On Twitter Nigeria Immigration showed the guys passport that it has been ready since June 6th! That he arrived late and without a collection slip. My question is; How did they identify his passport to show us after he destroyed 5 cars? Couldn't they have used the same format to give him his passport in the first place? Sometimes, when i read certain news headlines and the comment some people make out of ignorance, I just laugh. Can you please join me lets analyse this whole news item? 1. A man was convicted in 2013 for a two year jail term. 2. EFCC appealed the sentence as being too small for the gravity of the offence he commited. 3. in 2018 the appeal court squash the former sentence and re sentenced him for 6 years in prison. 4. All sentencing for 3 counts to run 2 years concurrently! Total 6 years imprisonment 5. "They" are wondering why he is not in Prison.! Is it not so? Now, how many years was he sentenced before? 2 years! How many years is he sentenced now? Still 2 years! Why so. Yes, the Appeal Court jailed him for 6 years on 3 counts running concurrently. Meaning as 1 count is running, another is running as the same time. Concurrent means done at the same time. So they law permits the Nigeria Prison Service to keep the man for 2 years. Now this two years in Prison calendar is 1 year and 4 months. How did i arrive there. (1 year=8 months) so counting Night and Day as 2, we have 8 months make up one year! So after that judgement in 2013, the man may have started serving his sentence pending appeal. 2013 to 2014 plus 4 months he walks away a free man! Later on in 2018, Appeal Court eventually said in their judgement he was supposed to be jailed more. So they jailed him for 6 years!.....on 3 counts of 2 years each to run concurrently. So we are back to step 1. He is going to spend 2 years in prison-which is 1 year 4 months,-which he did! Remember, you can't serve twice for the same offence. What the Appeal court should have done would have been to increase his number of years, or vary the sentence. Some 4 years some 2. Because even if they jailed him on 10 count charges with 2 years each making 20 years imprisonment, he would still serve 2 years (1yr 4months) So they know what they are doing. The NPS service is only interpreting the law, and i am sure they are just laughing at the ignorance of others. Save this post. As far as i am concerned that Video didn't reveal anything! All what the INEC man was saying was their plans and programs. If you listened carefully you will hear he stressed MANUAL COLLATION...BY LAW meaning that is the only one the electoral act recognizes. And even if such Electronic servers exist, it is simply not admissible because the foundation is not set. No law is backing electronic transmission of votes! I will encourage anyone who has not gone to a court before to make out time, visit a court of law, preferably a High court and witness how cases are done. A whole day in a high court will open your eyes. Loads of youths just talk sentimentally on how they feel, or what they feel should be the correct thing...you will always hear ..."the whole truth, nothing but the truth in court"...all that na story. The court deals on facts, evidence and law. Have you not seen a criminal let off the hook when there is no evidence to nail him? INEC knew what they were doing.They talk plenty, collect money for budget, but did they actually carry out that task the way the electoral law said the should? Was the deployment of electronic means futuristic as no law was backing it just yet? Is the law backing such methodology in arriving or computing results? These are factors that must be considered in arriving at a judgement at the tribunal. Not what i feel or what you feel should be the right thing. There is also another angle to it. If this matter goes way up to the Supreme Court, which i am sure it will, can it be reversed to favor PDP? Do you remember SC judgement on Former President Yar'Adua's election vs Buhari? Why didn't they reverse it when it was clear that elections was fraught with irregularities? They had to look at the wider implication of such judgement. Will it unsettle the peace of the polity? Call it a political judgement if you will, but these things are taken into consideration. Will it cause political disturbance and the present frail security situation unmanageable? Judgement are not just given, a lot comes into play. It will be very difficult to upturn APC's victory. Yes, very difficult. Imagine the entire National assembly made up of APC's principal officers! Can a PDP president survive that? Life goes beyond what we see daily. This is why people do meeting at night 2am below. May God save us. |

Can i shock you? Let us assume that really INEC conducted elections and so transmitted it electronically-It cannot hold in court. Why? The court relies on the Law-that law is the electoral law. It forbids electronic transmission of results for now. Only manual collation is accepted and approved. The lawyers are just "testing the waters" and chopping Atiku's money! Can you build a house on nothing? No foundation? The electoral law is clear and free from ambiguity. That petition cannot win. The framers missed the crux of the matter!. I feel they should have insisted on forensic examination of the collated manual results sheets and looked for errors there. All these unique MAC ID etc na story. We court will never buy it. Ordinary video evidence is difficult to admit in court, not to talk about "computers servers, blah blah blah blah, make we dey watch nah. People, this is what is happening. When EFCC carry you, they take you to custody. Normally, they will grant you administrative bail, especially when it seems wetin them accuse you of is not clear, or easy to investigate immediately. They will grant you administrative bail. However, if there is an "interest" in your case, they may not grant you admin bail and will not release you, until maybe human right groups starts protesting or your family demands that you be taken to court. Now in court, 2 things will happen. Either you are granted court bail or you are denied court bail. Now, if you are granted court bail, most likely the judge will order that you be remanded in Ikoyi Prison, especially if your matter is Island based, some Mainland and other places go to Kirikiri medium or Maximum depending on the gravity etc. That is by the way. Now after remand, your "bail conditions" MUST be met! 2 sureties, Civil servants preferably with C of O, Level 1O and above.(This is a very difficult bail to meet) Level 13 or 14 is a school Principal, so level 10 is way lower! How can a level 10 posses a landed property in Lagos island, Ikoyi, Vi, Lekki and environs around the court?. Some do, by inheritance or other means, but few. That is the interpretation of court jurisdiction. They have to look for someone who has a property with a registered title, who is a Civil Servant, who is willing to surety him.(It comes with a fee-which should not be a problem) sometimes 400k or more for each of the sureties around where the court is located! Its not always easy. Finally, one is found! Depending on what the court ruled during the bail ruling...did it say EFCC prosecutor should verify the sureties? Or did it say the court Bailiffs will verify the sureties? If EFCC will verify.....that na long thing. They will verify at their own time and pace. Until they return to the court with a satisfactory response the court may not proceed on that bail perfection. However, if the Bailiffs are to verify then your people must go and see them-very important. Its faster to see them(This is Nigeria) Sometimes, the registrar of the court will tell you that "my Lord" has rejected one or both sureties based on blah blah blah....sometimes true, sometimes false! True in the sense that, that very "professional surety" you brought has been used recently in that court and the court knows the person or the title is not "clean" so it will be rejected by "My Lord"(the Judge). False in the sense that the registrar herself-mostly a woman lol, wants to handle the surety ship job....but she wouldn't say. They may reject it 3 times or more until you are frustrated and you will ask...what are we going to do now? Then she will offer to assist! Where she may bill 900k to 1.2M or higher to resolve it...booom sureties are accepted! Bail is perfected and you are off the hook albeit temporarily. But you must also attend court and early too. Any day you miss court...then you've "jumped bail, your bail may be revoked and you are remanded in prison again! Marley's case looks like EFCC to verify Sureties. Many Sureties dey fear....because them go visit your Ministry or office and house! I don't think its money. Finally, no ask me how i know all this o...them say experience na the best teacher. It answers everything! In law, if you accuse a man of stealing a cow and sue him, you call witnesses and they confirmed that the man actually stole a goat! The court cannot find the accuse guilty! The onus of prove beyond reasonable doubt lies on the prosecution. You said he stole 3.4 billion and it turned out that the money he met in the account was 1.8B, automatically this shows you lied about the amount involve or you didn't know the amount involve, and since you didn't know the amount involve how then can you know if it was mismanaged?!
