The constitution says an aggrieved person should go to court for a pronouncement/verdict on the disqualification or otherwise of a candidate. Sorry I do not remember the section of the constitution/electoral act that says this, I will get back to later with this.

Controversial PDP gubernatorial candidate in Anambra State, Emmanuel Andy Uba suffered major legal setbacks in his forgery case before a Federal High Court in Abuja earlier today. Saharareporters learnt that as soon as the case came up before Justice Babs Kewunmi, Andy Uba's lawyers led by Wale Akoni (SAN) from the law firms of Wale Babalakin bombarded the judge with motions aimed at stalling the entire trial as they have done since the case began. Mr. Emmanuel 'Andy' Uba's lawyers filed close to five ‘motions’ aimed at stalling the case, one of which challenges the jurisdiction of the court to hear the case even though Andy and his lawyers had initially subscribed to the same court when the case was assigned to two judges by Justice Roseline Ukeje, the Chief Judge of the Federal High Court who had tried everything possible to frustrate the case administratively.



Justice Babs Kewunmi dismissed most of the objections by Andy Uba and his lawyers and fixed hearing the jurisdictional objection for Monday next week, in stark contrast to Andy's antics that called for a long adjournment, the most bizarre part of the case was INEC's spirited involvement in the case, for the first time since the forgery case was filed, INEC lawyers stormed the court and ferociously defended the candidacy of Emmanuel Andy Uba before the judge.
It will be recalled that Saharareporters did an extensive investigation on the character named Emmanuel Nnamdi "Andy" Uba especially as they pertain to his academic background and found out that Emmanuel Andy Uba did not obtain any university degrees from the universities mentioned in his CV to the Independent National Electoral Commission which was submitted on December 14 2007. Amongst other findings Emmanuel Nnamdi Uba who lived in California was found to have dubiously maintained two dates of birth December 14 and 15 in US official records.



Following Saharareporters exposee on Andy Uba, Mr. Greg Ikemefunna filed a case of perjury against Emmanuel Andy Uba asking the Federal High Court to disqualify him from the upcoming April general elections in Nigeria for making false declarations about his academic degrees and criminal record history. In particular he is seeking the powers of the court as enshrined in the Electoral Act to bar Andy Uba from running from office because he lied that he obtained a first degree in “Geology” from Concordia University, Montreal, Canada, and also perjured before a notary public that he obtained a masters degree in Geography from a California State University and also that Emmanuel Andy Uba engaged in fraud by claiming to have obtained a "Doctor of Sciences" from a fake  university known as "Buxton University" said to be based in the UK. Both Concordia University and California State University denies that Emmanuel Andy Uba obtained a degree from their university. Our research shows that "Buxton University" does not exist in the UK academic system.



He is also seeking a relief against the PDP, asking the court to fine the party 500,000 naira for knowingly fielding a candidate with fraudulent credentials.



Surprisingly, after the case went before two judges, Andy Uba lawyers are yet to file any defense in court to show cause that their client and PDP candidate posses any of the academic certificates in question, they have only relied on delay tactics and INEC chairman's , Prof. Maurice Iwu's and Justice Ukeje's help to bungle the case. Though Mrs. Roseline Ukeje has moved the case around without explanations, Prof. Maurice Iwu could not help Emmanuel Andy Uba change the INEC form he filed because Saharareporters had already obtained a copy and displayed it in the E-Library.



The next adjourned date of hearing is Monday March 26th 2007 when the presiding  judge is expected to give a definitive ruling on the issue of jurisdiction. Despite protestations from INEC lawyers that they were not properly served and motions by defendants that requested the court to stay proceedings pending the outcome of a petition by the plaintiffs against Justice Rose Ukeje whose daughter and son are in the inner circle of Mr. Emmanuel Andy Uba the hearing is expected to proceed without delay barring any further administrative intervention.

What I am trying to do by posting this list is for us to see the trend of things concrening the suppose "illegal disqualification" of Turaki Atiku Abubakar.

Remember all these cases have not gotten to the supreme court.

Attached is the list of Atiku's court victories.

THE Chairman of the Independent National Electoral Commission, Prof. Maurice Iwu, has been grinning from ear to ear that it is not INEC but the 1999 Constitution that disqualified the Vice-President, Alhaji Atiku Abubakar.

The INEC boss sought refuge under Section 137(1)(i) of the 1999 Constitution which provides thus:

“A person shall not be qualified for election to the office of President if

(i) he has been indicted for embezzlement or fraud by a Judicial Commission of Inquiry or an Administrative Panel of Inquiry or a Tribunal set up under the Tribunals of Inquiry Act, a Tribunals of Inquiry Law or any other law by the federal or state government which indictment has been accepted by the federal or state government.

