Romance › 5 Ways Your Prenup Can Be Made Useless by 2buffagain(op): 4:35am On Jan 26, 2019*. Modified: 6:54pm On Jan 28, 2019 |
If you live in the New York City area, you may have seen the news last month that a Brooklyn court threw out the prenuptial agreement a Long Island woman had signed with her millionaire husband before their 1998 wedding. This is a precedent-setting move, and divorce lawyers nationwide are sitting up and taking notice. Will more people now try to have prenuptial agreements tossed out of court? Long ago, having a prenuptial agreement was considered stodgy or even insulting, but these days, “prenups” are becoming increasingly common for high net worth couples. Simply put, a prenup formalizes the understanding between spouses-to-be as to which of their assets will become marital property, which will continue to belong to whom individually, and, in the event of a breakup down the road, what financial provisions are to be made. Most commonly, a prenup is drawn up to protect the spouse with greater separate assets from losing an unfair proportion of that wealth if the marriage should end.
Until recently, prenups were considered difficult to void. Indeed, I consistently advise brides-to-be to have a thoughtfully conceived prenup in place to protect their financial interests.
However, it does sometimes happen that a woman who signed such an agreement, and whose husband now wants a divorce, has defensible grounds for wanting that agreement revoked. Here are five conditions under which that could happen:
1. The agreement is fraudulent.
A prenuptial agreement requires each spouse to make full disclosure of his/her assets. In divorce, it is quite common for the husband to undervalue assets or fail to disclose them at all, so these assets can’t be made part of a settlement agreement. Unfortunately, prenups are prone to this kind of underhandedness, as well. If you can prove your husband did not fully disclose his income or assets at the time you signed the prenup, you may have grounds to have the agreement thrown out, now that you’re getting a divorce.
2. The agreement was coerced, signed under duress or signed without mental capacity.
Coersion or duress can be extremely difficult to prove, and, as with many aspects of divorce law, different states have different standards for what it means to have been coerced into an agreement. Still, it is not unheard of for a prenup to be thrown out on this basis. Similarly, if you can prove that you lacked mental capacity to understand the prenup when you signed it – for example, if you were ill or under the influence of drugs -- this may be a sound reason to invalidate it.
3. The paperwork wasn’t properly filed in the first place.
As with any legal contract, the enforceability of a prenup can come down to the proverbial “crossed t’s and dotted i’s.” Careless errors could render a prenup less than airtight. If the initial agreement was poorly drafted, it may also be invalid.
4. You signed without proper legal representation.
Both parties to a prenup should have separate and independent counsel (in fact, some states actually require that they do). If you signed something that your wealthy fiancé or his family arranged to be drawn up for you to agree to in order to marry him, be aware that this may not be an ironclad agreement if, years later, he wants out of the marriage. Signing a contract without legal representation is never a good idea! But if that’s how you signed your prenup, there may be a chance of invalidating it.
5. The agreement contains ridiculous provisions . . . or is simply too lopsided.
Even though divorce court judges are typically disinterested in most peculiarities of individual contracts, there can be factors that raise eyebrows. For instance, if your prenup states no child support whatsoever will be paid in the event of a divorce, it is likely to be thrown out. Provisions in the prenup about weight gain, hair color, frequency of sexual relations, visits by in-laws -- remember, the judges have heard it all -- are likely not to hold up in court, either.
In summary, in order for a prenup to be effective:
- Both parties must have their own separate attorney. Plus, the prenup must be:
- Written. Oral prenups are not valid.
- Executed voluntarily and without coercion. e.g A prenup that’s signed the day before the wedding can be invalidated.
- Executed only after full disclosure. If you hide assets and/or liabilities, you run the risk of invalidating the prenup.
- Conscionable. A prenup cannot be unconscionable. In other words, the prenup could be invalidated if the agreement is too lopsided, with one party awarded almost everything and the other receiving only a pittance.
- Executed by both parties, preferably in front of witnesses (or a notary). Some attorneys even recommend having a judge witness the signing to make sure that neither party was coerced into signing.
- Written in a recordable format, such as a real estate deed
Keep these conditions in mind, not only if you are trying to get out of a prenup you now believe to be unfair, but also if you are thinking about signing one. Whichever side of the coin you’re on --whether you’re trying to void an agreement or trying to draft one that cannot be voided --it’s critically important to consult with professionals who have the expertise to help you navigate these sometimes choppy waters and plan for a secure financial future. Nene05: Also for the million time I want kids but sex denied He probably won't give you kids... You'll just use that against him as a means to have more grounds to enslave him. You already have that mindset. I think what we have here is a case of "cunny man die, cunny man bury am". You are both using each other for cunning goals and using whatever leverage you can to achieve said goals. I think its best you both treat this whole thing like the obvious business deal it is and lay things down for each other as you would in a contract. No emotions, no fake statements like "I love him" etc. You obviously also want a child for selfish reasons. No child should be conceived in this kind of setting. Understand that this thing you have is purely business. So have whatever fun you have and relax at home all you want while having a slave make you money....before it comes to an end. |

