No matter how sentimental a judge can be, he/she can't sentence a rapist to death, because rape isn't a capital offence in Nigeria.... Besides, proving the essential ingredients of rape in Nigerian courts is a very Herculean and dehumanizing task... The girl would have to go through vaginal swabs, semen (if any) found in her has to be tested to see if it matches the accused person's semen, and the girl and her witnesses will be so thoroughly cross-examined that both the girl and her parents may wish that they had just let the matter go, instead of being subjected to such scandalous and degrading questions.

Bottom line is..... Rape is extremely difficult to prove, and it isn't even a capital offence.... The maximum sentence is life imprisonment...
