To the best of my knowledge you don't need statement of consent from your husband for baby US passport the DS 3053 will except maybe for Nigerian documents e.g. visa or passport which ever you decide to go with.
As for going with DS 3053 notorised maybe its possible , though i dont see any harm in trying besides the document is valid for 90 days from the day it is notorised

Hello. We don’t normally post in this thread, but it seemed worthwhile to drop in and correct some misconceptions. We say this a lot, but it bears repeating: Birth tourism is legal in the US provided the applicant is open about their intention and pays the medical expenses in full. This means that the applicant should declare any such intention they have at the Embassy/Consulate and again at the port of entry.

If it happens that the applicant gets pregnant well after the initial visa interview, they will have the opportunity to make their intention, medical preparations and financial resources known at the POE. However, it will remain up to Customs and Border Patrol whether to allow that applicant into the country. Some are not, and they are put on the next flight home. This must be extremely uncomfortable for a heavily pregnant person, to spend 15-20 hours on a flight to America, several more hours being questioned, then another 15-20 hours on a plane home. This is what we want to avoid.

Onto some other misconceptions:
The concept of the “change of intent” letter is not valid. These e-mails are not read nor correlated with the applicant’s file. Some people who send such letters may get a form letter in response, but it is informational in nature and in no way confers permission to amend the declared purpose of travel. What matters is what you declare at the Embassy/Consulate and at the POE. After the fact e-mails do not carry any weight.

Some applicants say, “I applied for only the B2 visa to declare my medical intent.” The B1/B2 visa categories are conjoined, so applying for only one does not make any difference. Other applicants say, “I appeared at the window with a big belly,” as if this alone is enough to declare their medical intent. Again, the responsibility is on the applicant to be honest about what they plan to do in the US.

Other considerations:
Medical care is expensive in the US, and costs can escalate dramatically if there are complications.
Credibility is paramount in the US visa process. If visa officers detect any deception or obfuscation, no amount of excuses, documents or receipts will make up for the loss of credibility.

This is exactly what did I got my third multiple entry visa used it 4 times before childbirth. But I still went ahead to notify the embassy thus;-
"Dear consulate officer,
I have a b1/b2( no.000000), I have also visited the states 4 times with the said visa, however I wish to go in Dec to put to birth in Houston Tx. Do I make an appointment for another visa?
Please advice."

And I got the normal response.
Mind you I didn't even know of this thread when all these transpired
it was a colleague in the office that adviced I did so. He said it was what his sister did.
I just didn't want issues at all.

What if you got your visa for visiting and used it for that purpose, in fact multiple times, and got pregnant almost a year later. Would you still need to reapply for another visa interview?

You can go through any POE you so wish for me they are all the same from my experience JFK ,Atlanta, Houston are the the 3 ones have used I see no hassles.
Just make sure to have on you correspondence with dr/hospital, money in what ever form to show you can foot the bills, accommodation booking or host address which ever applied to you.
You won't even be noticed when you arrive in a local flight.

Go or contact the hospital you plan to use they will direct you on how to get another doctor affliatted to them.

OK,so I arrived the US yesterday through Dallas. I flew Qatar airline at 34weeks and the POE was a breeze. My seat was changed in the plane, I was given a whole row(3seats) to sleep so I didn't really feel the journey was loooonng. Thanks to the air hostesses, and we were served jollof rice in the plane...I loved that! Had only about 4hrs layover in Doha. Arriving the Dallas airport was like arriving Oshodi market, the crowd was massive, I was allowed to join the B1/B2 visa holders queue right in front because I am a pregnant. We took turns to scan our passport, it got to my turn and I spent less than 3 mins doing that. The receipt was printed out and I was directed to get my bags after which I proceeded to Immigrations. The officer that attended to me only asked a few questions and stamped me in in less than 2 mins.
Officer: Hello ma'am. What brings you to the US this time?
I: I am here to give birth to my baby
Officer: Oh! You Pregnant?
I: Yes
How much do you have on you?
I: $$$$
Officer: Have you paid part of your bills?
I: No
Officer: Where would you be staying?
I: (showed her the address) The same place I stayed when I was here the last time
Officer: Oh, you have been here before?
I: Yes ma'am!
Officer: (Stamps me in and hands over my passport) Wish you the best then. Did you come with any form of food?
I: No
Officer: That's fine then. You can go.
It was really short.

