Please what higher tie do you need to show when they have clearly shown that they intend to migrate via their petition?
your ties becomes weak since you plan to leave these ties anyways as proven by submitting a petition

remember that once someone with a pending petition enters the US, they can just work illegally and adjust status when their PD becomes current, a smart way to outsmart immigration law and an abuse of the visit visa.

Tmeeto has confirmed this and nupital will in a few days.
There may be exceptions though, if you have an history of using previous visas rightly, i will guess you may get it because you have a good reputation already
I am glad Tmeeto saw the good side of it all.

Assuming Mrs Ambode ( wife of Gov) sibling filled immigration petition for her, assuming she has not even visited US b4 and she had even in the past refused visit visa because of the petition on ground. now that she is the wife of the gov. do you think she ll still be refused visit visa now because of the ongoing petition? Absolutely no.

my point, if you have a powerful tie to Nigeria, like securing a senior manager position in a big coy, you ll not be refused visa because you have a petition. Your present economic status shows that you ll not stay illegally talking based on balance of probabilies!

Good day to you all, i am a student and also a working class man, i work as an accountant and also the personal Assistant to the medical Director,i am in my late 20's i want to apply for a visiting visa, am actually going for my cousin's wedding so hes inviting me, what are the documents i might likly need? Cos in the invitation letter i told him to write my hospital will be sponsoring me. I hope that is okay? And also do i need my salary statement since i said it the hospital that will be sponsoring me. My passport is a virgin passport. The wedding invitation card is out and i also told him to attach it with the invitation letter. The wedding is stated bfor September 2016.What are my chances of getting the visa. Hope to get a reply soon. Thanks

Even if the MD is nice and generous enough to sponsor this trip , you ll almostl automatically b refused if you say anyone but you is sponsoring this kind of trip.

You're free to apply to visit U.S it is up to you and V.O to decide if you're eligible or not.
fill your form correctly and go for the interview... Hopefully it will be successful but no one except the V.O can guarantee you a U.S Visit visa

This is so true , US visit visa as to specific standard to be met. its totally at the discretion of the VO at the time of interview , unlike immigrant visa that as specific requirements to be met.

I think its prolly because i have an immigrant application pending. Is all good tho

That could most likely cause the denial. But having said that, some people still get granted despite their immigration pending application! They just need to show a higher ties to Nigeria.

Thank you, boss.
How about travelling to countries like Kenya, Dubai and South Africa then probably France. Coz I will be going to France soon with my cousin for this year euro 2016. Or is it a must I must travel to UK before I can be qualified for USA?

No.

Oh thanks kennyCanny and all, that could be my mistake, the change was made after she had booked appointment for June 1st.it was retrieved, corrected and resubmitted but retained earlier appointment date, i dont know how he did it but the Code changed on the new printout. What do you think?
Again, i thank God for this forum. I have been wondering why i did not search for info b4 now. We wouldn't have spent all the money the said agent collected to make this mess. I now know better, "Best things in life are for free".

Not 100% sure of my position though, but frankly speaking, the VO accessed her based on the information on the current form she submitted and not on the retrieved one.

People that have genuine reasons , and good jobs and profile also get refused many times when they are unable to convince d VO during that extremely short visa interview. so getting refused US visa is not a big deal if I must be sincere with you.

Thank God its her true profile that she attended the interview with. she should stick to it and be truthful always.

when to apply again? depending on the reason she wanted to travel , if its very very necessary for her to go to US now ( like to close a big deal on behalf of a big coy, medical , govt meetings , etc )she can reapply almost immediately. But if her reasons falls under not really very necessary reasons ( like tourism, visit of friends or family etc , I ll advice she wait for some time like a year plus , because she ll likely get same result if she rush to reapply.

Thanks but it seems you did not understand me. If u check, i joined this forum yesterday. how did i get 2 know about the forum? as soon as she called that she was denied as she explained. i went to the web to check for info via FAQ, i also checked visa Agent info with the hope of getting a better and experienced agent. It was the advice i read from there that some agents can mislead and the info there that VOs answer some questions on nairaland that led me to this forum. i joined and read your comments, then suspected what i posted.

I wonder why you think i am lying on this forum when i am seeking for help and info, there is no need for that. I stated that she had her form completed earlier by an agent who felt he should add a "Better" job different from what she is doing. He did but by the time she came back and told me i was not comfortable with that cos i dont know how she was going to defend it. I requested a retrieval and that was what i had the agent do to change to her real job to make it easier for defense. sorry for the lengthy write up just to explain. Note: this is her first attempt. like to have more info on this pls.
Be blessed.

I saw your post and understood u clearly, because I have passed through same experience of an agent giving me a job profile that I don't have. I cancelled the appointment
and latter applied with my genuine information , although I was refused then but I guess it does not have to do with the info the agent filled for me, but because I was not convincing enough then.

I applied later again with a more pressing reason to be in US and I was granted visa.

My take , she was not refused because of the form the agent earlier filled. She was most likely refused because the VO felt that she is not qualified as @that time , probably cos her reasons for travel are not good enough from the VO perspective.

Was an appointment booked b4 you demanded for the correction?

NOTE: my own case , appointment already booked and I cancelled it like 48hrs to the day.

In my opinion, if you are married in 9ja or over 21 years, with siblings who are USC or LPR you no longer qualify to be sponsored by your sibling aka 4th Preference.

