There are processes to everything in life.

Osinbajo is the Vice President, and the next in line to the office of the President of the Federal Republic of Nigeria; in fact, it’s his unopposed right.

But if by this evening Buhari can no longer be found, can Osinbajo just wake up and declare himself President because he’s next to Buhari? The answer is a big no.

Osinbajo must wait for some legal encumbrances, like the president not transmitting power to him while he was traveling, to be cleared first. In this case, the senate might have to invoke the Doctrine of Necessity like they did under Jonathan.

After that is done with, then Osinbajo must wait for the Chief Justice of the Federation to swear him in as President before he can now start laying claim to anything.

It is the same thing with this Labour Party leadership tussle.

After court asked Abure to step aside, the next thing to do would have been to call a NEC meeting of the party where the party will decide to either obey or disobey the ruling depending on their interpretation of the legal implication of the ruling.

Now, if they decide to obey the judgment, it is still NEC that would choose or rectify new leadership for the party pending the determination of the case in court.

But Apapa and co smokers thought they are in a Banana Republic where they can walk into an organization and declare themselves anything they like.

And to think that Tinubu boys are clapping him on is what is most cringeworthy.

But it won’t be long before Lamidi Apapa and his boys will go into oblivion never to be remembered again.

An Independent Review of the Independent National Electoral Commission (INEC) iREV’s portal commissioned by Reportera News has exposed the extensive electoral fraud that occured in the last presidential election.

*The February 25th 2023 presidential election has been described by Nigerian citizens, political commentators, & International Observers as the worst election in the nation’s history.

* It’s 2 months after the flawed polls, more evidence have been outpouring to further expose the travesty that was administered to Nigerians by INEC’s Huncho, Professor Mahmood Yakubu in the guise of an election.

*This is the 1st part in a series of investigative reports conducted by Reportera News to unravel the electoral fraud perpetuated by INEC.

*The European Union (EU) and other foreign observers scored the election below par.


Most Nigerians Feel Peter Obi Won The Election.

Nigerians woke up to the News of the declaration of APC’s Bola Ahmed Tinubu as the winner of the flawed polls, thus returned ‘president-elect’, a decision largely seen as controversial, with many calling for the annulment of the decision because of the irregularities and inconsistencies of the election results uploaded on their results portal, iREV. The former Lagos governor was clandestinely declared winner by 4:03am when most Nigerians would have been asleep, an action that has called for the arrest and prosecution of the INEC boss who failed to follow the guidelines established by the newly reformed Electoral Act of 2022.

Reportera News commissioned an Independent Review of the iREV portal immediately after the polls amidst heavy criticisms from voters across the country over the inconsistencies in the results as a significant sum of the results varied greatly from what was announced at the various Polling Units, this is apart from the many recorded incidents of violence and voter suppression against a particular political party. We reviewed the results of the 36 states & the FCT for the presidential election and found out that the outcome of this election would have been totally different had INEC followed due process.

Something interesting was discovered by our researchers within minutes of analysing the data on the portal; massive incidents of mutilated results, alteration of figures, and reallocation of votes from Labour Party (LP) to All Progressives Congress (APC) and People’s Democratic Party (PDP), this was indeed a ‘sight not to behold’. Our analysts swung into action using every available means to decrypt and obtain the correct & original figures on the sheets before they were mutilated, after which they were collated. The major beneficiary of this scheme is the ruling party, APC which in one particular incident allocated as much as over 60% of LP’s votes to themselves. The victims; Peter Obi and LP were stripped of victory in 4 states which would have brought the total number of states they won to 16, not 12 initially announced by INEC.

In addition to these 12 states; Abia, Enugu, Anambra, Ebonyi, Imo, Edo, Plateau, FCT, Delta, Crossriver, Lagos, Nasarawa, LP scored majority of the votes in Taraba, Rivers, Bayelsa, and Benue states.


Peter Obi Scored The Highest Number Of Valid Votes In 16 States.

Majority of Nigerians feel that Peter Obi won the elections, the atmosphere in the country following Tinubu’s emergence as ‘president-elect’ was that of sadness and mourning, it was enough to conclude that this wasn’t the man that the people voted for.

1 BVAS machines or CTC copies must be attached to the BVAS report.APC used in its petition Since there is no evidence of presentation of BVAS machines the Apex court did not accept APC appeals.

2 The SC held that results recorded on forms EC8 at the poling units should be used to prove overvoting not those snapped or downloaded at the IREV of INEC. . APC did not use EC8 from the polling units. SC strucked the case out
3. The SC held that voters register must also be used to prove overvoting. APC did not use Voter registers. Only BVAS reports and IREV were used . The SC strucked the petition out.
In my opinion :
1.The SC discredited the APC case on overvoting with the technicalities by placing emphasis on BVAS machines or CTC copies as a condition to accept BVAS report.
2 The SC placed emphasis on EC8 forms from the source not snapped or downloaded copies.
3 As for voters registers, ,is it not posinle to have 250 accredited on the registers while 100 will be on the BVAS report? Yes
That is why INEC placed emphasis on BVAS reports to electronically auntheticate accreditation. The SC concluded otherwise.
4. With this judgement of the SC on Oyetola and Adeleke , Obi and Atiku should forget thier.cases because neither of them fronloaded all the conditions defined and required by the SC in their pettitions.
Perhaps Oyetola was as used as sacrifice to legally BAT victory and as an ambush against the oppossers of BAT.