PS: So I got into Dallas just for my host to tell me somebody called from Dr Stimage office that she is fully booked for July and can't accept me. I sent her my medical records and EDD by email last Monday. Now I have to start searching for a DR at 34weeks. Mamas that have given birth in Dallas,pls lead me cos I am too frustrated to search now. If I was you I will print the web page containing the information for pregnant women on the day of my flight and carry along. So that if confronted with any other information not on the page I will show where I am quoting from.

Good day house. I want to say a big thank u you all for all the information that has been shared on this platform.
Pls am in a big dilemma. I just had my baby to the glory of God.am being told now that he needs to have a hearing test which is mandatory by law. The test however is not in the package I got and it is not discounted for.it comes at a fee of 500$.
Am confused as this is quite high for me.am considering refusing this test buy they say I'll have to sign a refusal form
Ave been trying to consult pple some say I should do it since it's mandatory by law of the state others say if I don't have the money and it's not goin to be discounted for I should refuse it sign the forms instead of been stranded or been boxed to receiving any form of financial aid
Pls house I need your timely advise as ave told the lady to come while I decide on what to do.
Let me add that i delivered via an unplanned caesearean which added a new twisty to the all situation.
Has there been any body that refused the test of this kind,any consequence later for the child or future application.

The rate of refusal was about 99% from my estimation, and the crowd at the Abuja office was like a crusade.

Houston POE Experience!

DW left 9ja with Emirates last Friday (26/05/17), had 4 hours stop-over at Dubai before boarding to Houston. Spent 17 hours on air and landed in Houston around 4pm. DW and DM were not given any special treatment as DW is not the bigger-tommy type, so they didnt really notice DW is pregnant. Spent about 30 minutes on the queue. Meanhwile, there was this CBP that has been sending people to 2nd inspection constantly. DW was praying she should not be sent to her sad Alas! The dreaded CBP called DW, below is the transcript:

CBP: Why are you here?
DW: Child-birth and vacation.

CBP: (surprise look on her face) We no longer alllow that here from foreigners. It was actually cancelled last week.
DW: Not aware of that. I duly informed the embassy in Nigeria and such info wasn't given to me.

CBP: Why USA?
DW: For better healthcare due to complications I had during my previous childbirth

CBP: Why not UK, which is closer to you?
DW: I just prefer the US, didn't think about UK at all.

CBP: How much do you have?
DW: Bleep (I learnt this here - hehehe)

CBP: for Virginal or CS
DW: Virginal

CBP: Your estimate should be based on the highest quote which is CS
DW: Whichever case, I have sufficient funds.

CBP: Again, we have cancelled childbirth here by foreigners just last week. I will just have to allow you in for a week bla bla
DW: Was not aware of that. I have sufficient funds and no plan whatsoever to use any form of insurance. **at this point, DM started feeling bad and CBP asked her to go**

CBP called another officer to take DW in for secondary inspection and allow DM to proceed to baggage claim. The officer asked her to stamp DW in, she insisted that DW has to go for secondary. DW got to secondary, there were lots of people, DW waited for 2 hours before it got to her turn. So many people.

CBP asked same 1 & 2 questions. DW gave same answers.

CBP: Have you contacted any Doctor and hospital?
DW : Yes, I have the necessary correspondence with me.

CBP: How much do you have?
DW: $XXXXX, I also have fund on my cards and accounts.

