And Nigeria has chosen the WRITTEN type (as opposed to the UK, for example, which has the “unwritten” type).

The ONLY way to add to our written constitution is by LEGISLATIVE amendment (federal and state)…
Supreme Court rulings merely INTERPRET our written constitution, it CANNOT “create” new constitutional provisions!

Going to jail for what? He will go by the Supreme Court ruling. Old naira notes will be legal tender till 31st December. However, where will you find old naira notes? CBN will never bring back the more than two trillion old naira notes it has already recovered. Banks will be free to accept old naira notes and old naira notes will be accepted in the country as legal tender. But how much old naira notes will be in circulation? CBN has already achieved its objective.

Why did the Supreme Court hold that the old notes shall remain legal tender until December 31, 2023? I am not even sure that was a relief requested by parties to the case, so why not indefinitely? Or (since it argues that the process was illegally implemented) until the process is properly and legally implemented?

Instead, by determining the December 31 time period for old notes to remain legal tender, the Supreme Court has INSERTED itself into the policy-making process and has SUBSTITUTED its own substantive policy over that of the President and the CBN Governor with respect to currency management, an area that is constitutionally and legally the EXCLUSIVE preserve of the latter.

Courts are neither empowered nor equipped to make a substantive determination which government policies are ‘good’ or ‘bad’, or to CHANGE substantive (executive or legislative) government policy. The constitutional power of Judicial Review granted to the judiciary is limited to determining whether laws or policies were wrongly or rightly made, not which different dates/substance should apply.

This judgment risks sacrificing confidence in the substantive neutrality of the judiciary on the altar of short-term political expediency.

Exactly how is Nigeria purportedly operating a constitutional federal system if the federal government cannot take decisions on matters reserved for it without first consulting (and presumably seeking the approval of) state governments? Is the FG also required to consult with the LGAs? If not, why not, when said policies similarly affect LGAs?

Disobeying a lower court is a serious offence, disobeying the supreme Court is unthinkableshocked. Whatever ruling the supreme Court gives becomes part of the Constitution shocked shocked. Without prejudice to what else you wrote, it does NOT…
The Supreme Court cannot change, add to, or subtract from, the Constitution.

It can only “interpret” what’s already in the Constitution…
And even that interpretation can be later overturned by the Supreme Court.

When you look at his records on google scholar, you would have a little premonition.

While anybody can get their articles on google scholar, users or consumers that know their onions are as well concerned about the publisher or journal.

Is it indexed in Thomson-Reuters or Scopus or Scimago or another recognized index? What you find is that his publication is an offshoot of his own fictional book and little invested in academic rigor.

But then he has the charisma of a dogged Cornel West. He could have been more successful than Philip Emeagwali.

He presented himself as such and accrued benefits by such associations. He was invited to other institutions on the basis of such associations and he allowed himself to be so identified. He got the honorary doctorate as a result of these misleading associations. How no Nigeria scholar could look a little within as to his credibility is actually not ridiculous. It is even the aspiration of the genuine local scholar to get a reference from him.

But he was smart, he was no Moses Ochonu, or Farooq Kperogi or another in diaspora that had a critical opinion on ASUU. But his association with David is just one of those anti-climax movements. That association is perhaps his most prominent hamartia. He was trying to win the space and gain more influence on the back of David. He also associated with Linda Ikeji, but David is the one that has smart detractors: he is a popular fellow who has given a fight to the BBC and accused it, to such extent, to destroy its reputation. Oxford providing their platform for him, legitimizes such accusations, and the smart fellows David Hundeyin has crossed by his manner of journalism are much interested in his disastrous end. David didn’t lose out from this. Onyeka did. He perhaps lost all; folks would now review his books and find misogynistic nonsense and plagiarism and incompetence. He is not a film maker on the level of Mr Macaroni, but by his association in the past, there were those who’d considered it an honor to work with him, now he has lost that too, and all his credibility. And his reputable name will be associated with fraud. Don’t build on sinking sands.

I hope he gets all the supports he can get from those around him. And that those who used him as a ladder, do not genuinely abandon him. He can get a genuine doctorate degree and earn himself a genuine comeback in 2-3 years from now.

