b]

Because in the UK and all CIVILIZED nations, it’s illegal to buy and sell human organs…

The economic reality of life is that if allowed, poorer people will simply become “human spare parts” for rich folks…
In CIVILIZED nations (which, by definition, perhaps excludes Nigeria) there’s belief and PRACTICE that all human lives are EQUAL!

The just concluded general elections have exposed the ignorance of "exposed" Nigerians regarding the organisation of society.

The law abhors vacuum. The constitution prohibits a leadership lacuna.

The position of the law is that a candidate who is declared elected by INEC is constitutionally qualified to occupy the office he was elected into until a court of competent jurisdiction declares otherwise.

The timeline set by the law for determination of election petition by the election tribunal is 180 days from the date of filing the petition.

The court has to carefully scrutinize the prayers of the parties and avoid reaching a decision per incuriam . The Labour Party, the PDP and their candidates filed their respective petitions on the last day of the 21 days stipulated by law to avoid mistakes. They made use of their complete 21 days to avoid rush and to present well researched and compelling arguments.

The Tribunal is obliged to deliver judgment after it carefully exhausts its 180 days to avoid error. Don't pressure the court!
Not even remotely the point… embarassed

What the Rev said was that election petitions should be concluded prior to any officeholder being sworn-in…
It’s not rocket science, and frankly it’s something that other nations (even fellow African nations like Kenya, Ghana, etc.) do!

Instead of discussing SUBSTANCE, Kayemo launches into an ad hominem attack…
Such quick trigger resort to personal attacks merely betrays the lack of a substantive argument or a CRUDE family upbringing!

Ask these people supporting this crap here who are the other occupants of the other Landcruiser and Lexus SUVs in a Nigerian governors convoy, most times na party chieftains and political associates. In case you don't know each of those vehicles has a monthly budget for fuel (1m+) and service/repairs. Add the daily allowance of the over 20+ DSS and Police on the convoy. Add the physical cash inside the DSS vehicle behind the governors car in case oga want to spend or share cash.

I met a beautiful and godly Nigerian girl on facebook and we have been dating for some months now we are now thinking of marriage, she is in Nigeria while I am in the USA.

Some weeks ago my dad asked me to do some tests and send to him, (He is a medical doctor), I did them, turns out to be fertility tests and all was perfect.
I just told him about my fiance and my plans to get married in some months time and he said she has to do fertility test before he can agree to the marriage.

This was very shocking for me as he insisted that it is his position, I haven't told my fiance cos I dont know how to and my fiance is scheduled to pay my parents a visit for the first time in Port Harcourt in 2 weeks time.
My fiance is from Delta but lives in Portharcout as my parents while we are from Port harcourt.

My dad has said if I cannot tell her that he will, what do you guys think ?

Honest advise please and admin kindly push to front page for wider advise.

Thanks.

One of the delusions of Nigerians is that politicians are “different” from them.

The reality is that NO-ONE was born a politician…

Among today’s politicians were yesterday’s labor activists (Oshiomole, Moro, etc.), student activists (Melaye, Labaran Maku, etc.), human rights activists (Keyamo, Abdul Oroh, etc.), and even diaspora professionals (Chimaroke Nnamani, etc.), among others.

Reality is Nigeria’s condition is the culmination of the actions (by commission or omission) of ALL Nigerians!