If it's just left he's not happy with unorganised house. And buy the way there is money left over each month.
If I have to do the man's job AND women's Job may as well be single.
It's a team- you provide and I do everything I'm not like one of those over weight women who's house is a mess no food on table no exercise etc. .. I see. He sounds like one of those useless Nigerian men then. You can't demand all chores be done in the house and that she also works too. That is illogical. |

You are obviously just a manipulative slave driver, and he resents you for it. Go and work and stop being lazy. What is in laundry? cooking? etc? Are single people not already doing that and working already? In a world of washine machines, dishwashers and vacuum cleaners... Your By-force Housewife logic has no freaking point |

I have made the situation to benefit me.
He's not in a position to support anyone else I deliberately don't make an income for this very reason.
I'm not unintelligent. Well there you go. So you already know your problem. Like I said, You are just here looking for pointless validation. You won't get any. This thread title might as well be "Why is my slave not working fast enough?!!" And you still haven't answered my earlier question of WHOSE child that is that you were using as an argument point in savings i.e childcare fees. I'm guessing the child isn't even his. Now I don't know what arrangement you 2 had before engaging each other in this manner, but it is clear the whole thing is like a business deal. So I don't get why you still feel this same slave individual would want to have sex with you... |

Nene05: This is not true The cost of child care is expensive takes most of one wage.
We live somewhere he can afford. If he lived alone would have to pay same bills. Only with 24/7 live in maid service.
If the living costs your saying move somewhere cheaper manage with one car believe me it is doable. If 2 incomes coming in who will take care of the home?
Also people I know who both work the guy sends most of his wage home etc. ... so you can afford all of this but not basic living.
Also when he first came he couldn't work and I took care of everything if I managed as a woman what's wrong with him.
He always talks about he's provider and prefers submissive woman.
He admitted likes the benefits of this and that most woman not interested in catering to a man Is that his child or yours?..... |

Nene05: If he showed me affection then we would be fine.
Maybe I will give him a deadline and let him know if nothing changes by xyz then just so you know I will be getting to know other men. And rather than him finding out will let him know before hand. Looks like you know exactly what the problem is but you are just being an undisciplined woman looking for validation from either social media or faceless forums without doing the hard work of addressing the actual issue on ground with your husband. We Also haven't heard his side of the story. But I've heard enough to know that he is feeling used. Making him go and slave for you outside to bring money to you comfortable sitting down at home. Your talk of Visa means you are in a country where the cost of living has inflated to accommodate feminism. These countries have things set up in such a way that both couples have to work as opposed to back in the day when one person could take that helm. Being that he has a temp Visa, I doubt he has a high career paying job and can only work for nuggets... So you are basically being a slave driver if you want to leave all financial burdens to him. As you have said, he has told you the issue, but you have chosen to ignore it like a typical annoying female... Choosing to focus on "how you don't like experiencing the consequences of your inaction" as opposed to working out a logical solution with the guy. |

Nene05: It's a temporary visa that if nothing changes will not be renewed. Will be going back to Nigeria The both of you aren't communicating. If it's intentional, then the other person is just looking for a way out. You've said before that he is paying for things alone and you don't want to work... So you might just be the one not listening. |

What we are asking - or at least, I am asking - is, if a MAN made the same comment - if a male coach had retorted that he picks his all-female team based on their breast sizes (or vaginal tightness, or whatever, lol..) would YOU still find it sarcastic?
Tell me in all honesty, would you?? Just watch... No female will answer this simple question. They won't because to them, an argument is never an opportunity to learn or to come to a sound conclusion on a matter, but purely to argue. These vagina'd creatures could care less about honesty and reason. This is why no one takes women seriously and neither should you. |

It was a sarcastic answer to a question she considered gender-biased. I think it was a simple "yes/no" question though.
Someone types several lines and omits an "s", you tag it illiteracy. You are a very smart one. Probably the smartest in your clan. A failed attempt at protecting your fellow feminist. If a man said he only picked a women's team members by the size of their breast , or if we're comparing apples to apples....
