OSHIOMHOLE: THE TRUE PICTURE OF HIS CASE IN THE EYES OF THE LAW.

Sometime around November 2019,Oshiomhole was suspended in his ward as an APC member. He was accused of trying to disintegrate the party in Edo State,hence the suspension.
Recall that one Oluwale Afolabi had instituted a substantive suit against Oshiomhole before a Federal High court sitting in Abuja. In the substantive suit, Oluwale is praying the court to remove Oshiomhole as the national chairman of APC since he has been suspended as a member of the APC in his ward.

The substantive suit is still in progress and Afolabi Oluwale brought an application of interim injunction before same court on 16th January,2020, asking the court to grant an interim injunction which would restrain Oshiomhole from acting as the national chairman of the APC, pending the adjudication and final determination of the substantive suit which is already pending before the court.

Around March, 2020, the Federal High Court saw sense in Afolabi's argument and granted the interim injunction which restrains Oshiomhole from acting as the national chairman of the APC.

Interim and interlocutory injunctions in law are not court judgements as widely misconstrued and reported by journalists and most reporters. Injunctions are equitable remedies which protect the interests of every party in a litigation. Interim injunction for instance is an order of a court which comes during the pendency of any litigation and the reason for interim injunction is to always ensure that none of the interests of the parties to the litigation is harmed in the interim.

It is always issued to stop either party from acting in a particular manner while their case is still pending before the court. Therefore, in essence, no litigant obtains judgement through injunction. Injunction either interim or interlocutory is literarily an equitable temporary remedy set out by the court to make sure that neither of the parties in a litigation would refrain from or even perform specific acts that would harm each other's interests.

As a matter of fact, a party who is not satisfied with the decision of the court on granting interlocutory and interim injunctions can still appeal such injunction and then apply for stay of proceedings pending the determination of his appeal on the injunction. The appeal court can still agree with the appellant when he is able to prove that the trial judge erred in law or has exceeded his discretion which resulted to a substantial injustice.

When the High Court granted Afolabi's application of interim injunction, Oshimhole had two choices by law ; to either obey the interim injunction of the FCT High Court and vacate office pending the determination of the main and substantive suit or file an appeal challenging the interim injunction at the appeal court.

He finally chose the latter by appealing against the interim injunction at the Court of Appeal which he lost on 16th of June, 2020.

The main suit between Oluwale Afolabi and Oshiomhole is still pending before the Federal High Court,and the court is yet to adjudicate upon that matter.
Oshiomhole may win the substantive case or even lose to Afolabi, but that's not the reason for this analysis as I cannot preempt the court.

The point is that the interim injunction granted by the Federal High Court and concurred to yesterday by the appeal court does not represent court judgment and can't be misunderstood to be such. An injunction of the court is different from court judgement. In Oshiomhole's case, the Federal High Court is yet to adjudicate upon the matter. What does it then imply? The implication is that no court of competent jurisdiction in Nigeria has concurred with the suspension of Oshiomhole by his ward as wrongly reported by most journalists and media houses.

However, while Oshiomhole is standing as a respondent to the suit instituted against him by Oluwale Afolabi, I advice him to institute an action before the court challenging the procedure which led to his ward suspension as an APC member or seek alternative means of resolving the issue, else even if he wins the suit instituted against him by Afolabi, it doesn't lift his suspension.

Anyway, let us wait till Obaseki formally registered to another party and see if he will still be the Governor before the General Election. APC can file a case against going by Nigeria Constitution and Electoral law and Obaseki may loose his seat. Let see how the drama unfolds.

Which Governor in Nigeria has lost his seat for decamping to another party? Do you know that Obaseki has fulfilled the constitutional requirement for defection? APC is in crisis in Edo state with 2 factional chairmen.
Until you understand how direct mode of primaries work, you will still hold on to your belief.

Lol. You don't really know politics. As factional chairman, his job is to cause troubles within APC, right from selection of aspirants. His faction will bring out an aspirant, the faction loyal to Oshiomole will bring out their own aspirant. APC will have 2 aspirants. That's the beginning of confusion
That is why APC is opting for direct primaries. By APC constitution, it is the NWC that organises governorship primaries. That from sales of nomination, candidate selection and screening and mode of primary. It is when the mode of primaries is indirect that the State executives comes in through selection and collation of delegates. That is where court cases of which factional chairman is eligible to sent list of delegates comes in. So in this case, the chairman roles is not needed. Direct primaries foreclose any legal issues on the constitutionality of the primaries.

