Sir, most of the churches are not following the teachings of Christ then cos the courts are full of so many church cases. Can you see how the church has invited the world or govt to pry into it's affairs? So who is truly responsible for all planned laws? Are you aware of so many church leadership disputes in Nigerian courts?

I really appreciate all your thoughts so far. The ultimate solution to all these is for the church to self regulate which is where the churches in Nigeria has failed to do. This is why CAN or PFN was even set up but the problem has always been that no one want to be accountable to anybody as everyone claim they are called by God and only accountable to him which has always been the gimmick used to cover all atrocities lots of churches and pastors have been associated with. Like I said earlier let's stop pretending that all is well. Even in the genuine churches there are issues cos they have all failed to self regulate. This is why the idea that the pastors and churches should be left alone to do as they please cannot hold water anymore. As you have also pointed out, many are no longer following the teachings of Christ in resolving even their internal issues.

The day nigerian churches truly uphold righteousness and integrity, they will find it easier to tell govt to look away from it's affairs but all your theological theories of how church can handle itself is not working in any Nigerian church today except we want to tell ourselves lies and the pastors themselves know it.

According to Scriptures, every govt is ordained by God and they bear not the sword in vain, reason we are enjoined to always pray for those in authority to guide us in all godliness and honesty. The church in Nigeria despite the gains in terms of number of, attendance, souls and conversions has not been a very good example in the last 20 years in the area of integrity and holiness, gone are the days employers of labour seek referrals from churches and pastors for employment, gone are the days cheques from churches are honoured at banks without much questions. The Nigerian church need to do soul searching and return to righteousness, then we don't need to be fighting with govt on pages of newspapers. It has nothing to do with whoever in aso rock after all we had non christians as Presidents when the church still had much respect and honour than today. Telling the govt that they have no spiritual competence to pry into church affairs is double speaking as the church too has not enough spiritual competence to handle its own internal affairs from what we have seen over the years.

Whatever is happening today is a call to the church by God to awake and return to righteousness. God bless you bro and blessed week to you and yours.

What was done was that financial running of the church was taken over by an administrator while trustees remained to continue to serve the spiritual aspects of the church.
Good you now agree that it's "few" members or pastors aka trustees that are privy to the financial details of the church which is what FRC requires. No law requires that all members be informed.
I don't know where you get the idea that churches have a lot to hide. You can cite examples to buttress your claim.

In view of the recent noise about CAMA 2020 and its inherent powers to sack the Board of Trustees of Charity organisations including religious bodies, this thread seems to beam light on the actual duties of A Church Board of Trustees.

I have also come to realise that a lot of church members do not even know those who are made up of the Board of Trustees of their church.

I will attempt to garner information on the Trustees of some popular churches in Nigeria.

Most churches rely on the donations of its members to fund its mission. Members enjoy a tax deduction for these donations that are freely given to churches that maintain nonprofit status with the IRS (Tax Authority).

One of the requirements for maintaining a nonprofit status is to have an oversight board. Church board responsibilities are many but the most important is to ensure that the ministry is financially viable and that it fulfills its core mission.

This is done by developing strategy, monitoring performance and ensuring church financial accountability for the sacrificed donations of its members.

Church boards make certain a meaningful mission is implemented effectively.

Effective boards have an impact on the long-term viability of the organization and have a vested interest in how well the church implements the strategy of achieving its mission.

This is done by meeting regularly while actively overseeing the key operational functions – which are church budget oversight, top leader performance evaluation, strategic performance management, and legal compliance.

EIGHT ( 8 ) CHURCH BOARD RESPONSIBILITIES

1. Strategic Planning
The board is responsible for articulating the church’s core mission and developing a strategy and plan to achieve it.

This is done by going through a formal strategic planning process. Develop a mission, vision and values statement and operational goals that map out the specific steps needed for achieving the mission.

Delegate those goals to specific departments of the church.

For instance, if the church has an objective to create outreach programs for its community, write actionable goals and delegate those responsibilities to someone. Then hold them accountable for getting it done.

