The Senate can't decide for executive who to nominate for a position but the executive too can't decide for the Senate who to confirm and as long as you are not confirmed as an EFCC chair, you can't hold on to the office illegally. The law envisaged a situation whereby the president may eventually nominate his wife as EFCC chair for vendetta and personal reasons so it created a check and balance via confirmation with the Senate which are representatives of the people. Once the Senate says no, it means no. If you are not happy with your senator decision you can recall him but whatever he does in his capacity today as your senator is legal and must be respected. So if you fail exam that will qualify you as a doctor for example, can you start practising as a doctor? No. You may write the exam more than 3 times and fail but as long as you are yet to pass you can't practise. If the exam body finally says you are not trainable and they wont allow you to write exams again, can your parent say since they are the one paying school fees you shouldn't mind them but just go ahead and open a hospital? So those ones whose names were submitted a second time were finally confirmed after repeat exams and that's what makes it legal. The executive can send names as many times to senate for confirmation but until the person is confirmed if he acts in that capacity then it is illegal. So even if the Senate can't disqualify magu, magu can't act as the EFCC chair until he is confirmed so he can wait till he is confirmed before parading himself. Till then he can't be EFCC chair. This is simple common sense. You dont need to be a lawyer to know that. I know you won't still understand from your responses so far.