Anyway, let us wait till Obaseki formally registered to another party and see if he will still be the Governor before the General Election. APC can file a case against going by Nigeria Constitution and Electoral law and Obaseki may loose his seat. Let see how the drama unfolds.

He scale through because he used affidavit that all his credentials has been lost. PDP getting tips that he never graduated from UI took APC and Obaseki to court. After APC won, PDP never pursue the case to Supreme Court. With help of Wike, Bayelsa PDP was able to get the green light that the certificate issue can upturned the APC victory before the Elected Candidates were sworn in reason for the rush in final judgment.

The legal proceedings by PDP was actually what opened APC eyes to Obaseki certificate fraud but after he was sworn in, everything die a natural death. You see in politics, if you are to fight a dirty fight make sure your cloth is pure white.

Check Obaseki affidavit that he used in 2016 and 2020 petition based on PDP Court proceedings. It will interest you to note that the affidavit was also a fraud as the court that the affidavit emanated from denied ever issuing the certificate as there was no record of such in their records.

Nothing could be further from the truth.
He'd never do that, lest he awards the governorship to the APC even before the election day.
Obaseki using the SDP platform + the PDP also fielding a candidate (divided votes) = an easy APC win.

What he needs to do now is sit and talk with the leading PDP aspirants, mollify them to close ranks, drop their ambitions and support him with the promise to put them in the scheme of things should they win the election.
One week is surely too short to achieve that. It would have been easier for him if he started his consultation at the state level with the aspirants instead of visiting Wike and Udom to influence his sole candidacy. Anyway, let us see what will happened between this night and Saturday evening.

But on a second thought, automatic ticket will have been easier under SDP. Obaseki and his online Edo voters has been clamouring that it is Obaseki party and not any other party, so the party he will be contesting from should not matter. It is actually a platform to establish that majority of Edo people are with him.

Embattled Governor of Edo State, Godwin Nogheghase Obaseki and aspirant for the race to return to the state government house has been carefully exploring options to secure a legitimate ticket to run for the office of the Edo State governor for the second term in office.

The All Progressives Congress (APC) doors were on Saturday slammed against the Edo State governor, Godwin Obaseki for what the party considered to be his ineligibility for the same office he has served on the platform of the party since 2016.

The latest political bride amongst which the Edo State governor is exploring as he seeks re-election is the Social Democratic Party (SDP).

Tribune Online can report that the governor is weighing the options placed before him by the various party on which he seeks nomination as its flag bearer before making his final decision.

As time runs out of the governor, in view of the closing date of 27th of June for the nomination, resolution of dispute and conduct of primaries by political parties to produce a governorship candidate for the office of governorship for the election in Edo State in accordance with the section 87 of the Electoral Act 2010, Obaseki has opened many flanks to enable him to make an informed decision to his advantage.

The National Secretary of Social Democratic Party, Alhaji Shehu Gabam told Tribune Online that “we are in deep discussion with the Edo State governor for him to fly the flag of the party in the forthcoming elections.”

He said, APC treated the candidate rather unjustly and so it opened its doors for the aspirant to seek the mandate of the Edo people on its platform.

He said the party has kept its doors open for him to take urgent steps in view of their discussions and the window available following the dictate of the electoral law upon which INEC derived depends to conduct the elections.

His words: “We are talking, it is left for him to take urgent steps, we felt he was treated badly. Discussions are ongoing and discussions are deep.”

Obaseki had after serving as Edo State governor for four years suffered rejection from his party following disqualification by his party by the screening committee led by Professor Jonathan Ayuba and letter upheld by the appeal screening committee led by Dr Abubakar Fari who said the Professor Ayuba’s committee did well.

National Chairman of the party and leader of the national working committee upheld the disqualification for closing any chances of Obaseki securing the ticket of the party.

It would be recalled that the Governor Obaseki had told his supporters that he would not seek redress by appealing to the Appeal committee because he believed that he would not get justice, so long as Adams Oshiomhole is still the chairman of the party.

There is a strong indication that Obaseki may be seeking the support of the opposition Peoples Democratic party to win the elections.

Pictures emerged on Sunday showing the governor in a meeting with the Rivers State governor, a move many believe is not unconnected to his aspiration to lead Edo State for another four years.