2. Managing Performance
The board is responsible for monitoring and holding leadership accountable for doing their job.

This is done by developing annual church goals, delegating that responsibility to leadership, and then monitoring the progress.

Show support by delegating decision-making and authoritative boundaries for achieving those goals.

For example, the Executive Pastor should understand the boundaries of his authority for making tactical decisions about the day-to-day operations of the ministry. This decision-making authority removes decision bottlenecks that can hinder the progress toward achieving a goal.

3. Financial Oversight
The board oversees and ensures there is responsible stewardship of church resources, and that it maintains financial accountability, and solvency.

This is done by approving and overseeing the annual church budget.

Financial oversight includes identifying independent outside auditors to perform occasional audits to safeguard against embezzlement, ensure good business practices, and to maintain compliance with state and federal laws.

This committee is responsible for benchmarking top church leader’s compensation, making recommendations for pay and housing allowance, and approving salaries of senior leadership.

5. Ensure Legal Compliance
Church boards are responsible for adhering to laws that govern nonprofit organizations.

This includes the duties of care, loyalty, and obedience.

The board has a responsibility to ensure that the church stays true to its core mission by participating in decision-making, using good judgment, setting aside personal interests to ensure the best interest of the organization is kept, and by complying with governing laws.

6. Monitor Conflict-of-Interest
The board is responsible for ensuring there are no conflicts-of-interest and puts policies and systems in place to ensure full disclosure of any potential conflicts between outside organizations and church employees or the board.

For instance, if a church board member owns a painting company, this could be a potential conflict if that company is given preferential treatment for outsourced painting jobs.

Do this by creating a conflict of interest policy that requires employees and board members to disclose potential conflicts and sign a conflict of interest statement.

7. Maintain Supporting Documents and Board Records
The board is responsible for ensuring all board records are kept including:

board minutes
mission, vision, values statement,
church bylaws,
articles of incorporation
and any policies that govern the board function.
Manage these documents by housing them on secure servers and controlled file cabinets.

8. Board Training
Help new board members by providing the appropriate orientation and training for their role.

This includes a review of all corporate documents, job descriptions, and responsibilities.

Also, orient them to understand the legal requirements for board members. There are many church board training resources that can help.

Anyone who is chosen to be part of a church board should recognize the honor and incredible responsibility that comes with that role.

Having a good understanding of role responsibilities, coupled with thorough training, is a great way to get a board member equipped to serve the church.

It does not target the church.

It's mainly a law for Charity and Non-Governmental Organisations.

However, religious organisations are registered under Charity and NGOs by the Corporate Affairs Commission.

So, the law applies to all religious organisations (either Christianity, Islam or whatever) registered by the Corporate Affairs Commission and the NGOs.

I'm glad he actually understands that accountability is not the problem here but the fear of abuse of the law by the government agencies involved, and that has been the argument all along! If it was about being accountable alone, it wouldn't have generated do much heat. I wonder why he has not used his good office to put CAN through on what to do to correct this and he had to wait till he was asked this question by the NBA before telling them what they can do. Christians have become too edgy these days. Any advice given to them is tagged propanganda. Did CAN take time to go through the laws before making noise all over?

In my church, the church elders received correspondence from CAN on the matter and were already fuming that CAC wants to remove trustees without going to court. I corrected them that there is a provision for approaching the court.

CAN should tell us other means the church board of trustees can be made accountable.

And even if a criminal wilfully evades arrest, such case can be tried in absential with sufficient evidence.

A welcome development in the right direction. Seriously there need to be a revamp in the laws that governs the courts in Nigeria.
We are a difficult set of people in Nigeria. This is reflective in how terrible all services are in this country.

Administration of justice through the courts ...nothing to write home about.

Interior services like driving license, international passport, National ID card..... terrible.

Police services... zero

Emergency and Medical services ....zero

Public services like roads, electricity, waste management, drainage services, etc... zero.

All these cuts across every body. So the problem of Nigeria is with each individual person.

It is ingrained in our system to use technicalities to prolong cases. I know a company that has been in court with the Corrupt Commission for 5 years! 3 judges have backed out due to the corrupt commission lawyers antics!!
