Please tell your lawyer to call press conference or get someone who can link you and your lawyer up with any ' oga at the top' in The Punch. If they can publish the story repeatedly in Punch, trust me, your money would be returned without much ado. If you have to follow legality per se, it may take time most especially when your wife is expecting. |

Do we have that kind of system in Nigeria or at best in Lagos? It would be a great challenge enforcing that section of the Law. |

Please break it down. Is it that you have money and you cannot find an office space in the location or you are looking for a free office space? If the former is the case then there are office spaces in the local airport, just walk to the BDC village and if you have too much money, MMA2 is the best place. You could also get partitioned spaces around Oluwaleimu, Off Toyin, Unity axis etc. Wishing you all the best. |

I quite agree with you, I mean Why pay a lawyer/professional a huge sum of money when you could do it yourself or use an in-house person? These are services you can conveniently complete online in other climes. But please let me add this; when you pay a lawyer/professional for services you can possibly do yourself, you are taking off the stress involved in that line of services off your neck. As for people in-house, lawyer use them with PR to assist in speeding up the process and not necessarily to do the work. Let us look at company registration, as a staff of CAC you are not expected to do personal work, if you do and you are caught, disciplinary measures would be taken against you and such work would probably be kept in view. Although, it is the order of the day in most government agencies but the truth is " if you are caught" you will pay dearly as it is against Civil Service Regulation. In this case, lawyers would have completed all the necessary paper work, submit/file and ask the staff member to help follow up, this applies to the TM issue as well. So please "don't get it twisted" like D'banj would say. To top it off, a professional can charge any amount for any service rendered to you as long it is separated from statutory fees. Without trying to overdo it, even if someone pays a huge/questionable sum into your account, if you can claim with documents that it is professional fees, that would be the end of such inquiry. The point here is that no Law regulates Professional fees in Nigeria, people charge based on standing and years of experience and professional fees are not subjected to inquiry. Many thanks. |

What the OP is just trying to say is that the achievements of the present government is overbloated as people are fed with pictures of projects from a few highbrow areas whereas most parts of Lagos especially on the mainland look like shanties. A lot of roads are bad, very few have been paid attention to. One road that pains me personally is the road that links Ogba to Adeniyi Jones, Ikeja. For so many years the construction that never constructs has been lingering and the state government is paying no attention.[/size]Please verify from people resident in that area, I presume workers (labour) around Acme/Ogba/Jones would have some info too. I learnt the earlier contractor was mobilised and he crossed to yonder. There is a new contractor on site now and work has reached 85% completion. You may please verify this and report to the house. @loudmedia, Please check my post in your company registration thread. SCUML has nothing do with EFCC per se, it is a creation of an Act arising from the amended anti-money laundering Act. SCUML is working under the Trade and Investment Ministry with the collaboration of CBN, who in turn issues a regulation that no Designated Non- Financial Institutions shall open or maintain a bank account until such DFNI produces a certificate of registration from SCUML. In compliance with CBN directive, banks began implementation of the SCUML certificate of registration on February 1, 2013. The part that relates to EFCC is that banks are mandated to report any transaction above N10m to the EFCC. This one is not new, any banker or anyone who has been involved in heavy money transaction in bank would attest that this particular regulation has been in existence for years. Your picture would be taken, information about you and the transaction would be sent to NFIU which was an arm of EFCC or so. It used to be N5m on individual, N10m on corporate organizations and foreign transfer above 10k USD per day. Also, since the anti- money laundering law is an Act of National Assembly, it is expected that any violation thereof shall be prosecuted by the EFCC. |

Getting the Customs Licence for Clearing and Forwarding is not that easy or simple because it involves some process before you can be issued Nigeria Customs licence agent.This will cost you money because your statement of account,CAC certificate will be requested for during the process. I do need the account as i intend to use it as a savings pot for when i eventually relocate to nigeria. its just frustrating that the banking system is designed to be difficult for account opening.Hi, You need to understand that our banks are doing well but not at the rate commensurable with banks out there. If you are genuinely planning to open a savings account in Nigeria without necessarily flying in, I think it is possible. You can open a savings account through a 3rd party, it could be your lawyer or relative. Just fill all the forms, attach utility bill of a Nigerian address and the opening balance, passport photograph, your Nigerian Id etc. It is done. You can now begin to transfer money into your account from wherever you are. I think it would be easier with Gt Bank. |