The visit to Wike is not to win the governorship election but to get PDP ticket as their governorship candidate. The problem is that PDP have 3 candidates already, they have the choice of

1. disqualifying all the candidates. This will be very bad move as all the aspirant will see that PDP does not win while all loyal APC members will join forces with PDP to win. This choice cannot guarantee PDP victory.

2. Persuade all the aspirants to accept Obaseki and forgo their aspirations. While this is very possible with money and striking of deals, a week is too short to make this comes to reality. If this becomes reality, PDP has higher chances of winning the election.

3. Reject Obaseki move. Most of the loyal members and allies of POI in PDP are readily available to work for APC for political gains and relevancies. APC victory is guaranteed.

On a serious note, Obaseki can not say is fighting godfatherism by going to Wike. He is actually adopting another godfather. You can not be promoting godfatherism to get political position and at the same time saying you want to destroy godfatherism.

As it is now, how is that possible when the sale of nomination and expression of interest has closed? Except by concensus/mutual agreement of all PDP aspirations, any imposition of candidates in PDP as at today will make PDP loose woefully legally and in the booth.

Obaseki has good 3 years to rectify whatsoever irregularities in his certificates after PDP took him to court, but hell no, he believe in the mentality of "I am the Governor" and "I will show **** that I am the governor of this state." Seriously, Obaseki is a fraud on the matter of his certificate, hence, in my personal opinion, the reason he did not take any step to correct what PDP accused him of.

From what the committee found:

1. He obtained Higher School Certificate from Institute of Continuing Education (ICE). ICE by the name suppose to be for post secondary education, continuing education has always been after secondary school. The Certificate Higher School Certificate was not recognised by any (educational) law in Nigeria. To make the case worse, he did not have the original certificate but attestation that he attended the school. He did not tell us that the school is no more in existence, by this, we may consider why he has not collect his original certificate or results. At least this allegation did not come to him as surprise, PDP took him to court in 2016 and some APC members took him to court early this year. Personally, I can conclude that he did not attend University of Ibadan because:
a. University of Ibadan will never accept attestation letter for admission, it is either your certificate or stamped statement of result with stamped broad sheet showing your name and grade. Forget A level results, you must present your O level results as a prerequisite for admission into 200 level.
b. No reputable and recognised educational institution will award A level certificate to a student with no credit in English and failure in Mathematics. Omission of Mathematics in Obaseki O level result means he has F9 in the subjects or he didn't sit for the subject.

2. NYSC Certificate reads OBASEK instead of OBASEKI. The governor having known about the discrepancy and with all of his educational, professional and political exposure never deemed it fit to write NYSC for correction. Why? Possibly because he can't petition on what is not existing such as the affidavit he submitted in his first attempt that was later found not to be in the records of the court. Anyway the party cannot take chances on this based on Bayelsa experience.

3. Not complying with APC constitution, especially, in the aspect of complaints/issues resolution. Obaseki agreed he never utilised and exhausted all the party laid down procedures in settling all party related issues most especially the removal of the National Chairman. He you do not believe in a party, it processes and leadership, you should not in the first place seek to represent such party and secondly, you should not expect such party to accept such an individual to represent them as a governor of a state.

“Mr Godwin Obaseki: Though, His Excellency, Godwin Obaseki in his nomination form claimed to have obtained a Higher School Leaving Certificate from an Institute of Continuing Education, Benin. It was observed however that no educational certificate such as HSC is known in Nigerian educational system. Even then, the same HSC was never presented in the course of the screening exercise. The aspirant admitted that he has never collected it.

“The attestation from the Institute of Continuing Education, Benin from where the alleged HSC which was indicated in the field of attendance as obtained is of no consequence, as it only attests that Obaseki was a student of the Institute. So what we had was like an attendance. It was just attendance, it was not a result.

“Although, the Committee received a petition on his University of Ibadan Bachelor of Arts Classics certificate which he submitted to INEC in 2016 when he first contested as governor, the committee on further probing was presented with an original certificate issued by the University and the original was sighted.

“On the NYSC certificate dated 6th August 1980, the committee observed that he bears the name ‘Obasek’ Godwin. While this may be an error on the part of the issuing authority, we observed however that the aspirant has not taken any step ever to have the anomaly corrected by the issuing authority.

“In our interaction with issues raised, we concluded that HSC was defective. The NYSC certificate and the fact that the aspirant took the party to court, the above aspirant, His Excellency, Godwin Obaseki, therefore, is not eligible to participate in the election.