Sometimes it takes up to 12 years sef before it can get approved so VO's don't usually see y'all as an immigration risk because you can't get immigrant visa via that route, especially from places like Nigeria where there is a high demand for IVs

@LagosNIV pls correct me if I'm wrong. It's the impression I have always had.

you are always qualified to be sponsored for immigrants visa by siblings irrespective of the age and marital status. Its only the time it ll take that is affected by these factors.

immediate relatives are brothers, sisters, father, mother who are permanent residents or citizens.
if you fill them on the ds-160, you wont.
maybe they have gotten it in the past and used it well, they may get it again on account of the integrity they have built
but apply now in 2016
To them, your immediate relative could file and once approved, you could adjust status, forget ties.
i wont argue much on this, wait for those 2 applicants i quoted

I got my visit visa granted few weeks ago, and yes I said I wanted to attend a function my American citizen sister ll be having in US.

It is more of your social and financial ties in Nigeria that ll give u a chance to be granted visa not weather you have a relative in us or not.

It is also true that at times it is more difficult to be granted tourist visa when you have an immediate family residing in US. But thousand of people still get their visa granted despite having American sibling living in US.

Thanks everyone. Points well noted.

My opinion, let her apply with all truthfulness. Luckily there is no where in their form that requested for if you have been deported from another country or not. ( I know both countries share criminal informations together) but if her case was not treated as a criminal case , it ll not come up in the interview. But if any question is raised in that direction, she should not hide the fact that she was once deported.

If she is upfront and truthful , deportation from another country since 2009 will not give her permanent inadmissibility to the US.

Its the confirmation on your appointment that you ll need to take along . if its the old one that is on your appointment , you ll need to call the embassy to inform them that you want them to update your form to d new form you have filled.

I really appreciate your efforts and various comment to different question. I just applied for a visiting visa and my interview will be coming up next month. Am a newbie and I want to know if travelling experience is a must to get my visa approved. My friends keeps saying I should travel to dubai to disvirgin my passport but I don't have enough money for that. I have all the documents to back my claims and the invitation letter. Thanks

A lot of people get US visa without any prior travel experience. They focus more on your family / social ties to Nigeria than weather you have travel out b4 or not.

Although previous travels could be an added advantage in some situations.

1. Course fee is refundable, so if I don't get visa I will get 90% of the money back. The only risk is the $100 visa application fee. It's worth giving a trial. I don't have a travel experience. This is my opportunity to get 1. I don't intend to stay illegal in the US. I have plans of coming back after my course and conversion of my license. It shouldn't take more than 1 month if I plan it well. If I can achieve this I will be very glad coming back because it means that I can apply for jobs outside nigeria. Lots of openings in middle-east.
2. With the current economic situation in Nigeria, I don't think hustling is my best bet. I can loose 1.5million, and start all over again.
3. I'm sure I will get more money from family and relatives if I secure visa. Just that for now, they are still skeptical about my ability to secure a visa with the plan.

Its not wise of you saying all these about your plans on a public forum. You ll not know how much damage you might be doing yourself and other genuine applicants.

oh. I didn't mean they ll not know. Fingerprints taken @ d embassy ll reveal that its the same person applying. What I just stress for him is that with 11 years in between , he can apply again and b truthful about his present and past application if asked about it.

If inconsistencies exist, the person's credibilty has been damaged and it is not a 'sure thing'.

even without inconsistencies US visa or any visa is never a sure thin.

But he should let them stop him in a future application and not him stopping himself for ever.

once he was not banned then , and there is a reasonable time past. He can always try his luck , be truthful this time , and if he got refused, he can then move on and try latter.

He shouldn't just ban himself forever if he was not actually banned by us govt .

With the experience of my friend I shared, his case is not a total hope lost.

Now am married with kids and my inlaw in USA is trying to send me an IV, although when I used the agent in 2005,all docs was forged so my fear now is Will the info I used in 2005 still be in their Database or System?

2. How about if I decide to travel to any other country, then apply for USA visa frm there, will they still have my information of 2005 application in Nigeria?
Thanks

Dear bright . 11 years is very long. b4 lying anywhere we should always think of d permanent damage it may cause.

However , it may not be bad as you think. A friend was in similar situation, agent helped him fill his form, told him not to b opened that he has a sibling in US , but just wanted to visit a family friend and he was refused visa.
Almost 10yrs after, he wanted to apply again to visit his sibling that he didn't disclosed he had previously , now with a new passport that his year of birth is different from d year on previous passport , with UK refusal stamps. He was scared. I adviced him to fill yes to have you applied b4 question, and VO not satisfied to Y he was refuse visa then. And also to be plane should the VO referred to his previous application.

As God we have it , the interview was successful with no question asked about his previous application or about the inconsistencies with the current one.

My conclusion , give it a shot where you are based. Don't try to cover up if questions are raised about your previous application. I strongly beleive that If you are truly qualified for it now , you ll be granted!

Dear Abujaniv,

Thanks once more for taking timeout to assist with valuable informations here.

My visit visa and 2 other family members(all adults)
were approved on Friday @ the Lagos embassy. I couldn't even listen effectively to the instructions on how to collect our passports back.
I was only given a generic white paper. No personal
information of us was on it. I was thinking an additional
card with our details was supposed to be attached to d
white paper.

Is the single white paper enough to claim our passports?
I ll appreacaite any information as regards avoiding going
there more than once.

Also when is the visa granted on Friday likely to be ready for collections?

Thanks.

Goodmorning all. Welldone LadyG. Please, is there any lawyer that is planning to attend IBA conference?
Does anyone know how many months visa is issued for conference?
This year's conference is BTW 18-23 September, about a week. Does US issue the normal 2year visa for conferences or just to cover the duration? Thank you.

The normal standard given to everybody is 2 years. but on a rare occasions they give out just for the duration of the intended period of visitation.
