FuckAllTheMODs:Sorry for replying late. If I understand you right, there is a subsisting notice to quit, Which elapses 2 months after your rent’s expiration. You were able to move out within 2 months of after your rent expired. Legally, you are required to pay him for those two extra months. But you can hide your pride and beg him to allow you pack your things and leave without paying. But if he insists - I am afraid you have to pay him for the extra two months you stayed. |
tpapi:Yes! He has to be given an exact same 6 month Notice to quit. You can claim your arrears of Rent and Mesne Profits.... those are not affected. If you think he is not learned and will not take you to court - then by all means, you can resort to selfhelp and eject him. But if he is a learned person and you resorted to selfhelp without going through the statutory notices; you will be the one to pay him damages for unlawful ejection. |

kevoh:End of March on how many months rent? In the absence of information.... let me give you 2 scenarios. 1. If it is a Yearly Rent. And the tenant pays upfront. Then the 6 Month Notice MUST be within the Preceding Rent. IF for instance he paid the rent January 1 2018. You must serve the Notice Before June ending, 2018. If after then you wish to eject him STATUTORILY; you will have to put up with him till he pays another rent before you can serve him the Notice. That’s what the Act says! 2. If it is a monthly tenancy. That is, he pays month by month. Then you don’t need 6 months notice. A Month notice to quit is enough... and then you serve the 7 days notice at the expiration of the 1 month notice. It’s as simple as that. That’s why you guys should instruct a lawyer before starting this process. There is no room for selfhelp under Nigerian Law at all! If you meet a learned tenant - and they take you to court for non-compliance with the statutory process, You will cough out damages! |

Under the the Abuja RPA for example: The 6 Months Notice to Quit MUST BE GIVEN BEFORE the expiration of the Rent... and the 6 Months must end on or before the eve of the Rent’s expiration. If in Lagos’s Tenancy Law: Then the 6 months Notice to Quit can be given BEFORE or AFTER the Rent expiration But the Landlord is entitled to claim Mesne Profits from the Tenants for each day spent after the rents expiration; including the length of the notice. But it is common practice everywhere to give the Motice before the Rent Expires so it saves the Landlord the problems of tying down his property to an unwilling tenant. IN BOTH STATES/Jurisdictions, the Landlord cannot exercise his power of reentry until he has Personally served a 7 days notice of owners intention to recover property - and the 7 days has expired! It’s just as simple as that |

If you read the article, the Judgment of the lower tribunal was found to be perverse - the reasons were not stated. If the perversion was to the root of the matter - the Appeal Court would have nullified the election and ordered a fresh election. But none of the prayers in the Appeal was granted - which means the Appeal was without merits. Please don’t mention me again - if you don’t have common sense. You know nothing about the law - and you are here displaying your ignorance. |