SCUML (Special Unit Against Money Laundering) is a unit carrying into force a regulation by CBN introduced last year to check money laundering. It is in collaboration with the Ministry of Trade and Investment, I think Ministry of Commerce is involved too. It is required of non- financial institutions to get certificate of registration with them before account opening, existing account holder under these category are not exempted. Although, it is observed that the regulation was targeted at real estate, looking at the billions that exchange hands in that sectors without any formal regulation but the collaborator agencies have said that it is to prevent money laundering in non-financial institutions. Non- financial institutions according to them are; law firms, real estate firms, hospitals, architectural firms, accounting firms, private businesses etc. The regulation formally commenced in February 2013. The registration is in addition to TIN which is a collaboration between CBN and FIRS. For easy of accessiblity, I think they have desks inside CAC. I have seen their desk in CAC Lagos. Apart from these, banks are also to report any transaction above N10m to EFCC, it used to be NIFU. So many agencies. hmm. |
@iphie25 Many thanks for the apt observation. Many people go to government agencies' website and begin to paste the content here or advise users to go try them out. It may work out there but in Nigeria it doesn't work that way. @@arbitrage There are one thousand and one agencies that a foreigner would have to satisfy before he/she can commence business in Nigeria. As a foreigner, you don't want to heed all those stuffs of 48 hours, trust me. What you need to do is to instruct a lawyer or other CAC accredited agents. Generally, as a foreigner, you will have cause to deal with Corporate Affairs Commission, Federal Inland Revenue Service, Nigerian Investment Promotion Council, Nigerian Immigration Service, Ministry of Internal Affairs, in addition to these, if you are involved in Technology, you will need permit from Notap's office for technology transfer, if you are involved in Telecoms, you know NCC is a must for you, if you are involved in oil and gas, DPR is a must, if you are involved in consumable/drug NAFDAC is a must, other products, you must register with SON through intertek. If you would need to bring in capital/ repatriate funds like MTN, you must register with CBN, if you want to go into shipping, you cannot do without NIMASA and so on. The 'good'side of it is that all these registrations (about 90%) must be done before you commence business in Nigeria. Now back to CAC, to commence business in Nigeria as a foreigner, your minimum share capital is 10 million, that also depends on who is registering for you. Noteworthy is the fact that, CAC would not register a foreign company without having met the expatriate quota requirement, although, NIPC says it has a desk where some of these requirements are accelerated. Also, if you are going into shipping, 25 million share capital, aviation- 500 million share capital for domestic and 1b share capital for international. There is also the issue of Form CAC 4 which is meant to be signed on oath by lawyers or accredited agents of CAC. In the light of the above, may I humbly inform you that what you read and regurgitated above may not be feasible. Many thanks. |

Documents are available for scrutiny.Please endeavour to read very well whatever is before you so as to avoid putting pen to paper when in actual fact, such document is against your interest. The original poster posted list of tank farms with the least going for about N10b- all for sale. I exclaimed for being unable to find any lower than that or at least for N4b. In those days, we used to squeeze in names of minors as directors. But as early as January this year, CAC has devised a new rules by asking for directors to submit means of identification (national ID, drivers' licence, international passport and lately voters ID). As for your wife, a foreigner, you know by marriage, your wife should become a Nigerian and so She would not be addressed as a foreigner. @ poster, Topsy1971 is correct. Although, I have been involved in transaction like this and the lawyers on the other side relied on customary law to transfer interest in the land of a deceased (the Supreme Court has in plethora of authorities held that you cannot do so without a will or letter of administration but some lawyers still look for loopholes to support their activities in this area). I will therefore advise that the siblings resident in the property should be vigilant. If the effort to sell persist, they should approach the court. |