“During our interaction which was done live, he informed us that he has instituted a suit against the party and the National Chairman. Yesterday (Friday) we received all the documents of those processes and we had to rely on the party constitution because it is stated clearly that remedies should be carried through party processes. We gave an opportunity for them to give us pieces of evidence to show that this was done and nothing happened.

Firstly, he refuse to order a new inauguration date to swear in 14 out of 24 APC state house members despite the intervention of the National executives and Presidency. These are APC members oooo.

Second, he reduced to nothing all national executives and truncated all reconciliation move. He has many videos to his credit against the internal mechanisms of the Party.

Lastly, he issue executive order to make APC declared primaries not to be possible. Unfortunately for him, the FG government has higher constitutional authority to override his executive order. We have to wait till June 20/21 for this.

But we don’t have the money.

“Tell me, if you don’t have the resources and you still needed these projects because with some of them you can pay back what you owe once they are operational. Would you because you don’t want to obtain the loans, you will say let me abandon these projects. Or, you will say I will take the loans but I will ensure that all the loans I take and every other resource I put on these projects are properly, efficiently and prudently applied and deployed.”

He said if the loans were not approved, the nation’s economy may slip into recession.

He added: “For us in the National Assembly, we are conscious of the fact that this economy, as affected by COVID-19, if it persists, you could lose over 20million jobs in this country.
The logic in bold face is very valid and I think we are getting to the point where we start putting some little trust on our politicians support and fight them to give us the best from available resources.

Try Union Bank, I am very sure you will not regret it. You will hardly get a failed transaction using their ATM card, online service (I use the Union Mobile as I have no need for the Online (Web-based) banking. On their customer services, their email is reliable but I will advise you call. One feature why I like the Union Bank is the electronic banking and the ATM security. Union ATM card will not work on Web sites with less security or with high reported fraud, you can choose to switch off (block) your card at time using the Union mobile. I use this feature always, you cannot even get a cash from ATM when it is off, with correct pin, it will tell you to contact your financial institution. This prompt always remind me, I did not on my card, I logged in, switched on (unblock), use the ATM, get my money, turn off the card, and move on.

Union Bank also have WhatsApp and Twitter handle to attend to BASIC accounts issues, though you may get delay respond taking between 1 to 4 hours before they response on those channels. I always choose to call with my registered number.

Yes they do, because the cut affects Enugu airport also. The Deputy Senate President then representing one of the Enugu senate President cannot even stand against Sakari Mr Cutter.

Do you the funny thing is that the same category of people hailing the cutting in 2017 budget were the same people saying lie lie government now. Let looks at the facts.

2015: Buhari enter govt, he used Jonathan budget.

2016: Senate led by Saraki delayed passing of budget, leaving budget with less than 6 months to implement his budget. You should note it was this year that real construction started on Lagos-Ibadan expressway, 2nd Niger Bridge, N-SIP (Npower, TraderMoni, MarketMoni, Conditional Cash Transfer (N5k/person and N20k per household), railway construction, etc started. That was the first Buhari’s budget.

2017: Senate led by Sakari cut all budgets for majority of these projects and programmes by more than 50%. And as at the time, most of the contractors are being owned. Like the Lagos-Ibadan expressway the contractor were being owned N15b and Senate approved N10b against N30b budget. Practically, there can't be any work for that project same applies to all other programmes. To make matter worst the budget was approved towards the end of June. Going by PDP claims and standard budget implementation process in Nigeria, it takes about 2 months to start implementing a budget after it was signed. So, technically in 2017, Buhari has 4 months to implement the budget.

2018: The budget was also delayed till mid of the year. This year witness very strong political instability in national due to the Sakari led National Assembly and Buhari led Executive feuds. It destroyed our economic and financial system. The ministry of finance that suppose to implement the budget was in scandal of certificate forgery and Buhari was just recovery from is long period of medical conditions. We have new Minister of Finance by September or so, in practical terms, the new minister will take nothing less than 1 or 2 months before she can start performing. We have about 2 months in this year to implement our budget.

2019: We still have delayed budgets but at least substantial part of the years was available. It was approved in May after all elections were conducted. The budget was also bastardized. Unfortunately again.

From these facts, we have our freedom to choose what we want to believe in and fight for.

The OP help our intellectual "lazy Youths" by putting the key conditions for indirect primary or concensus candidates can be adopted in bold face but no, they must speak against anything Buhari, Tinubu and Oshiomole.