Also, he shouldn’t have had an opinion too on who was the better singer between Seun Kuti and one of the P Square brothers. Without earning David enemies, the dissatisfied lots from such a decision, could have as well get interested in ruining his reputation. Even if Farooq is not careful, the dissatisfied lots can find a post, where he subtly endorsed the Quran and infer he endorsed child marriage and women as subordinates. Thus, he is careful too. Or do you think Farooq can talk about homosexuality as haram or have an opinion that is traditionally from his place of origin or his religion, without getting the kick? That’s just one of the prices to pay.

Onyeka’s claim to authority was in Africa studies, a white person evaluating his methodology or reviewing his credentials would be less critical in their comments, else they are racist lots. At least as a future yahoo boy, trying to become the next Philip Emeagwali or Onyeka you learn the lesson in how to navigate their world through an intellectual endeavor. Don’t do the sciences where you can be easily disproved or rebuffed. Do an African related course, be an authority on the people of Sambisa, no one would question you that much, especially abroad.

In the end, he is a different Yahoo Boy.
This is what gets me about Nigerians of our generation…

The road to hell is paved with good intentions, and without prejudice to the purported effects of the policy, it is NOT the place of the courts (even the Supreme Court) to second-guess the substantive effects of the executive branch’s policies, including the CBN’s currency management policies (which is an integral part of monetary policy).

Accordingly, the Court should’ve limited itself to the whether the policy was properly made, and should never have strayed into the arena of the effects thereof, essentially according to itself veto power over executive policies. The courts are neither empowered nor equipped to determine which executive policies are good and which ones are bad.

Assuming the toga of a policy decision-maker is a slippery slope that is inevitably doomed not to end well, as it invariably subjects the Court’s actions/decisions to POLITICAL (rather than jurisprudential) scrutiny, and erodes confidence in its independence.

2/3 of 37 is 25 (to make it a whole)

Tinubu already secured 25% in 28 states.

So no case here at all.
Your interpretation would require the use of the term “including” the FCT…

In contrast, Section 134(1) could not be clearer in its employment of the conjunctive term “and” (aka “plus” or “in addition”).

Having said that, the reality is the Supreme Court can literally reach ANY decision it pleases.

I am not happy that Peter Obi did not win. There are clear fundamental factors that were so herculean to overcome the very moment LP/NNPP alliance failed.
Now that Atiku is seemingly out of the way, it is time to galvanise the opposition towards 2027. It is going to be a marathon, so let us start now. There is no point wasting resources on election tribunal. With the capacity shown by Obi, 2027 is possible, but we need to do the following:

1. Not waste time and resources on election tribunal, but need to let Nigerians know of the brazen robbery APC governors and Wike perpetrated. If the PDP wants to challenge the results, let them do so themselves, without involving LP

2. Get real political structure for Labour Party across Nigeria. One reason we loss was because we did not have strong roots in the North.

3. Galvanise all elected officials to form a formidable force to take on APC, which is already reduced in strength from 21 to 12 states.

4. Peter Obi and LP should focus on the March 11, 2023 governorship polls. Obi should begin touring states LP won to boost morale of LP supports in the 22 states win high voters. Not waste resources in states like Katsina, Yobe, Zamfara.

5. LP leadership should begin talks with NNPP, progressive still in PDP and form a formidable party with structure, just like what ACN/CPC did. We need to start now.


The typical Nigerian way…
Forget injustice and HOPE it will be better in 4 years.

Nigerians have been HOPING for over 60 years, and things only get WORSE…

Anyway, legislative majority in Nigeria hardly promotes anything other than “rubber stamping”. That’s how Buhari borrowed our grandchildren into debt that we will still be repaying well into the future. While I personally do not want a logjam between the executive and legislative arms, good programs and policies should be able to survive due scrutiny by the legislature.

Can political parties therefore similarly disregard INEC guidelines? The Constitution gives SOLE authority over national elections to INEC, including the power to make binding rules and regulations for the conduct of such elections. In that regard, what is referred to as INEC “guidelines” are in effect ADMINISTRATIVE LAWS, which (though inferior to statutory laws enacted by the National Assembly) are actually treated by the courts as any other law. Accordingly, these guidelines (unless they are contradictory to statutory laws) are treated as any other LAW binding on all relevant parties.
