If you read John 3 vs 1 -21, you will note that Jesus Christ never in fact mentions the Spirit in question is God's own Spirit. He instead speaks of a rebirth of a Spiritual kind, confirming God's statement regarding His New Agreement people in Ezekiel 36 vs 26, where He declares that He will give them a new Spirit ( again not His Spirit).
