The new Electoral Act conforms that pre-election will only come through Sections 29(5) and 84(14). In both situations, only an aspirant has that locus, unless they say otherwise on Friday.
Issues of disqualifications are pre-election matters: Shettima's double nomination does not touch on the Constitutional Eligibility Requirements of his Candidacy. It's a product of the Electoral Act and pre-election.
Issues of forgery, citizenship and so might be looked into at the PEPT not double nomination which is wholly pre-election.
A collective reading into Abdulrauf Abdulkadir Modibbo v. Mustapha Usman, APC v. Aliyu Suleiman Lere; our Courts classified the following issues as Pre-Election.
nomination of a candidate double nomination of a candidate disqualification of a candidate wrongful substitution of a successful candidate’s name by INEC complaints about the conduct of primaries false declaration on oath about particulars of a candidate.
In all of these, none touches on items in the CFRN.
I believe it is clearly a pre-election matter. In a nutshell, Tinubu's false declaration suit as well as Shettima's double nomination are merely academic before the tribunal (to my understanding). The bolded was what I thought as well. Because with Atiku’s declaration would come a new cause of action which aggrieved parties would have 21 days again to seek redress. On who can sue a candidate for double nomination or wrong substitution by a party, I think when still a pre-election matter, only fellow aspirants in same party has the locus to sue. But once elections are conducted, fellow candidates in the election are then conferred with locus to challenge the entire process leading to the emergence of such candidate in the election. But let’s see what the Supreme Court will say. Though I am not expecting the Supreme Court to void Tinubu’s candidacy. But one thing we always overlook is that if we are talking about bribing judges, Atiku equally has enough financial war chest to pay judges double of whatever Tinubu can offer. At the end, their Honourable Justices will just have to do justice in the best way they dim fit. |

There seems to be no no rest for the ‘president elect’ as just as news is filtering in that the Supreme Court has fixed May 26 to give judgment on the double nomination suit challenging his qualification for the just concluded elections, another court, a Federal High Court, will on Tuesday hear a perjury suit filed against him which is equally seeking his disqualification and the halting of May 29th inauguration. Federal High Court Sitting in Abuja will on Tuesday hear suit by concerned Nigerians seeking to halt the scheduled swearing-in of All Progressives Congress (APC) Presidential Candidate, Asiwaju Bola Tinubu, as Nigeria’s new President on May 29 for lying on oath.
This is even as another Federal High Court will consider suit seeking to declare that Independent National Electoral Commission (INEC) failed to comply with electoral laws in the Feb. 25 presidential election.
While the suit on perjury against Tinubu’ will be held in Court 9, the second suit is requesting from Court to declare that INEC failed to comply with Electoral Laws during Presidential Election will be heard in Court 5.
Fidelity Leaderboard In the suit on Perjury, Concerned Nigerians had in a motion ex-parte filed last week alongside the suit marked FHC/ABJ/C5/567/2023 alleged that Tinubu, who was declared President-elect by the Independent National Electoral Commission (INEC), lied on oath about his possession of a Guinean Passport.
The concerned Nigerians who filed the suit are Praise Ilemona Isaiah, Pastor Paul Isaac Ausu and Dr Anongu Moses.
The defendants are the President of Federal Republic of Nigeria, Bola Tinubu, All Progressives Congress, Attorney-General of the Federation, Director-General of the Department of State Service, Inspector General of Police, and Independent National Electoral Commission.
The concerned Nigerians are seeking an order of the court to nullify Tinubu’s candidacy in the February 25 presidential election.
They are also seeking an order restraining President of the Federal Republic of Nigeria from swearing-in Tinubu.
The litigants are making the following demands:
“A DECLARATION that the deliberate, wilful and false information deposed to by the 2nd defendant in FORM EC9 of the 7th defendant wherein he stated that he is a not a citizen of another country apart from Nigeria, contrary to the fact that he is also a citizen of The Republic of Guinea, is a criminal offense capable of preventing the 2nd defendant from being sworn in as the President of the Federal Republic of Nigeria.
“AN ORDER of this Honourable Court nullifying the candidacy of the 2nd defendant as fielded by the 3rd defendant as its political party flag bearer for the presidential election of the 25th of February 2023.

IGBOGENE27: In that situation, either the petitioner will be asked to amend his petition to make Atiku & INEC, the Respondent based on the Judgement, or APC & Tinubu's name would be struck out, leaving out only INEC as a Respondent. But, the 1st option is imminent, in the circumstance.
However, I doubt the possibility of SC sacking Tinubu and APC, based on Shettima's double nomination. My reason is that, since it was brought as a pre-election matter, PDP, does not have the locus standi to institute the action. They should have waited till after election, to bring it by way of post election matter. Should the suit be dismissed for lack of locus standi, Shettima will still have to battle double nomination at the post election matters before the PEPT, where the court will decide it on the merit. Shettima's double nomination is disqualification ASAP but does the Atiku/PDP have the jurisdiction?
In the old Electoral Act, it is any person but not so in the new Electoral Act. Yeah, I know that once the Supreme Court resolves the case in favour of Tinubu then the double nomination leg of Obi’s petition will automatically be struck out. Since the plaintiffs already lost at FHC and Appeal Court, I don’t see SC ruling anything different; more so when it’s against Tinubu. |
