US man wants value of kidney in divorce settlement

New York doctor donated kidney to wife in 2001 and is now demanding an estimated $1.5m, attorney says

Now that Dawnell Batista has filed for a divorce, Richard Batista wants his kidney back as part of his settlement demand. Or, Barbara said today, his client wants the value of that kidney: An estimated $1.5m (£993,000).

The case is being heard in Supreme Court in Mineola, New York.

Barbara said his client, a 49-year-old doctor from Ronkonkoma who graduated from Cornell University Medical School in 1995, married Dawnell Batista on August 31 1990. The couple had three children, now ages 14, 11 and 8.

After she had two failed transplants, Barbara said, his client donated a kidney to his wife in an operation that took place at the University of Minnesota Medical Centre on June 18 2001. Richard Batista said his marriage at the time was on the rocks because of the strain of his wife's medical issues.

"My first priority was to save her life," Batista said at a news conference in Garden City. "The second bonus was to turn the marriage around."

Dawnell Batista, 44, of Massapequa, filed for divorce in July 2005, Barbara said.


Medical ethicists agreed that[b] the case is a non-starter.[/b] Asked how likely it would be for the doctor to either get his kidney back or get money for it, Arthur Caplan at the University of Pennsylvania's Centre for Bioethics, put it as "somewhere between[b] impossible and completely impossible".

First and foremost, said Robert Veatch, a medical ethicist at Georgetown University's Kennedy Institute of Ethics, "it's illegal for an organ to be exchanged for anything of value". Organs in the US may not be bought or sold. Donating an organ is a gift and legally "when you give something, you can't get it back", he said.

"It's her kidney now and ,  taking the kidney out would mean she would have to go on dialysis or it would kill her," Veatch said.

Nor can you assign a subsequent monetary value to an organ, Caplan said. "There's nothing later [you can get] in terms of compensation if you regret your gift," he said.

What's more, no reputable surgeon would perform such a transplant and no court could compel a person to undergo an operation, he said.

I think its a cultural thing in nigeria for a lady to fully depend on a guy for everything including buying inner clothes small stuff like credit cards and worse still phones!! Otherwise we wont be reading what we read everyday about golddigging.

You know av been on this forum and I have come to one conclusion. Majority of 'nigerian men' either fear or detest classy or women who have the muscle to bring food home. I read a thread asking if a man would be scared of approaching a lady with a car.I couldnt believe it.
I seriously don't know what the problem is with the working class ladies there.Do they pose a challenge? and if so what challenge?
Everyday a thread opens saying nigerian women are gold diggers and all that. And I wonder,is there NO single working class nigerian lady who is not a gold digger? is there no lady that pays her own bills,drives her car,without depending on a man for maintanance? Really? is there none at all?
Is it a society problem that makes it criminal for a woman to be self reliant? do you get ostracised if you fail to depend on the man?
It shocks me to read about small things like recharge,meals etc when I know that some single ladies take care of bigger stuff like rent,food,clothings etc without relying on any man. And they have very stable relationships as well because its a matter of 50/50.
Seems like having no money as a lady in nigeria is a problem and having it is even worse problem! so what do u expect your ladies to be??
I think the men there are contributing to this menace.
Its almost law that for a guy to get a lady he must buy recharge cards,meals,clothes balablabla.
If I came to nigeria and I refuse all those things then will I be considered abnormal? What if I turn tables and I decide to buy the guy the cards and fuel his vehicle,pay for meals and pay the hotel for 2 days while he pays for 2? Will I still qualify to be called a lady?

American humour is right on your face.The british humour is more thinking as you have to read between the lines to understand what they mean
Look at how the british behave in restuarants.They will not complain even if served with bad food. Reason, they don't want to create a scene.

The reason its hard to make friends with the british is cz they are quiet and love to keep to themselves.
Funny enough they are more polite than the americans. Its easier to hear a 'thank you or 'am sorry' from the british than the american.

They both have their good and bad sides.They compliment each other.

Lol there's also this one called 'God on trial'.Same Nazi story. The reason I said americans are easy to chat with is cz they are obvious,loud and easy going. Their jokes are clear no irony.They are also flexible.
The british tend to have a sarcastic undertone which is dark and cold.
I think its cz they are more cultured and reserved than the americans.

Try making a crude joke infront of an english dude then try the same infront of the american. Diffrent reactions.The former may slap you while the american will laugh it off.
I am comfortable among easy going ppl.
