This is where the problem lies for the prosecuting team. How can they prove that the killing was premeditated? I believe that the accused will walk free in the end or get a very light sentence, provided that his rifle has licence.
I would say, they can just prove malice. And bear in mind that one who commits an act is presumed to intend the result. Hence, he fired the gun REPEATEDLY to either Kill or cause grievous bodily harm which resulted in death. Firing a gun is no way to investigate a generator being off, besides, a man thinks there is a robbery attack, he didn't look for or call out his family members, buh he just grabs a gun and shoots away! Its fishy.

I can only say
1. The above case will not meet the conditions laid down for proving self defence. The law has made it very strict, and the supreme court has laid down some conditions too in various locus classicus which this case cannot meet
2. He might plead mistake of fact, although this will be difficult but it might succeed.
All in all, his lawyers have a tough role.
If i were the prosecution, i would try him for murder, seems more like this was intentional killing. The police should seek for a motive.

Falana said "vicariously liable"... It is a principle of law in which the master is held to be jointly or severally responsible for the acts of his servant in a master servant relationship, once the act that injures the victim falls within the duty delegated to the servant.. For instance, your sErvant drives and knocks down a person, the person can sue you or your driver or both of your for compensation.
In this case, Fashola delegated duty to demolish to the police, so MIGHT be vicariously liable, however this is to be determined by a court of competent jurisdiction.
Also, Fashola can argue that he is not vicariously liable as the relationship is not that of a master/servant which is usually mostly based on not only delegatin duty, but tellin them how to do it.
The court would be the final destination

As is it with Abuja, F.C.T; today, it was developed by the federal government and has a great deal of diversity. Same goes with Anambra, Enugu, Imo and others; political appointments should be assigned to natives of that land. Lagos and Abuja are different, as they are former and present capitals respectively.

I know many of you would be shocked to hear this: Igbos, Hausas and all other ethnic groups ought to be able to run for a political office in Lagos, includes office of the governor.

If the ibo, hausa etc fill up all the posts, where will indigenous Lagosians work? When last was a Yoruba or ibo appointed as FCT minister? And that is still the capital oo!

I hope you are aware that the chief magistrate will not take me on that day, if he does, it will be offending the administrative rule of .....in causa sua'. Having said that, i will be detained and under the democratic rules, i will appear before another magistrate or judge the next day, by which time i would have used my contacts in the NBA to reach out to the magistrate. I am also certain that colleagues will be in court to throw up issues if he decides to go with the contempt proceedings.

My take remains that while in the temple of justice, we should all observe the rules and ethics, however, i will rather die than be brought to public odium, how would i appear again in that court? God forbid bad thing.
Unfortunately, in contempt, the judge you violated his authority is the one with the sole authority to try you, except you appeal the contempt if you have good grounds. In this case, the man would ve been convicted, if he chose to be docked.
Its one reason why contempt of court is condemned, it violated principle of non habeat in causa sua, as the same judge jugdes his own case

If the man under went 5mins of frog jumping, he is still an exconvict, assuming that contemp is a convictable offence (whatever that means).. He was found guilty of Contempt and that should be the only important factor in determining of he is indeed an ex-convict.. Its like this, he was found guilty by the court and sentenced to either being Docked or an option of Frog Jump!!

Either ways, if at all this is considered a conviction, then regardless of wether he went to jail or not, he is a convict!!!

Brother, he was not 'docked' i.e put on trial, so he is not an ex convict. His frog jumping was a mere punishment not on record of court. So he was merely punished not convicted. Howevere, i think the jugde was TOO harsh on him: he could have reported him to NBA after a stern warning

We witness on daily basis during court session some senior lawyer and SAN making unbelievable noise. Any ways as the post stated, it happened in “Osogbo”…more like “Osogbo Justice”
I beg to disagree, choosing to be docked for contempt would make him an ex convict which might affect his right to practise if tabled before the NBA.
Also, contempt of court is the only crime in our justice system that is not substantially defined with any punishment in line with the sec36(12) of the constitution. What this means it, contempt proceedings and punishment is based on the judges discretion and exercised to protect the integrity of the court. Hence unlike other offences which are clearly stayed in CC or PC or other acts withe there requisite punishment, contempt is not.
This means a judge can apply any punishment he deems suitable till the contemptor is purged of the contempt.
Hence the jugde action is within purview of law.

For someone who is vocally poor and lyrically hopeless, there is no need to waste time purporting to do a "cool song" or "diss track", both require the right voice and lyrical substance. The likes of Asa, Darey, and even Wande Coal are great vocalists and lyricists. They can survive without club bangers. But for D'Banj? The transformation agenda is on course. Reforms are ongoing in every sector. The finance ministry is carrying out bio metric evaluation of federal civil servants  to reduce waste. There is the new integrated online payment system which helps the minister monitor transfer of public funds. Our foreign reserves have risen again to 37 billion dollars. There's the proposed Soveriegn Wealth Fund to cater for excess oil sale proceeds.
In Energy, a lot of reforms. The president is keen on transparency and thus has set up probes into the sector viz KPMG AUDIT and AIG IMOUKHEDE. The president sought to close the window of corruption by removing subsidy but the cabal misled Labour into a protest. That notwithstanding, the reforms are still ongoing and the full deregulation of the downstream sector being vigorously pursued. Last week, the FG had concluded the PIB which remains a landmark legislation that will revolutionarize the petroleum  industry. Refineries are undergoing repairs and an American company, VULCAN is to build six more new refineries.