I think we will get more clarity when we see the full judgment.

But one thing is that the apex court did not invalidate the BVAS nor the IREV.

Looking at the constitution section 134,it is divided into A and B
A) a candidate must score the highest votes
B) he must get two third in 36 states and fct.

A simple understanding of the constitution or the interpretation act will reveal that two conditions are needed that is A and B.if fct was to be mandatory,subsection c would have been added or under subsection B,they would have added an additional clause or condition with a comma.in atiku's petition,he funnily added fct as the C part.I believe this should settle that matter...

Now the elections are over and attention has shifted to the different Election Petition Tribunals across the country, it is not out of place that we understand and try to make sense, to the best of our knowledge, the issues at play at the tribunals, and what to expect even though we do not know what to expect.

In this thread, I want us to consider INEC Guidelines and how much weight they carry in determining what the judges might say about the different cases before them.

It became imperative to talk about INEC Guidelines because different elements seem to have held different positions as to the relevance, power and place of INEC Guidelines as regards the different petitions in court.

Now, for explication purposes, we need to understand that the judges at the different tribunals, are going to rely on four documents to arrive at whatever ruling about any case as regards any Election Petition. These documents are:-

1) The Constitution
2) The Electoral Act
3) INEC Guidelines and
4) Judicial Precedents (of the Supreme Court in most cases).

1)They are going to rely on the constitution because it is the grund norm of all other laws in Nigeria and the document whence INEC derived its powers.

2)The Electoral Act derived its powers from the constitution and is a body of laws guiding the conduct of elections in Nigeria.

3) INEC Guidelines (this is our topic of interest): Now, the constitution that established INEC, gave it the power to formulate rules and principles/guidelines that would guide every season of electoral contest. These are called “bye laws” if you please. Now, INEC being an umpire which is supposed to be unbiased is envisaged by the constitution to issue these guidelines to parties and candidates informing them of the modalities and the rules that will guide the conduct of the election without prejudice to the constitution and the Electoral Act. What this means is that INEC has no powers or whatsoever to initiate any guideline that would be at variance with either the provision of the constitution or that of the Electoral Act. Any such act would amount to nullity.

Now, are INEC guidelines justiceable in law? Can a candidate or candidates approach the tribunal on the basis of INEC failing to adhere to its own guidelines? To that I leave us the video of Michael Aandokaa, Former Minister for Justice and Attorney General of the Federation, where he explained that the Supreme Court has ruled in previous cases that INEC guidelines have constitutional flavour.

What this means is that since INEC is an establishment of the constitution and exercises powers granted to it by the constitution, whatever guidelines they issue is enforceable in law as they can equally be taken as law.

4) Lastly, Judicial Precedents. This is how (superior) courts have decided electoral matters before which is usually binding on lower courts, in most cases, especially if the facts of the matter are the same. What this means is that the Governorship Petition Tribunal for instance cannot give a ruling that totally deviates from what the Supreme Court has previously ruled about a similar case with similar circumstances.

In conclusion, the aim of this piece is to educate those who are making arguments that tend to suggest that INEC failing to adhere to its own guidelines is without consequences.

Again, nowhere in the world does an umpire change the rule of the game in the middle of the game. And worst still without communicating such change to contestants in the game.

The referee in a football match cannot come into the game and say that because he has the final say in the outcome of the match, that there was technical glitches and VAR will not be functioning, therefore he has the right to decide that throwings are corner kicks and vice versa.

Once INEC set the guidelines for the election and communicated same to parties and candidates and the general public, it became binding on them to follow those guidelines to the letter. And any default thereof becomes fatal on the outcome of the election unless otherwise proven.

Again, you don't need the primaries source if there is no disparity in the secondary source among the political parties. Accreditation data will also be compared with NASS, it was same accreditation

Between the Bvas and Irev, which is the primary source adopted by the tribunal to adjudicate

Adeleke won because APC/Oyetola suddenly have no evidence to present before the supreme court wink

Can Peter Obi shift the court lens from the primary source to secondary source as IREV .. time will educate us all
The facts and matters of the Osun case and the Presidential petition are very very different.

While Oyetola’s mean argument in court was over voting, Obi and Atiku are not alleging over voting but manipulation of results. These two things are different and the judges are going to decide the petition on its merit.

So, don’t give yourself hope with Osun ruling.

The only thing left to harvest information from is the INEC server. Something which seems like a secondary source to INEC going by Adeleke's case. INEC wont entertain anything else except from BVAS itself.

You see that BVAS, if you like format it or flash it, there are experts who can still extract every information that has ever passed through it since the date it was activated. In this case we are even talking about mere reconfiguration. So you thought reconfiguration wiped out the data of the presidential election stored in the BVAS? Lol.

Do you know what BVAS is? Do you know the meaning of extraction? How do you think it’s possible to extract from a soft ware? Don’t you know software is what’s inside BVAS? The online result on Inec portal, you think it’s BVAS transmitting them?

This is why the English is inspection. The only thing they inspected was BVAS color, plug, how they do turn on likely cuz that’s what you can inspect! All the physical parts! Abi, can you unscrew the machine?
Have you not heard of Certified True Copies of BVAS data issued to parties by INEC? Or you think that is useless?
