krebbs: Hello @just wise et.al,

What are the chances of someone with a 10 year ban, married to a another person in the UK on a student(tier-4), work permit or permanent residence visa.......Is the ban 'cancellable, under any these visa categories?
If you are married to a British citizen or somebody with permanent resident paper and you applied for spouse visa you stand a chance(if you met all requirements).

Student visa and work permit holder doesn't count.

jennykadry: Off topic- In the UK say for instance, two students still on student visa decide they want to have a child. When they have that child, does that child automatically become a citizen or does the child go under the same visa as both parents?
No the child will not become citizen automatically, the child is a Nigerian just like his/her parents, yes she goes under the same visa as both parents.

Proudlygemini: Please nairalanders I need your advice on getting a spouse visa.
I would start off by saying I recently just got married to a British expat that lives and works here in Lagos but travels during the holidays back home to the uk. Before we got married we decided that Nigeria would be our home but we'll always travel during the holidays back to the uk. Based on this decision, his last trip this December he sold his house since there's no one there. Now we plan on vacationing this summer for about a month but I'm confused. I do not intend to live in the uk atleast not for another 4 years, do I still apply for a spouse visa even though i plan to stay a month. We also decided to rent an apartment while we are there. My strong tie to Nigeria is my 5 years old son from a previous relationship and my business also my husbands contract isn't due till 2016. I have also read that he needs to earn 18k and above annually to meet d financial requirement, right now he''s paid 5kpounds monthly that's 60k a year. How long does the spouse visa take? Do I have to do a change of name on my passport cos I recently renewed it and it doesn't expire till 2017. Do I fill the application in my name as it is on my passport or in his? Please I need you advice on how to get this right, thank you.

junnymercy: Thanks for this. Do you mean her daughter is not her tie in Nigeria? And lastly, what do you think if she go for administrative review? OR what do you think she should do about it? as she has no property...
Her daughter can be looked after by her family if she decided to stay back in the UK, she got no husband, job, business, major commitment in Nigeria that might persuade here to come back, she is not spending her hard earned money for the trip. The assumption is that she might decide to stay back in the UK.

If this is a trip for medical treatment then its a different case all together but a trip for leisure and the amount involved here raises eyebrow.

She can try administrative review but i can't bet my money on the outcome.

junnymercy: Hi, pls i need advice on this

My cousin is 25 yrs old, and she applied for a tourist visa to visit the UK for a week.
Her application was refused recently and given limited right of appeal.
Here is the decision:

You have applied for an entry clearance to visit the United Kingdom for one week.
I have considered your application under paragraph 41 of the United Kingdom Immigration Rules.
In order to be able to make a decision on whether or not to grant you entry clearance in this category I have taken into account your stated circumstances in Nigeria, the reason for your visit and your proposed travel arrangements. You have declared that you are a student of ………………. And supported by family member and that you have no family commitments or children to support.
I note that you have submitted no evidence of personal assets or savings. You also state that you propose to travel alone as a tourist and have no friends or family in the UK.
Given the statements you have made and the documentary evidence you have presented to support your application I am not satisfied that your circumstances in Nigeria, coupled with your reason for wishing to travel to the UK, are such that you have shown your intentions are as stated or that you intend to leave the UK at the end of your proposed visit. I am therefore not satisfied that your application meets the requirements of the paragraph 41 (i) and (ii) of the Immigration Rules.
Your right of appeal is limited to the grounds referred to in section blab la bla.

But, she told me that she submitted her personal savings account along with her sponsor’s account and sponsorship letter for the one week including evidence of income from his sponsor. Her sponsor provided his personal account with proof of income, his company tax and company cert. She also submitted letter from her school and ID.card and evidence that she has a daughter and she live with her daughter and her partner. She has not married though.
But I’m surprised with the decision because, the decision indirectly as if one must have a relative in the UK before she can be issued a visa? Must she have a property before she can be issued a visa? However, her sponsor also provided his landed property but the landed property was returned at the VFS office that they don’t need sponsor property. What do you think?
They did not even complain about school, hotel accommodation, air fare, and BTA because she provided documentary evidence of these and confirmed. But the visa officer only complain and refused her application base on assets.
My question is: Must she have a property in Nigeria? Is it a must for her to have property as a student before she can be issued a tourist visa?
Must she have a relative in the UK before she can be issued a visa as a tourist to visit the UK for a week?
And why the visa officer cleverly avoided or telling lies that she did not have family whereas the officer knew that she has a daughter and partner living together?
Your advice is needed here. Do you think she should go for administrative review and attach same set of documents and those the VFS did not collect from her, so she should send everything together to the embassy for administrative review. What do you think pls?
She was refused purely for her lack of tie to Nigeria, getting a visa as an adult student is difficult as she got no job/business, no strong source of income. Those are the things that helps when applying for visiting visa.

Marvel606: So, does that mean if she's endorsed on my passport at the Nigerian embassy in London, i cannot bring her to 9ja and take her back to the UK. Also does my husband that has a 6months tourist visa, qualify to apply as my dependent since I'm a Tier-4 student ?

You can take her back to Nigeria obviously she is a Nigerian, contact Nigerian embassy for more details but bring her back to the UK will be an issue, you need to apply for visa for her.

Your husband can apply for dependent visa but from Nigeria.

Lytelbeuti: Your box is not missing we sent it back to where you bought it fraudulently from, the only one we shipped we didn't know you stole them that's why we shipped it by the time the authority alerted us you escaped us. If you bought them in good faith please send me your govt issued ID and we'll take it from there.
Thanks for coming back to reply to this allegation.