The section went further down the line to state: “Any appeal against the decision is pending in any court of law in accordance with any law in force in Nigeria, subsection (1) of this section shall not apply during a period beginning from the date when such an appeal is lodged and ending on the date when the appeal is finally determined or as the case may be, the appeal lapses or is abandoned, whichever is earlier.”

The purport of the section is that though a person may be disqualified if indicted by any of the panels enumerated in Section 137(1)(i), such indictment is subject to review by a court of law including a Magistrate Court.

During the pending of such an appeal for review to the court, the indictment will remain in abeyance and unless upheld by the court, the indictment shall not be a ground for disqualification.

In the case of the Vice-President, his co-accused Otunba Oyewole Fasawe did challenge the decision of the administrative panel in the High Court and the decision has been set aside by the court of competent jurisdiction.

Since the administrative panel report has been set aside, can INEC rely on same to disqualify the candidature of Abubakar? The answer is on the negative.

Before the eyes of the law and common sense, that administrative panel report died with the decisions of the High Court of Lagos State which nullified it.

Even without the nullification of the report by the court, and so long as the report is under judicial review by a court established in accordance with any law in force in Nigeria, the disqualification section will remain inoperative.

It will be interesting to know who is actually behind the administrative panel that indicted the Vice-President. The feud between the President and his deputy became public knowledge and the President accused his deputy of certain “crime.”

The President while considering that his deputy needs to be probed, did not deem it necessary to call on the Chief Justice of Nigeria to constitute the probe panel.

Nor did the President consider appointing retired Justices of the Supreme Court or retired Court of Appeal Justices, nor elder statesmen but members of his kitchen cabinet ministers.

Ipso facto, at all material time the President was the administrative panel.

At the end of its “investigation”, the panel, though did not afford the Vice-President opportunity of fair hearing, submitted the report to the Federal Executive Council, headed by the President, the chief accuser.

And the same ministers who “investigated” the Vice-President sat with the President to adopt the report.

It is not only a case of memo judex in causa sua but a travesty of justice that offends the rule of natural justice and right thinking people.

The ministers and the President could not pretend to even go home for one week to study the report but there and then before one could spell John Bull all screamed crucify him – Atiku.

It is, therefore, this questionable report, concocted by President Obasanjo and nullified by the court that Prof. Maurice Iwu, an appointee of the President, is now relying on to disqualify the Vice-President.

Any election where the electoral body takes the mantle of disqualifying candidates presented by their political parties for election is fraudulent on its own.

No other rigging will surpass that and such election ab initio is not free and fair.

The President has therefore combined unto himself the status of executive-legislative-judicial function.

It is further an absurdity to hear the INEC boss counselling the Vice-President to proceed to court to clear himself.

In our criminal jurisprudence, the accused is presumed innocent until proven guilty. The onus of providing the guilt is therefore vested on the accuser/prosecution and it never shifts.

It is not for the Vice-President to proceed to court to clear himself but for INEC to proceed and seek that relief from the court, barring the Vice-President from contesting in the April general election.

This position is in tandem with the position expressed by both the British and American governments and other civilised Western world.

Mohammed Babangida detained, EFCC looks into Globacom and IBB’s “front investments”

Mohammed Babangida, polo player and first son of former military president Ibrahim Babangida was arrested earlier today by the Economic and Financial Crimes Commission (EFCC) from his Abuja hotel suite, sources told Saharareporters.

A source within the EFCC confirmed that his arrest was part continuation of a prolonged probe into the ownership of GLOBACOM, a telecom company owned by Mike Adenuga who was recently arrested by the EFCC.

Mohammed Babangida is alleged to posses 24% ownership in the $1.5 billion company. He had earlier been invited by the EFCC to explain how he came about the wealth used in purchasing the shares and he denied knowledge of such investments. The EFCC source said their investigation finally paid off after Mike Adenuga revealed this to the EFCC during his arrest and interrogation. Mike Adenuga had long been rumored as a front for retired General Babangida, who is unarguably one of Nigeria’s most corrupt past leaders.

Mohammed, according to our sources also owns oil blocks in Nigeria and Equatorial Guinea as well as several buildings in London even though he never held a real job his entire life.

Mohammed is married to Rahama Indimi, daughter of another IBB’s associate and front man, Alhaji Mohammed Indimi, Chairman of Oriental Energy Resources Limited which owns Oil Mining License (OML) 115 and Oil Prospecting License (OPL) 224 which covers around 61,000 acres located in shallow waters 35 miles offshore Nigeria's prolific southeastern producing area, Texas based Sovereign Oil and Gas company provides technical support to Oriental.

