but the court accepted to handle the case so what ar u sayin
You obviously have no idea how U.S district courts operate, they will accept any case since it's a common district court, in the end they either refer the case to the proper court or dismiss it.

These monkeys are always embarrassing themselves! No U.S court has jurisdiction over matters such as these as long as it did not happen on U.S soil and does not involve U.S citizens, I could understand International Criminal Court but a U.S district court, pathetic!

You are wrong about that. The lawyer that sued FRSC (road safety) over number plate nko? Did he not win?
You are comparing apples with oranges. Suing FRSC is not the same as suing the Ministry of Works or Housing or even the Federal government like Tinubu did in the past, but let's even assume it is, it will be tough for any lawyer to prove that incompetency or ineffectiveness is the same as a Constitutional breach. If not, we all should have sued LAWMA, LASTMA, FAAN and so on grin grin grin

And from where should we start tackling d real deal? if not from what we the masses are paying for?
abi U wan invade National assembly or d Senate 4 a start?
Start by using your votes correctly, start from the grassroots. If you are a righteous person, engage your community, participate in politics. Help your neighbor, do not cheat or cut the system, when we change as people and embrace humanity then we can automatically elect righteous leaders who will make or amend our laws to favor the masses not the corrupt 1%. If you think suing the government is a wise move in this current judicial system then by all means start fetching water with a broken calabash.

At least he needs support (what if it happens to be your brother) I swear the comments on here is heartbroken. We should try and stay by our friends/brothers in difficult times
Just like if a friend should give you a bag at the airport to look after, not knowing it is full of cocaine. Ignorance is no excuse in the eyes of justice. Nobody wants to be associated with fraud or even someone suspected of such, wise up your good name and character is worth more than gold!

This is my take on the issue, people buy land and build houses worth millions even over 100 million in that area yet they expect government to solve all their problems. This area has been plagued for years and it is clear government is not the solution, what would it cost for a community effort to raise 20 million or above and take care of the issue once and for all. if you go outside of VGC towards Ikota the problem does not exist, this means that particular area has poor drainage system; for goodness sake it only rained for less than 2 days and such calamity what are they going to do when we have one of those 5 to 7 days rain? angry angry angry

I am not a lawyer but I am familiar with United States justice system. If found guilty of all the counts, all the sentences will run simultaneously. In sentencing a criminal United States, the judge consider a lot of things and first among it is if the person is a first offender or repeated offender, if the criminal is a first offender, the Judge give you the minimum keeping in mind or hopefully you will return because keeping in prison for a long time is it drain on taxpayers money.

uote author=abbey621 post=57233772]

I don't think you are familiar with the U.S justice system! He is facing 7 counts of grand theft and 2 other counts bordering on identity theft with each charge likely to earn 1 to 5 years in jail. This means if he is found guilty of all counts he could face 30 years or more, with a good lawyer he might not serve up to 5 years but certainly more than a year but with public defenders they won't even stress themselves. First offender theory is meant for U.S citizens, when it comes to foreigners and even permanent residents you are at the mercy of the court and there is no issue hotter in the U.S right now than cyber identity theft or cyberfraud. Best case scenario, the promoter Chukwuemeka confesses that Dammy was not aware of all those transactions, the attempt to use up to 5 cards for one purchase and that the Samsung phone used belongs to someone else, this might save him from a harsh sentence but the Nigerian stigma will always make this case a hard one for any defense team.
This is not true for all cases and in Dammy's case, I can frankly tell you that unless he is a U.S citizen the first offender act does not apply. I have an uncle that was arrested in the 90s for the same thing, it was his first time being caught but that did not stop them from slamming him with 7 years. Being a foreigner and a black person in the USA we are already handicapped but to now earn the wrath of the justice system na die o

Since he committed the crime in the USA, it is completely up to the U.S government whether to extradite him or not.

I don't think so. public defender is not a bad thing. its cost so much to hire a lawyer and considering his fake life, he might just not be able to afford one which leave him with no choice. On a normal circumstances, he should get less than a year if found guilty cos this a his first time and just a transaction.

Credit cards, Internet scam etc are federal crime in State. He is a first offender so I guess he just going to get a slap in the wrist between 6 to 11 months which is a misdemeanor but if he get a meet a racist judge, then he is in for a big sh**t.
6 to 11 months is a fallacy considering he is facing up to 9 counts, I bet he gets a minimum of 5 years considering public defenders/lawyers are not going to waste their energy.

Take it easy, madam. Not all who support gay rights are gay. Moreover, we have more pressing issues than attacking gays. Of all the bills that could make this country a better place, only that of gays got such tremendous uplift. I think it is high time we started getting our priorities right. One of such is to start holding our leaders accountable. We all keep on shouting "revolution" and yet can't even come together to revolt against our useless leaders. But if it is about the harmless gays, people will start getting unnecessarily worked up. What should work us up more: "gays or useless leaders"?
Two wrongs does not make a right, because our lawmakers are negligent on every other important issues does not mean we should allow them to be negligent on the issue of homosexuality. After all that has gone wrong in this country, adding homosexuality will completely bankrupt the little hope remaining for a morally correct society, emphasis on the word LITTLE!

I don't know about the law proceedings but once they book you the first time your a first time offender. I watch law and order a lot yes you may have history and unsolved cases that they can tie the person to but the first count is what they book you the first key evidence or case they have against you in this case Grand theft then subsequently adding additional charges as applicable . Once your in the system and records its hard to get out it's your first time going in that's why they ask for fingerprint when we travel to run it against all major crimes databases.

Sometimes I will encourage you to watch the show it has taught me so much about the justice system and how to stay away from anything that will bring you through it. Permanent record means when you travel them go know who you be.
We are talking about two different things. What you are talking about is a first time offender in terms of criminal law while I'm talking about him being a professional at this and doing it multiple times. Either way he's going to face the wrath of the law but you are right they might lessen his sentence due to no prior criminal history grin grin

The first time you are caught it's your first time
I disagree, if you are caught in regards to fraud in America, you are prosecuted based on the number of attempts or victims, the boy is facing up to eight charges and he'll serve jail time for each charge if not careful.
