The question here is how should a non-compete clause be drafted to ensure that it is enforceable?
In Aprofim Engineering Nigeria Limited v Bigouret & Anor (2015) and in the case of Andreas. I. Koumolis v Leventis Motors Limited (1973 SC 250/1971 the arguments had been made that restrictive covenants constitute an affront to section 17 (3) (a) and (e) of the 1999 Constitution (as amended) hence, any agreement that is considered as an excessive restraint or unreasonable in nature will not be entertained by the court.
It is therefore important that HR practitioners take note of the following when including a non-compete clause in a contract of employment or when drafting separate restrictive covenants.
1. Such agreement must not be overly broad otherwise it will be difficult to enforce. It must be specific and well defined. I was posted to an NGO for my service year in February, they got me a house without pay. In April we had a project on HIV and AIDS and I was paid 20k. Ever since, I just go to work and sit down from morning 8am till 5pm doing nothing, I started and finished Game of Thrones from 1 to 7.
Before I was posted in camp I always dreamt of teaching in a secondary school, because that's were my passion is and, I have an ambition of being a lecturer.
Now, I recently saw a school were I can teach for twice in a week, but my current ppa closes by 5pm, which means I only have my cds on Wednesday free to teach, I have taught twice, and I really love it and want to continue.
The problem is how do I tell my Director at my NGO that I want to leave? He has been good and nice to me and they rely on me to do a lot of clerical work in the office, but inside of me I'm not fulfilled and don't have time for myself.
Its 6 months into my service and I'm not feeling like I'm impacting any live or my community.
I want to summit my resignation letter by the end of the month, and focus on my students especially in economics and accounting, if I leave I will also leave their accommodation, that means I will be coming twice a week from my uncle's house which is far (N500) daily to the school.
I've been praying about this for a month now, and even discussed it with my mum with her giving me her blessings to leave, today my Director during a meeting said teaching profession is the best ever, I was wondering if that's a sign, and I'm also planning on visiting my grandma in August when schools are on break, an opportunity my NGO won't give me.

perrychemical: I am one of the PTDF Scholars in France, studying in one of the Grande ecoles . From my experience from the PTDF Scholarship. The fact that PTDF has recommended you implied that you have gotten the scholarship.
I will however clarified something for you people, it was not as if DAAD will be the one funding your scholarship, it is still the PTDF funding the scholarship, they are just trying to harmonise the scholarship for greater efficiency and also to reduce cost, without compromising on quality.
I was supposed to go to Germany, I missed out when we were asked to upload the document on DAAD website, because it was not properly coordinated during our own time, even though I got admission to TU Berlin. DAAD could not do anything again regarding my visa, that was the reason why I came to France in order not to waste another year.
So congratulation to all the shortlisted, if you are not been follow from the village, those that got the e mail are the successful one from the Germany point of view.
Those coming to France , I think will also be updated.

I do supply of diesel and other products to a company here in Port Harcourt. They always paid within one or two weeks.After my mother's burial last year ,I didn't have enough cash to execute the supply they gave me because i sponsored the burial as the first son. So I borrowed some cash from a friend.
That was the beginning of my wahala. The company's manager and some workers defrauded the owner that hardly lives in Nigeria. So my payment was delayed and I explained everything to my friend. That I even invested all my little savings to that supply and that I'm even finding it difficult to feed my family.
Around February this year I went to Cross River state to buy chippings for someone and I spent about two days there because of truck problems. So my phone battery was down and even my wife was not able to reach me. To my greatest surprise, this my friend went to my church and I told my pastor that defrauded him.That I have even packed out of my house and switched off my phone. Meanwhile he knows my place and he didn't even bother to go and ask my wife where I went to since my number wasn't going through. When the pastor told me things he said, I couldn't believe it (infact I was shocked). I called my friend and he initially denied meeting my pastor.
The pastor scheduled a meeting for us to meet and sort things out but the guy refused to show up. I have tried to sell my own share of my inheritance to pay him his money but I have not been able to see a serious buyer due to the location of the property.
The problem is that this guy is calling everybody that I know and even going to Facebook to contact my friends that I defrauded him. I have asked him to give me time but he said I must come to somewhere outside port Harcourt town with my wife before he will negotiate anything with me. I cannot allow anybody to ridicule my marriage because of debt. I told him I won't involve my wife in that kind of arrangement. He calls me every morning and night and sometimes i just feel like ignoring his calls because i know it's same talk everytime.The company is currently not operating but the chairman has agreed to pay me soon. How do I handle this mess because this guy is ruining my reputation and it's tearing my marriage apart. If you have experienced this before, please I need your advice urgently because I'm going insane. My response will be Christianity based. 1. A lot of things happen at burials, show off of wealth often attract envy and bewitchment. 2. Friends can be diabolical and their wealth can come from an evil source. Have you taken this issue to God in prayers, have you fasted? Has your pastor joined you in prayers? I will advice you go for Three-day deliverance session at MFM Rumuola.