Sovereign's President Joseph M. Bruso, Jr. once said, "OML 115 is located in one of the richest oil tracts in the world. The block lies at the center of a 1.2 million-acre tract with over 7 billion barrels of proved oil reserves. The area produces over one million barrels of oil per day."

There is no official word from the EFCC about plan to bring charges against Mohammed Babangida. As at press time, IBB and his political associates were making frantic efforts to bail Mohammed from the EFCC in Abuja.

I have just finished installing Ubuntu Linux on my system. The Installation when went  on smoothly. After I  login in with my username and password, i was given commandline (I am expecting the graphical interface just like Redhat Linux and the live Ubuntu CD that comes in the package)..

Is there anything I might have done wrong? or what command do i need to execute to get the graphical interface?
Also I will like to know what i need to install inorder to configure this system to internet gateway for my local network.

According to a Newspaper reports, The Council for Regulation of Enginering in Nigeria (COREN) is proposing that all  Engineering Graduates from Nigeria Universities are to start  going for one year industrial Training after graduation (B4 NYSC).

Some of the questions i will like to ask are:

1. Is this necessary? Why is COREN not ensuring that engineering graduates are posted to firms where they can get the training during the NYSC year?

2. Is this not another form of cheap labour? So it will that 6years of training + 1year of NYSC to produce an engineering graduate.

3. With the current problems being faced by Medical Graduates in getting Specialist Hospitals for their  House Job, where are the willing engineering firms that will absord new engineer for the one training?

THE ISRAELI OFFENSIVE: MIGHT IS RIGHT?

Continuous conflict in the Middle-East has become routine so much that when a lull is observed it becomes an aberration. The current cycle is between Israel and Hezbollah in Lebanon with the world being treated to spectacular fire-power and determinism by the Jewish State to bury anti-Semitic thoughts of annihilating the state of Israel. Lebanon in this process is caught in the middle of the exchanges resulting in the massive destruction of infrastructure, residential houses and massacre of human lives: all a collective punitive measure for the crime of a few!

There is of course nothing new about the bad blood existing between some Arabs and the Jews. Transparently the United States has never hidden her support for Israel even when the latter's response is completely disproportionate to the causal factors as observed for this latest offensive. However morality and human conscience cannot be obfuscated by those wielding superior military machines. The will of man must speak truth to power and it must echo the truth as succinctly stated in Soyinka's classic book: "The Man Died: " … the man in him dies who keeps quiet in the face of tyranny." In essence this means that humanity dies when the world is helpless in situations of grave recklessness occasioned by hubris, self-righteousness, racial superiority and military might.

Writing this was preceded by thoughts of Israel's side-stepping of the normal modes of diplomatic niceties in situations of kidnappings, demands and ultimatums before resort to inflicting maximum damage. Has Israel exploited available channels to pressurize the Hamas and Hezbollah to hand over soldiers kidnapped? Was a report lodged at the United Nations about this provocation by the Hezbollah militias? Was the Lebanese government given adequate time to use own internal security and diplomatic machinery to secure the release of these kidnapped soldiers? Or, are there unknown factors to the observer world that are goading the Olmert government in Israel to pursue a maniacal plan to sow bitterness in the hearts of Lebanese (current and future) and other Arabs? One wonders about what happened to the wise admonition to be at peace with one's neighbors.

True, the convoluted developments in the Middle-East cannot be solely placed at the door steps of either Arabs or Israelis. They are historical, offshoots of colonialism and psychological and moral burden of World War II. The world helped in creating the problem and it is the world that must come to grips with the solution. None of the belligerent parties can win the peace except mutual trust cum adequate dosage of respect prevails in that region. As it is, these are lacking.

Definitely the semblance of peace enjoyed in the Middle-East has been shattered in the current conflict. Any subsequent ceasefire cannot erase the memory of the latest high-handed attack by Israel in Lebanon. The polarization of nation states into 'strong' and 'weak' ones has become more evident. And the implication of the latter for world peace is better imagined, especially when viewed against the background that Syria was expelled from Lebanon by a middle-class demonstration after the assassination of Rafik Hariri. This paved way for a democratic government that is barely one-year old and which is still struggling to walk the talk. Could it therefore mean that Syria was manipulated to leave Lebanon for a future Israeli occupation? Your answer is as good as mine.

A precedent is being laid. It is a signal that 'might is right', and this beckons to other nation states to massively invest in weapons of self-defense for deterrent purposes. No wonder the Korean government and other strong-willed leaders of the world are not paying attention to big brother's ranting of non-nuclear proliferation. Current flattening of Lebanese houses, knocking off bridges, massacres of innocent civilians and bombing of roads are good ammunitions in the hands of hawks in governments all over the world. Consequently, the United Nations might soon become a fire brigade outfit rather than an organization for preventing the type of diabolical recklessness observed in the current Israeli/Hezbollah conflict.