In roads, Zaria-Funtua-Gusau roads, Oshodi-Apapa with expansion and drainage works,  dedicated bridge frm liverpool roundabout to Tin can ports, trailer park, Dualisation  of Ibadan -Ilorin, ENUGU-Onitsha, completion of OWERRI -Onitsha,    9th mile, ongoing reconstruction of Benin-Ore-Sagamu highway measuring over 265 km, Kano-Maidugri Dualisation. Keffi -Akwanga-Lafia, award of Afikpo-Okigwe, Auchi-Okene being handled by Setraco. Loko-Eweta-Karishi bridge, Kolo-Nembe -Brass  to mention but a few.

In Transport, massive reforms at the ports. Sanitisation and reduction of operating agencies to 7. Introduction of 24 hrs ports operation. Ongoing Construction of light gauge train railways across t4 cardinal point of the federation

In  Aviation, massive reconstruction of major airports in the land, Enugu airport is undergoing total rehabilitation. The domestic wing of Abuja airport is also being reconstructed with expansion of roads and car parks. Same fr the international wing and the kano airports

In Education, establishment of 9 new federal universities in less than 1 year. Constructed 2 new campuses of the Nigerian law schools in Yenagoa and Yola respectively. Launched the Almajiri schools for education of itenerant Islamic pupils in the north wFhich Buhari and other northern leaders abandoned. Increased funding to almost 400 billion to education thereby setting an all time highest record. Reinvigorated the inspectorate oversight of schools leading to the revocation of some licenses from universities. Executed the landmark upgrade of university lecturers retirement age from 65 to 70. 

 In agriculture, for the first time in our history, we have a clearly defined agricultural policy which is targeted towards maximum utilisation of cassava for growth thru the launch of the cassava bread campaign. The policy is intended to reduce our reliance on imported wheat so as to encourage local production of cassava and it's conversion to flour for bakery. The FG has in less than one year eliminated the middlemen cartel that fed fat on fertiliser distribution at the expense of local farmers. Now through deregulation reforms, fertiliser is now accessible in the open market. he has also embarked on massive construction of silos and has increased import duties on the importation of rice in order to encourage local farmers. The efforts of the minister has been so appreciable that the world bank assisted with over 50 billion Naira for fertiliser redistribution scheme/ silos. The CBN has also set up a 500 billion loan scheme which is to assist farmers.

In power, the NIPP has been revived with the subsequent refurbishment of Afam, Alaoji, Calabar, GEREGU, Omotosho, papalanto power plants. This has led to the addition last December of 4,000 megawatts from barely 1700 to the national grid. To address the problem of distribution,  the 18 successor companies have been slated for privatization.  The media is already awash with news of the proposed privatization next week. The reforms include the review of tariffs in order to ensure a cost reflective tariff that will encourage private sector participation in the building of gas plants. Already, this has started yielding dividends as SPDC has commenced processes towards building a gas plant in IMO state. 

Like the president said during his last media chat,  people like You who have found a business in criticizing him should continue while he concentrates on his ongoing reforms. That when most of his reforms I.e power sector reforms, civil service reforms, Energy reforms etc are thru, they will have a rethink.

In  Aviation, massive reconstruction of major airports in the land, Enugu airport is undergoing total rehabilitation. The domestic wing of Abuja airport is also being reconstructed with expansion of roads and car parks. Same fr the international wing and the kano airports

In Education, establishment of 9 new federal universities in less than 1 year. Constructed 2 new campuses of the Nigerian law schools in Yenagoa and Yola respectively. Launched the Almajiri schools for education of itenerant Islamic pupils in the north wFhich Buhari and other northern leaders abandoned. Increased funding to almost 400 billion to education thereby setting an all time highest record. Reinvigorated the inspectorate oversight of schools leading to the revocation of some licenses from universities. Executed the landmark upgrade of university lecturers retirement age from 65 to 70. 

 In agriculture, for the first time in our history, we have a clearly defined agricultural policy which is targeted towards maximum utilisation of cassava for growth thru the launch of the cassava bread campaign. The policy is intended to reduce our reliance on imported wheat so as to encourage local production of cassava and it's conversion to flour for bakery. The FG has in less than one year eliminated the middlemen cartel that fed fat on fertiliser distribution at the expense of local farmers. Now through deregulation reforms, fertiliser is now accessible in the open market. he has also embarked on massive construction of silos and has increased import duties on the importation of rice in order to encourage local farmers. The efforts of the minister has been so appreciable that the world bank assisted with over 50 billion Naira for fertiliser redistribution scheme/ silos. The CBN has also set up a 500 billion loan scheme which is to assist farmers.

In power, the NIPP has been revived with the subsequent refurbishment of Afam, Alaoji, Calabar, GEREGU, Omotosho, papalanto power plants. This has led to the addition last December of 4,000 megawatts from barely 1700 to the national grid. To address the problem of distribution,  the 18 successor companies have been slated for privatization.  The media is already awash with news of the proposed privatization next week. The reforms include the review of tariffs in order to ensure a cost reflective tariff that will encourage private sector participation in the building of gas plants. Already, this has started yielding dividends as SPDC has commenced processes towards building a gas plant in IMO state. 

Like the president said during his last media chat,  people like You who have found a business in criticizing him should continue while he concentrates on his ongoing reforms. That when most of his reforms I.e power sector reforms, civil service reforms, Energy reforms etc are thru, they will have a rethink.
You forgot to mention the laptop you got!!! 40 laptop squad packaging a failing government. Anyway, i am keeping my eyes and mind open, let's see when all your reforms will materialise to something tangible. Did i mention your arguments are amazing?

Seems the problem with most people is they only want a party jam or a club banger. So because he is Dbanj he can't do a cool song or a diss track. Its just a diss song, and for a diss song, its ok. Although there is a higher probability you won't like it if you don't understand yoruba.......