CBP: Let me see the cash
DW: Handed it over to him to check. He looked at it and return the money back to DW

CBP: Make sure you get all your receipts and zero balances for verification when you are coming the next time.
DW: Noted, thanks.

He stamped DW in till Nov and asked another officer to take her to ML for cash declaration. At this time (7pm-ish), Agric and ML had closed, just one person came out to attend to us.

DW has been resting since Friday and out tomorrow for her first appointment. We learnt alot here and it pays to say the truth and be prepared. We got B1/B2 visa late last year, and declared we would like to use the visa for childbirth via change of intent. We only realised the opportunity to have our last baby there after getting the visa.

if you are processing nigerian passport for your yankee LO, you need NPC birth certificate but the place of birth will be USA even in the nigeria passport, you will just have to produce the american birth certificate for sighting and confirmation that the child was actually born abroad. the place of birth in my babys nigerian passport is USA, cos thats where she was born

It all depend on how informed all involved are. Citizenship defers from country to country. For Citizenship in Nigeria, we have by birth, registration and naturalization. Many mistake citizen by birth to being born in Nigeria. Meanwhile, the constitution state as follows: "Every person born in Nigeria before the date of independence, either of whose parents or any of whose grandparents belongs or belonged to a community indigenous to Nigeria; Provided that a person shall not become a citizen of Nigeria by virtue of this section if neither of his parents nor any of his grandparents was born in Nigeria. From the stated, No banker should ask for a made in Nigerian BC, and if you must get one it should be clearly stated that the child was born in a foreign land.

In my case place of birth on the registration form as it is called is Houston. If not I for waka straight.

For the birth certificate issue I will advice us not to jeopardize our children's chances in future. The birth certificate or registration is only for children born in the country. I was also in that dilemma when I wanted to open an account with GTB for my children. I went to one of the local Govt council and they asked me where I had the children and I told them in the US. And they said they only give birth certificate to children born in the country but you know the Nigerian factor, they said they will help me if I can pay 'something extra'
There is a column on the form for place of birth and they said I should write Eti-Osa which obviously is a lie. I just said NO thank you and I left.
Moral of the story : what if the child need to get an important appointment in future and a dispute arises as to his place of birth? The child can be accused of possessing different birth certificates.
Please let's do the right thing. Go to another branch present the birth certificate if he has a passport go along with it and your own passport as well. The only issue I had was that the name on the children's birth certificate does not correspond to the one on my passport. I explained that they use mother's maiden name for birth certificate in the US. I was asked to attach a copy of my marriage certificate and that was all the account was opened.

Yes I was in this situation in fact it was in January this year I went to first bank to open an account for my LO after submitting BC (us) ,Nigerian international passport for ID I was told to go and expect the account number but to my surprise it never came after 3 days I went back only to be told that I should bring birth certificate from Nigeria my God I was so vexed. The issue even made 2 of the managers in the branch to quarrel. The marketing manger said the US BC should suffice while the branch manager insisted on getting the Nigeria birth registration.
I think it's all depends on who is in charge.
But I just went to the LGA council which was close and got a birth registration/certificate at the cost of 500 naira. It's 500 multiplied by the number of years meanwhile it should be free.
Just don't mind them give to them and move on
If you are in rivers state You can also get it from the nearest primary health center ,LGA council or UPTH and other government health facilities to you.

If you are talking about getting Nigerian passport for an unborn child the answer is no.

Following the scarcity of Nigerian passport from abroad, is it possible to get the Nigerian passport for my LO in Nigeria and take it along with me to the US for her use to return to Nigeria? Has anybody tried this option? I read people now find it difficult to process emergency travel certificate (ETC), VOA too seems not to be readily available unless you know someone to help you out (as @desouls has helped many here). Quite a number of people are asking for @desouls contact while some are getting frustrated.

Please can @desouls give a step-by-step guide to be taken to process the VOA without necessarily calling for his/her contact anytime anybody wants to process the VOA.
