Commonwealth Doctors Mourn Death Of Queen Elizabeth II Commonwealth Medical Association, CMA, on Thursday expressed sadness over the news of the demise of Her Majesty, Queen Elizabeth II, Head of the Commonwealth. In a statement signed by the President of the CMA, Dr Osahon Enabulele said: “Since being apprised of her death, our hearts have been laden with grief over her earthly transition. The CMA shares the deep sense of loss of the Royal family, the people of the Commonwealth and indeed citizens of the world, over the loss. The statement further reads: “On behalf of physicians from all over the Commonwealth, we offer our deepest and heartfelt condolences to the entire Royal Family, the Government and people of the United Kingdom, and the people of the entire Commonwealth. Her Majesty, the Queen of England was globally known as a strong centripetal force and an effervescent supporter of the Commonwealth and its people. Aside from engendering a new era of openness, integration, and connectivity in the Commonwealth, she admirably performed her roles as Head of the Commonwealth. “She was very collaborative and people-centred and strove hard to connect and integrate the people and nations of the Commonwealth through her very profound and impactful initiatives. Indeed, she was quite motherly, caring, and result-oriented. “We pray that the beautiful memories of her legacies, sacrifices and diligent commitment to the growth of the Commonwealth and its people bring great solace to the Royal family, as well as the people of the Commonwealth during this period of bereavement. May her precious and profound soul rest in perfect peace.” https://www.vanguardngr.com/2022/09/commonwealth-doctors-mourn-death-of-queen-elizabeth-11/amp/

Joshua To Get 40% From Fury Clash Anthony Joshua has officially accepted Tyson Fury’s offer for their ‘Battle of Britain’ showdown and with this, has now paved the way for the biggest fight in British boxing history. Joshua was on the surprising end of a callout from Fury, who is not willing to wait till 2023 for an undisputed clash with Ukrainian, Oleksandr Usyk. Joshua was offered a 40 per cent split of what would be a record-breaking haul to fight the Gypsy King. The news comes after Fury’s promoter Frank Warren confirmed on Tuesday that he would be sending Joshua an official written offer for a fight against Fury. A date in early November was initially put on the table, but Joshua can only return by December at the earliest following last month’s defeat to Usyk. Fury also wants to include a rematch clause and Joshua’s team are happy with the terms, as long as they get the lion’s share for the second fight if they win in December. Joshua’s promoter Eddie Hearn confirmed they are willing to take the deal on offer after talks with Frank Warren’s son George. He told iFL TV on Thursday, “We just went back this (Thursday) morning and said I spoke to AJ about that offer, we think, I think particularly he deserves more than 40 per cent. “But, he’s happy. And I don’t make the decisions, he does. So, I went back this morning and said, ‘We accept 60/40’. “We want that reversed in the rematch, rightfully so, because you’re champion here, you want the bigger split, which I think is fair. “And we want to do the fight in December. Now, interestingly, they have December 17th, Queensberry held at the Millennium, so that’s perfect.” Fury initially wanted to fight WBA, IBF, and WBO champion Usyk, who beat Joshua twice in the space of 11 months. It would have been the heavyweight division’s first four-belt undisputed title decider. However, despite having December 17th held, Fury has appeared to tell Joshua there are only two dates he’ll fight. He claimed on talkSPORT that November 26 at Wembley or December 3 in Cardiff are the dates on offer. He said, “I have Nov 26th at Wembley or Dec 3rd. One is 11 weeks, and one is 12 weeks. “If a professional athlete who’s shredded all year round can’t get himself in shape in three months, there’s a problem.” Joshua, 32, was set to return before the end of the year against an opponent ranked within the world’s top 15. But plans to build back steadily could be cast aside if the chance to challenge for Fury’s WBC belt goes from longshot to reality. Promoter Warren backed the all-Brit bout to break the domestic PPV record with two million sales. And if the price takes an expected increase to £30, it leaves £60million made in box office receipts alone. And the last time Joshua boxed in Wales, beating Joseph Parker, 30, in 2018, around £10m was made by paying fans. It means Joshua and Fury would be expected to clear well over £70m in PPVs and ticket sales. Negotiations are only at a start but Hearn has maintained they are happy with the financial terms. He said, “In essence, we accept the offer of 60/40 and we confirmed that this morning. Lots of conversations to be had.” https://punchng.com/joshua-to-get-40-from-fury-clash/?amp

Diaspora Donation To Peter Obi Campaign Violates No Law In Nigeria (1) -By Festus Ogun, Esq Following the pledge of a Diaspora Support Group to crowdfund $150m for Peter Obi’s campaign, concerns are raised in some quarters over the legality and constitutionality of diaspora donations made in respect of Mr. Peter Obi’s Campaign. In fact, some groups reportedly called on the Independent National Electoral Commission (INEC) to “without delay” disqualify Mr. Peter Obi, the Presidential Candidate of the Labour Party, from the 2023 Presidential race. To be clear, donations made by concerned citizens and support groups (either in Nigeria or in the diaspora) to Peter Obi and or his Campaign Team are not in violation of any living law in Nigeria. Those who hold otherwise rely largely on Section 225(3)(a)(b) of the 1999 Constitution of the Federal Republic of Nigeria (as altered) and Section 85 of the Electoral Act, 2022. With greatest respect, these provisions of law are generally inapplicable to this instant case and those who rely on them to demand from INEC the disqualification of Mr. Peter Obi, which is itself laughable, are either mischievous or misconceived. Section 225(3)(a)(b) of the 1999 Constitution of the Federal Republic of Nigeria (as altered) provides that: “No political party shall hold or possess any funds or other assets outside Nigeria; or b. be entitled to retain any funds or assets remitted or sent to it from outside Nigeria”. Section 85 of the Electoral Act, 2022 provides that: Any political party that— (a) holds or possesses any fund outside Nigeria in