dupyshoo: Tell your new employer that your current employer is stalling. Submit your payslips and bank statements to show that you worked with the employer. Ask of you can give another reference instead.
Once you get your COS and you get your new visa, you will not be able to work with the current employer legally again. Make sure you ask for the associated costs and ensure your communications are recorded. Thanks to everyone for the advice and the bashing.
Even If I am able to get the new visa, I still wont start work until I release myself from the contract and serve my notice.
At least I'm happy that everyone here have seen that my employment contract has an exit/release clause, only my employer has refused to see this. Well I believe his lawyer will explain better to him.
My prospective employer is with the NHS and I have had this conditional offer for about 2 months. In between, I have been satisfying all pre employment checks ( verification of identity and documents, Nigerian police check, dbs, occupational health, etc).
HR has confirmed to me that it remains references and then we proceed to CoS which is why I told them to contact my referees.
Having said this, I have read everyone's opinions and views on the matter and I will act accordingly.

So whether he likes it or not, he would have to give me the cost of ending the contract since I am no longer interested in the sponsorship as stated in the contract. I believe he is just stalling. And again, getting my reference sorted out with prospective employer doesn't even mean I have moved to the company as I have not given my leave notice yet. Send them an official letter stating your disengagement and terms ........ From experience, would 2 out of 3 references suffice? since oga has refused to give reference OR I suggest to get a 3rd reference from another previous employer. |

HR gurus and other members of the forum, please I need your knowledge in this situation. I am currently employed in a domiciliary care company with sponsorship (I did not pay) and after spending a year with the company, I have decided to move on. Luckily for me I have found a better job with sponsorship and all pre employment checks have been fulfilled. According to my prospective HR, the only thing remaining for me is to provide 3 references and then we proceed to CoS stage.
I have provided my prospective employer with the 3 referees as requested ( 2 from previous employers and 1 from current employer). The 2 previous employers have responded and I have gotten a confirmation that it has been accepted. It remains only my current employer and after talking to him about it, he said he would not attend to the reference and he would have to talk to his lawyer first because the contract says I have to work in his company for 5 years.
Attached is a screen shot of the contract that I signed and I am ready to abide by it.
Please guys I need your response on what to do as I believe he wants to waste my time.
Can I also inform my prospective employer of the current situation and ask if they are happy to proceed to CoS stage with the 2 references that they already have OR if I can provide a 3rd reference from another previous employer in the UK?
Do I need to join a union because of this issue?

Just putting this out there;
So a colleague of mine on tier 2 visa traveled to naija and back using KLM. Had a stop over at Amsterdam on both journeys, didn’t have a transit visa.
I know after brexit, only British citizens could fly KLM or Air France or any of these European airlines without a transit visa. I stand to be corrected.
I dunno about any other airline, but she flew KLM to naija and back to the UK and she’s on Tier 2 visa. |

My employer issued me a COS but on the tier and category section it says " Skilled worker ( change of employment - ISC liable) " but I'm only switching from tier 4 dependant to skilled work. Though I raised a point with the HR person that the tier and category seems wrong but the told me that they only saw three options which are Leave, change of employment and extension and the change of employment is the only option they thought is relevant to me. Should I proceed to apply with that COS or I should press further for a correction on the COS?

EmeeNaka: I put 10years of driving experience. My car is Peugeot 207, 2008 model . The cheapest I have seen is £1600 for myself and my wife. I chose that I park the car at my Residential Parking at Night and at office parking during the day. Total annual mileage 6000miles. I have not made any insurance claims back home, but if I chose it, they ask me to produce evidence. One major factor is location. My insurance once dropped from £1200 to £700 because I relocated from Manchester to Devon |

Same here, I booked 2hrs on the test day like I normally book for normal lessons. 1hr warm up drive and 1hr for test and back home. No extra charges. £35/hr in my area for a manual car. |