Direct primaries is democratically the best mode for any party election. First thing is that the APC guidelines was made for 2019 elections, so it was not targeted at Obaseki. He was being treated by a private doctor for over 3 weeks, his health was not improving, then he started showing coronavirus symptoms. The doctor contacted the NCDC, you know Nigeria and their slow processes, I forgot to add that there was no testing center in the state. Before the test results could come, which came positive, he has given up the ghost. 2 weeks ago, I was informed that his father has died, possibly due to the shock of how he died as he is the bread winner. His mother health position has since changed and I knew the financial status of the families will not remain the same.

COVID-19 is real, our pray is not to experience it, in order to believe.

What gave Fashola the tickets for APC Gubernatorial Candidate was that he enjoyed the popularity and acceptability of party members, executives and civil servants not Lagosians. Lagosians only boost his chances in getting elected in INEC conducted elections. Without the party accepting you, you cannot present yourself to the citizens. Ambode was never accepted by the party executives, majority of the members and civil servants, even when it becoming like shameful thing to Tinubu not to accept the plead of Buhari and his respected political actors, it is too late to change the stakeholders mindset. Ambode make matter worse by publicly calling Sanwolu as a psychiatric patient that is yet to be totally cured.

Obaseki is worst than Ambode, shun the national executive peace move, plan the removal of the Party national chairman, write off all state Party executives and loyalists, etc...All those that he can run to including Tinubu, he has once insulted them. But in politics, anything can happen... Let see how Oyegun who want to score political scores with Oshiomole and has been the brain behind Obaseki's political blunders goes.

To me, I preferred that all party primary elections should be direct primaries where all eligible party members line up behind the poster/picture/representative of the candidate that they wanted to represent them in coming elections.

Direct primary should not be an option for party mode of elections but a mandatory and sole mode of elections.

He said the 8th Assembly passed the amendment to the Constitution to grant financial autonomy to state Judiciary and legislature and the president dutifully signed it into law over a year ago.

Obaseki shut all doors opened for reconciliation abusing his power to maltreat his political colleagues. What many do not understand is that the fight was never between Obaseki and Oshiomole but Obaseki and majority stakeholders in the state party. Oshiomole intervened and demanded for fairness but Obaseki turned the table against the peace maker (Oshiomole). He start telling the world that Oshiomole want to control his administration and he did not wht him develop the state. Oshiomole in his wisdom stay afar from him, keep mute when Obaseki and his teams were hurdling insult on him. Oshiomole went a step further by advising those who has been unjustly treated by Obaseki to threads the path of Peace and never to involve the judiciary. They listened and trust Oshiomole for his word.

As it stands now, no one can save him. Buhari will not come to his aid for his singular act of abusing his power on inaugurating a state assembly at night shutting out 14 out of 24 members out. To even celebrate the judgement that ousted the National Chairman (Oshiomole) has sealed his fate with Buhari and the entire "Presidency". Ambode was even better, his own sin was, he sidelined all party executives and elder and scraped LAWMA an agency where over 80% are members of the Party giving the contract to his close allays. In the current political setting in Nigeria, you can not say your party has no say in your administration, if you successfully complete your tenure, you will not get the next ticket.

Obaseki do not only sidelined major stakeholders of the state party, he rubbished them and cut them to nothing. Same thing that made Bayelsa lost to APC in the governorship election, no thanks to the deputy irregular names. Moreso, no matter what, in politics you should never be an ingrate. Buhari has and will never prosecute any case that will indict Jonathan because of Jonathan singular act of not contesting the election that brought him as President. His cabinet even Tinubu have no option when it became clearer to them in Buhari’s 2nd year in office, all cases (Metuh, Dasuki, FFK, etc) were pursue with glove hands. But Obaseki, in political ethics, failed in this regards.

The first thing to do is to believe that you have been forgiven by all. Second thing is to change your prayer point from more of forgiveness to pleading with God to reconcile you with your family for them to accept you back. You will not understand the efficacy of sincere prayer to God until you pray one and it start manifesting. It might take time but the result will surely come. Jesus said, pray until your joy is fulfilled, you should relent in praying for what you want in your life, at least, God is always interested in peace and love in every family, He will make it happen to you. God may even give you, as an extra, a good loving family again, I mean, a new loving husband and children, at a time you least expect.