contravention of section 225 (3) (a) of the Constitution, commits an offence and shall on conviction forfeit the funds or assets purchased with such funds to the Commission and in addition may be liable to a fine of at least N5,000,000 ; or (b) retains any fund or other asset remitted to it from outside Nigeria in contravention of section 225 (3) (a) of the Constitution commits an offence and shall on conviction forfeit the funds or assets to the Commission and in addition may be liable to a fine of at least N5,000,000. The above provisions of law are clear and unambiguous. The wordings are not difficult to understand; even for laymen that have never stepped on the corridors of any law school. Importantly, our law is beyond settled that where words used in a statute are clear, straightforward and unambiguous, they should be accorded their grammatical, plain, ordinary and natural meaning. In SKYE BANK V. IWU (2017) LPELR-42595(SC), the Supreme Court, per Kekere-Ekun, emphasized that “the general rule of interpretation of constitutional provisions is that where words used are clear and unambiguous, they must be given a literal interpretation i.e. they must be given their ordinary and grammatical meaning”. On the strength of the above, we are compelled to rely simply on the plain, clear and grammatical meaning of the above provisions of law. A careful consideration of the sections of law reproduced above shows that the 1999 Constitution simply prohibits a POLITICAL PARTY from holding or possessing any funds or other assets outside Nigeria and from retaining any funds or assets remitted or sent to it from outside Nigeria. The Electoral Act, by virtue of Section 85, only compliments the constitutional provision by prescribing punishment for its breach. In our considered view, 225(3)(a)(b) of the 1999 Constitution is only applicable to Political Parties and it is not applicable to political candidates or their campaign organizations. It is not a subject of debate that the diaspora donations are said to be made to either Peter Obi and or his Campaign Organization. The question that follows is whether Peter Obi or his Campaign Organization(s) is a Political Party envisaged under 225(3)(a)(b) of the 1999 Constitution? Section 318 of the 1999 Constitution gives no definition for a “political party”. Thankfully, Section 152 of the Electoral Act, 2022 defines a “political party” to include “any association of persons whose activities includes canvassing for votes in support of a candidate for election under this Act and registered by the Commission”. (emphasis mine) We respectfully submit, therefore, that a candidate or his campaign organization(s) cannot be regarded as a political party under our extant electoral jurisprudence. Having cleared that, it is safe to say that donations made to Mr. Peter Obi or his Campaign Organization in furtherance of his Presidential Campaign cannot be said to be made to a Political Party as envisaged under 225(3)(a)(b) of the 1999 Constitution. Neither Mr. Peter Obi nor his Campaign Organization is a “Political Party” and must not be mistaken or confused for Labour Party, a duly registered political party under the law. It would have been a different ball game entirely if the donations were made to Labour Party, as a political party. Donations made to Political Candidates or their Campaign Teams are not caught under 225(3)(a)(b) of the 1999 Constitution and Section 85 of the Electoral Act and are therefore not illegal and unconstitutional. Our position is further fortified by the Latin maxim: “expressio unius est exclusion alterius” meaning in the interpretation of statutes “the express mention of one thing is the exclusion of the other not mentioned; what is not included in a statute is not to be read into it”. See: COMMISSIONER OF LOCAL GOVERNMENT & CHIEFTAINCY AFFAIRS & ANOR V. ONAKADE (2016) LPELR-41133(CA). Applying the above rule to the provisions of law stated earlier, it becomes apparent that the express mention of the word “political party” in 225(3)(a)(b) of the 1999 Constitution and Section 85 of the Electoral Act automatically excludes donations made to political candidates or their campaign groups. And the exclusion confirms the inapplicability of that section to political candidates and their campaign groups. Importantly, while Section 88 (2) of the Electoral Act, 2022 provides that the maximum election expenses to be incurred by a candidate at a presidential election shall not exceed N5,000,000,000.00; there is no such limitation placed on the amount of donation a Presidential Candidate or his Campaign Group can receive or how much expenses a Presidential Campaign Support Group can incur. Either at home or abroad, Nigerians shall continue to enjoy their constitutional rights and civil liberty to support any candidate of their choice in cash or kind. Political candidates and their support groups are however advised to be transparent and accountable especially in the management of donated resources. God bless Nigeria. Just For The Records... The word 'Hell' is mentioned just 54 times in the entire Bible, while the word 'Heaven' is mentioned 582 times in the Bible. Surprised? The words 'satan/devil' are mentioned about 90 times, while the words 'Christ/Jesus' are mentioned 1,550 times in the same Bible. The word 'demon/demons' are mentioned 81 times, while the words 'angel/angels' are mentioned 294 times. The words 'witch/witchcraft' are mentioned only 5 times (this statistics is based on the King James Version). What does all these imply? This means the Bible speaks more of Heaven than it speaks of Hell. It speaks more of angels than it speaks of demons. It speaks more of Christ than it speaks of satan. It is not a book that glorifies witches! The simple reason for this is that Christ and His power and work are the emphasis of the Bible. When we talk more about Jesus and His authority given us, no power on earth will be able to withstand us. Many preachers have missed the real emphasis hence their sermons are more about hell, demons, and satan. The result of this is that many more believers are living in fear and uncertainties. Until we begin to emphasis what the Bible emphasises, there will be no genuine spiritual growth. Let's preach Christ loud and clear! Let's preach about His victory and power. Let's preach about His free gift of salvation and righteousness. This is how to walk over all the power of the enemy. The devil exists as a DEFEATED being. Think about this! -Pastor Olubukun {Facebook Page}
