Mystery 1:Sorry for the long-winded reply; If either you or the dad is a citizen or has settled status, your child is a British citizen at birth. If your child was born between 1st Jan 1983 and 1st Jul 2006, the dad (if he is the citizen) has to be married to the mum, but if the mum is the citizen, she does not have to be married to the dad. If the child was born after 1st July 2006, there is no need for the parents to be married. If none of you is a citizen or has settled status, i.e. you are here to work, study, visit, entered illegally or in breach of any immigration laws, your child is not a British citizen at birth. The child would have the rights to registration as a British citizen if the child lives in the country continuosly for 10 years or if the either or both of the parents gets settled status before the child gets to the age of 18. If your child is over 18, he/she would have to apply for naturalisation. |

Because Maggie was born before 1st of July 2006, she did not gain automatic citizenship by birth because her dad was unmarried at the time of her birth, but by virtue of daddy marrying her mum a few months after she was born. She became a legitimate child, and hence qualified for British citizenship by descent, after application from her, now married daddy. On the other hand, post 1st Jan 1983, if it was her mum that was the British citizen or had settled status, she would have automatically become a citizen, whether her mum was married or not. And this was the reason the new law was introduced on the 1st of Jul 2006, to comply with equality law and give all fathers the same right as all mothers.
