In that case Buhari should have cornered the oil wells and refinery business to show he was capable of improving himself when he was petroleum minister, head of state or PTF chairman. In sane societies, people such as the CJN and others would have since resigned or be forced to resign, but here we have people defending the indefensible. A judge is not a lawyer. A lawyer is a private businessman or woman who sells legal services to those who can afford it. Some lawyers charge millions just for consultation. A judge on the other hand is a public employee, a public servant paid by the state to administer justice. A judge is not expected to engage in business or provide legal services, so how do you compare the earnings of a judge with a lawyer? A judge's salaries and allowances can be determined to the last kobo. Now if a judge is reputed to have billions in his accounts, without any explanation, then something is amiss. In the UK, and ordinary citizen living beyond his or her means would have some explaining to do to the police, not to talk of a public officer or a judge. Here people are celebrated and some people are prepared to sacrifice their lives to defend such people. If you insist judges are able to earn billions in Nigeria, then where are his tax receipts, so we can see the businesses that generated the money. If he cannot produce the tax receipts, then he is guilty of tax fraud and evasion. That is how it goes in a sane country. How can some one who is unable to explain the source of his wealth sit in judgement of a yahoo boy or any one accused of corruption? |

The wall will not stop smuggling of drugs and narcotics into the US. With drone technology sending drugs over the wall will be a piece of cake. Most illegal immigrants come into the US through the airports. They come in with visiting visa and refuse to leave. |

If trump insists on appealing all the way to the supreme Court, the supreme Court might give him some reprieve, but he will not get close to what he wants, just like the travel ban. It would take close to 8 months to a year to get all the way to the supreme Court and get a ruling, by then the general elections would be down the corner and the damage to his poll numbers would have been complete. |

This is a statement from the NJC; The NJC also informed DSS that it was not amenable to “invitations being extended to judicial officers by departments and agencies of government for any reason”.In effect judicial officers are a law unto themselves. |

Now, how can the appeal court grant Onnoghen a judgement without there first being a ruling at the code of conduct Tribunal. I thought appeal court can only appeal a judgement of a lower court. But an appeal was heard even before the case at the CCT commenced, so based on what ruling did the appeal court based it's orders on? |
This lawyer has not read supreme Court judgement SC.279/2012 read by Justice Onnoghen himself. In the judgement of justice Onnoghen in 2012, je said the CCT has exclusive jurisdiction to try code of conduct violations, and the CCT also has powers to mete out punishments to violators. Any allegation that a public officer has committed a breach of or has not complied with the provisions of this code shall be made to the code of conduct Bureau”. The foregoing provisions are clearly unambiguous and so construed literarily mean that any breaches of any provisions of the said 5th schedule or matters of noncompliance with any provisions of the Code shall, (meaning that it is mandatory i.e. must) be made to the code of Conduct Bureau that has established its Tribunal with the exclusive jurisdiction to deal with any violations of any provisions under the Code, if I may emphasise any violations shall be made to Code of Conduct Bureau. The provisions have made it mandatory to take any matters so covered by the 5th schedule (supra) to the code of conduct Bureau and not to any ordinary regular courts as has been done in this instance. If I may repeat the code of Conduct Tribunal has been established with the exclusive jurisdiction to deal with ail violations contravening any of the provisions of the Code as per paragraph 15(1). This provision has expressly ousted the powers of ordinary regular courts in respect of such violations. The Tribunal to the exclusion of other courts is also empowered to impose any punishments as specified under sub-paragraphs (2) (a), (b) & (c) of paragraph 18 as provided in sub-paragraphs 3 and 4 of paragraph 18 while appeals shall lie as of right from such decisions to the Court of Appeal. |
