Failure to obey court orders in an open invitation to lawlessness and by the party's constitution once the chairman is removed the next inline is the deputy national chairman and unless the whole executive committee is disbanded by the NEC you can't just jump the deputy national chairman and appoint the secretary , treasurer or just anybody as the acting chairman while the deputy national chairman is still in office . It's like appointing the Senate President as the acting president while the vice president is still on seat

There is no proof they signed for any meeting. NEC meeting can be conveyed by two-thirds majority of Party members or stakeholders.

Almost all the State Chairmen were in that meeting. The NLC and TUC are from the LP Constitution, one of the tripods holding the Party so they are not just stakeholders but MAJOR STAKEHOLDERS and they were fully represented in the meeting. INEC was fully represented as well.

Abure and Umar were absent in that meeting intentionally, so who will prove they called for a meeting. That meeting is past 14 days and nobody has challenged it in Court so anyone who does now has slept on his or her own rights.

Deputy National Chairman Comrade Ladi lliya and Dep. National Secretary Prince Kennedy Ahanotu have been handling the correspondences.

And it is the fact that one of the grounds of Atiku’s petition is that Tinubu did not score 25% in the FCT for which he asked the court to declare Tinubu’s declaration a nullity. But on the same breath, he’s asking the court to declare him the validly elected person from the election while also not scoring 25% in the FCT.

They don't want to call out the judge for bias otherwise if they do, he will recuse himself and send the case file back to the FCT High Court CJ, but you don't know when it will be assigned to another Judge yet the subsisting order of restraining Abure has not been vacated.


The Appeal Court cannot vacate the order suspending Abure because this is an interlocutory appeal (an appeal to a higher Court against an aspect of its ruling, whilst the substantive matter has not yet to be ruled upon).

Again, in interlocutory appeals, the higher Court does not touch the subject matter so as not to sit on a case that is not brought before the Court. The only reason the Court will strike off the suit is if they uphold the preliminary objections, every other thing becomes academic.

What Abure is going to challenge at the Appeal Court is jurisdictional and not the substantive matter which Justice Muazu hasn't touched. So, he cannot go there to tell the Appeal Court that he should be restored as Chairman, it is when the Court uphold the objections, they can dismiss the suit but don't forget the allegations are that of forging Court documents, that's a Capital Offence.

The allegations are weighty; The claimants submitted Certified True Copy (CTC) of the police report, CTC of the letter by the Chief Registrar of the FCT High Court disclaiming documents bandied by the 4 Officers (all these are allegations though)!

I have not seen the objections, can't decipher where it might go.

The reason I said Abure could be sacrificed in the end.


Apapa cannot hold a National Convention today, INEC will not attend..... As long as NEC has spoken, his case is as dead as DODO. The only thing he might do now is throw money around to have allies even within the Abure Camp, pending a Convention.

It is not a pre-election matter so there is no hurry to settle same. Uche Secondus matter at the SC has not been decided till date.

LP & Abure have said they will be challenging the High Court's attempt to assume jurisdiction on a case they believe should be dismissed.

Now, this I believe will be an interlocutory appeal. You don't know if the Appeal Court will assume jurisdiction per CA Act or they will rule and take back to the lower Court or same will be challenged at the Apex Court, it is indeed a lengthy process especially when there 'assumably' unseen hands.

I think what Abure’s men want to do is to help Apapa lengthen the process since he wants to fight.

At the Appeal Court I believe their first prayer would be for the Appeal Court to vacate the order suspending Abure as officer of Labour Party pending the determination of the suit (Apapa men’s tactics at the High Court). Now, by virtue of the case being on Appeal, the High Court will be forced to adjourn the case until Appeal Court rules. Hopefully, Appeal Court will go in Abure’s favour.

If it doesn’t, then the Apex court is next while LP NEC will also insist Abure is chair.

It's safe to say that the NEC is in-charge. I know Ladi Iliya (the former NASU dogged comrade) is still one of the Deputy National Chairmen there.

It doesn't matter to INEC or the Courts as long as there is no leadership vacuum.

I believe Abure will be quietly sacrificed and the NEC will appoint someone (though loyal to his faction) in his stead in acting Capacity, pending Convention! The matter against him is a criminal matter and this type of cases linger.

However, he still can return but the chances are slim.

3 Justices of the Supreme Court, in their wisdom, ruled that it has been an established tradition of the court that Criminal Proceedings cannot be initiated through Originating Summons. But Apapa guys initiated their criminal proceedings through Originating Summon and the judge is still entertaining the case in defiance to Supreme Court precedence.

Then about the leadership of the party, the court that suspended Abure didn’t declare Apapa the party chairman. Apapa declared himself against party constitution and processes. Labour Party reserves the right to choose who their leader is even if it means going against court order. The worst outcome would be that they’d suffer the consequences later.

What started out as a minor distraction in the Labour Party leadership is snowballing into something unintended all thanks to the press.

But what is really the true state of affairs? Who is the authentic chairman of Labour Party right now?

To help our understanding of the situation, let’s take this analogy.

There are processes to everything in life.

Osinbajo is the Vice President, and the next in line to the office of the President of the Federal Republic of Nigeria; in fact, it’s his unopposed right.

But if by this evening Buhari can no longer be found, can Osinbajo just wake up and declare himself President because he’s next to Buhari? The answer is a big no.

Osinbajo must wait for some legal encumbrances, like the president not transmitting power to him while he was traveling, to be cleared first. In this case, the senate might have to invoke the Doctrine of Necessity like they did under Jonathan.

After that is done with, then Osinbajo must wait for the Chief Justice of the Federation to swear him in as President before he can now start laying claim to anything.

It is the same thing with this Labour Party leadership tussle.

After court asked Abure to step aside, the next thing to do would have been to call a NEC meeting of the party where the party will decide to either obey or disobey the ruling depending on their interpretation of the legal implication of the ruling.

Now, if they decide to obey the ruling, it is still NEC of Labour that would choose or rectify new leadership for the party pending the determination of the case in court. This never happened.

Apapa and co just barged into the Labour National Secretariat and declared themselves the new leaders of the party without recourse to NEC or any constitutional process.

Compare it to Osinbajo holding a press conference to declare himself president without being sworn in, because Buhari can no longer be found. You know the consequences. It’s treason.

It was the season of MKO Abiola who declared himself President after the 1993 election was annulled. We all know how he ended.

So, in life there are processes that must be followed before one can legitimately lay claim to anything.

As of today, Apapa is a meddlesome interloper, an irritant in the Labour Party that would soon be consigned into oblivion never to be reckoned with forever until his end on earth; he and his co travelers.