The US and British governments who hitherto enjoyed some trust in the region are apparently taking it 'cool.' This is not surprising considering the deception in which these governments took their countries to war with Iraq. Governments with moral turpitude are surely not assets to mediate in such a crisis. This was manifested at the G-8 meeting in St. Petersburg, Russia, early this week, when Bush and Blair adopted a casual disposition to the latest offensive in Lebanon by unwittingly declaring that the UN is a pawn in their geo-political chess game. The world awaits the next diplomatic shuttle by the UN Secretary-General and wish Lebanon and Israel well.

Finally, no party will gain from the outcome of this latest offensive by Israel as any success will, at best, be a pyrrhic one. The moral mathematics of the bombardments just does not add up. Peaceful co-existence in line with "do unto your neighbor as you will do unto yourself" is the answer, and not sowing seeds of hatred.

This is the second week of the war between Israel and Lebanon. I do not subscribe to the lie that it is a war between the radical extremist group Hezbollah and Israel. People may believe their eyes or buy into the propaganda of the United States and Israel. Bombs have been raining on Lebanese homes, maiming and killing the people. And Hezbollah rockets have been causing destruction to lives and property of the Israeli people. Therefore it cannot be a war between a country and group.

American politicians have again exposed themselves as gutless and hypocritical. It has become a long standing tradition of American politicians to support every action of Israel no matter how insane it may be. And this time they did not disappoint. Every politician who has been questioned by the media have expressed their undying love for Israel and absolved them of any responsibilities. The greatest disappointment has been Pres. George Bush who constantly touts his Christian values and yet finds nothing wrong in urging the world to look the other way while Israel decimates Hezbollah. The simple truth is that in the process of trying to destroy Hezbollah, many Lebanese and Israeli’s would be killed. Is it pro-life to look the other way while innocent people are killed?

Politicians in the United States of America constantly talk about America’s national interest. The so-called American national interest is often limited to oil. However, they fail to recognize that it is not always in America’s national interest to support any and every action of Israel. It would appear that there is an unwritten policy that defines Israel’s national interest as American national interest. Even then, any discerning person knows that this unwavering and wholesome support for Israeli actions and policies is motivated by the fear of the Jewish power in American politics. It is all about money and votes and Jewish lobby commands a lot of it.

The attitude of American politicians deprives the world of the sincere services of the only super power nation. The United States is incapable of being an honest broker in this conflict or any conflict involving Israel. It goes without saying that at some point there will be a ‘sit down’ between the two parties or their proxies. Who will mediate-- a biased super power or a derided and demeaned United Nations? The sooner we get to the point of talk the better chance we have of achieving some modicum of peace. But the killings have to stop now.

It must be clearly stated that the immediate cause of the current crisis in the Middle East is Hezbollah. By crossing into Israel, abducting and killing Israeli soldiers Hezbollah provoked this conflict. The world knows that Hezbollah is funded and to a large extent controlled by the duo of Iran and Syria. This calculated act of provocation by Hezbollah could not have been carried out without the tacit approval of Iran and Syria. Ironically, Hezbollah’s provocative action came barely twenty-four hours after Iran rebuffed a UN position on its nuclear program. No matter the provocation, it is hard for me to accept that the kidnap of two Israeli soldiers by the Hezbollah could be equated with the killings and destruction that has been going in both countries. This would, no doubt, sustain the cycle of violence that the Middle East has come to be known for. Given the culture of the Middle East, it is foolhardy to believe that if and when a ceasefire is declared the killings would stop. As the bombings continue in Lebanon and Israel more suicide bombers are born. Yet, the reality is that military might and prowess would not bring a solution to the Middle East crisis.

Israel is the ‘super power’ of the Middle East. The Israeli reaction to the Hezbollah provocation was predictable. Nobody, not even the Hezbollah leader, Hassan Nasrallah, believes that the radical Islamic group can defeat Israel in a military conflict. Why then did Hezbollah embark on this suicide mission? And who has benefited from the crisis? The Lebanese government was a very weak one. It is believed that the President of the country is a Syrian puppet. The current pounding by Israel would weaken the government of Prime Minister Siniiora even further. It is not hard to predict that the next elections in Lebanon would see Hezbollah become more powerful as more of its members would be elected into offices.

Certainly, Iran stands to gain from this conflict. While the world’s attention has been turned to the war between Israel and Lebanon, discussion on Iran’s nuclear ambition has been suspended. And another beneficiary has been Pres. George W. Bush. The Israel-Lebanon war has pushed Iraq off the headlines. We should expect the President’s poll numbers to start climbing as America moves towards elections in November. Could that be part of the reason the President does not want to encourage a ceasefire until more Lebanese and Israeli children have been killed?
